2. Answer all the questions.

UNIT-I Marks BL

1. a. “All torts are civil wrongs but all civil wrongs are not torts”. Explain.

b. Discuss the differences between a contract and a tort.

2. a. ‘A’ and ‘B’ both are lesbians, who are living together, decided to
marry. Both applied for the registration of marriage. But the registrar
of marriage refused to register their marriage. ‘A’ and ‘B’ filed a case 08 05
against the registrar for damages in Tort. Decide with reasons.

OR
b. Raju had not paid the electricity bill for the previous month to
Karnataka Electricity Board (K.E.B.). K.E.B. cut off the supply of
electricity to his house. On that day, there was a marriage function in
his house. Non-supply of electricity caused inconvenience to his 08 03
family. Raju filed a case against KEB for damages. Decide with
reasons.

UNIT-II
3. a. ‘Damage must be proximate, but not remote’. Comment with decided

b. ‘He, who consents to suffer injury, has no remedy’. Explain with
decided cases. 12 04

4. a. ‘A’ gave a bicycle to ‘B’, who is a minor on contractual basis for going
to school from home with a clear instruction that bicycle should not be 08 03
used for racing purpose. However ‘B’ used the bicycle for racing

purpose due to which the bicycle got damaged. ‘A’ filed a case against
‘B’ for damages in Tort, But ‘B’ refused to pay on the ground, “I am a
minor”. Decide with reasons.

b. ‘A’ met with an accident on the road and was bleeding. ‘B’, who
wanted to help ‘A’ to get admitted to hospital, asked ‘C’ to give his car
but ‘C’ refused to give his car. ‘B’ took it forcefully and carried ‘A’ in

the car to the hospital. ‘C’ filed a case against ‘B’ for trespass to goods
and claimed damages. Decide with reason.

5. a. Discuss the ingredients of nuisance.

6. a. ‘A’ collected a number of cobras in his house. One day, a cobra
escaped from ‘A’s house to neighbor’s house and bit ‘B’ and his

buffalo. ‘B’ suffered severe health problem and the buffalo died. ‘'B'’
filled a case against ‘A’ for damages. Decide the liability of ‘A’.

b. ‘A’, a pregnant woman was watching a live airshow on the television.
Two aircrafts during the show collided with each other and fell on the
people who were watching the show physically. There was severe
human casualty and parts of the various human bodies were scattered 08 03
in that area. ‘A’, who was watching all this on television suffered
nervous shocks and filed a case against the organiser of the show for
damages. Decide with reasons.

8. a. ‘A’ wrote defamatory words against ‘B’ in an open letter (Post Card)
and posted that letter to ‘B’s address. ‘B’ filed a case against ‘A’ for

10. a. Karnataka State Road Transport Corporation (KSRTC) has appointed
‘A’ as driver and ‘B’ as conductor for a Bus. ‘A’ parked the bus on
parking space during the lunch time and went for lunch. The conductor

tried to get the bus ready for next trip, drove the bus and caused injury
to plaintiff. Decide the liability of K.S.R.T.C. with reasons.

OR
b. ‘A’s bus and ‘B’s bus collided, because of which ‘C’, who is travelling
in ‘B’s bus suffered injury and filed a case against ‘A’ for damages.
‘A’ took defense that it is ‘B’s negligence that caused the damage, 08 03
hence he was not liable. Decide with reasons.
