About Flexi-MoU:

✓ The “Flexi-MoU” Scheme is being govern by the Ministry of Skill


Development & Entrepreneurship (MSDE), Government of India.

✓ It is being regulated by the Directorate General of Training (DGT).

• The Industry can hire any 8th/10th/ 12th pass candidates.


• Any age group between 16 < 40 can be enrolled.
• Such Candidates will be define as “Student-Trainee”.
• These candidates will be deployed at shop floor for OJT (On the-Job-Training).
• The tenure of the OJT will be 24 months (2 Years).
• There is no obligation to the industry, to hire post training completion.
• There will be no relation i.e. Employee-Employer.
• No statutory applicability will lies on such candidates.
• Candidate will appear in to the examination annually.
• After the successfully completion of the tenure & passing the exam, the student-trainee
will be rewarded with the CTS-ITI certification by NCVT.
• There is no caping define to hire the candidates. The industry can offer as per the need.
• The industry will act as an institute under this scheme to allow the students for the OJT
purpose.

This is with reference to your letter dated 09.09.2015 on the above cited
subject.
In this regard, a clarification on the status of student-trainees has been issued
by Head Office vide this office letter No. Coord./40(5)201
5/Misc./Clarification/27308 dated 12.10.2015 ( A
copy thereof is enclosed herewith for ready reference).

Therefore, the payment of stipend, if any, provided by the industry to such


student- trainees do not attract the provisions of the Employee Provident
Funds & Miscellaneous Provisions Act, 1952. However for the students
getting placement in companies and appointed as employees of
establishment, Employee Provident Funds &
Miscellaneous Provisions Act, 1952 will be applicable on such employees
even during on the job
training/induction/other trainings taken after becoming employee.

About NATS :
➢ NATS – National Apprenticeship Training Scheme.
❖ The National Apprenticeship Training Scheme (NATS) in India is a one year program equipping technically qualified
youth with Practical knowledge and skills required in their field of work.
❖ The Apprenticeship are imparted training by the organizations at their place of work. Trained Managers with well
developed training modules ensure that Apprenticeship learn the job quickly and competently.
❖ During the period of apprenticeship the apprentices are paid a stipend amount, 50% of which is reimbursable to the
employer Industry from the Government of India.
❖ At the end of training period of apprentices are issued a certificate of Proficiency by Government of India which can be
registered at all employment exchanges across India as valid employment experience.
❖ The apprentices are placed for training at Central, State and Private Organizations which have excellent training
facilities. National Apprenticeship Training Scheme is one of the flagship programs of Government of India for skilling
Indian Youth.
❖ The Apprenticeship training is one of the sources to develop skilled manpower for industry, by using training facilities

Industries – Why “NATS” ?
This scheme bridges the gap exiting in the Market place,
between the employer’s requirement in an Employee and
the talent pool of student available in the Market.

• It allows the organizations to recruit raw, technically qualified candidate, train


them for one year with subsidy from Government of India and absorb them on
regular roles if the need arises.
• The Apprentices are governed solely by the Apprentice Act 1961. The
organization engaging apprentices should posses the requisite infrastructure
and trained managers to impart training to the apprentices.

Highlights :
• 50 % of the Total Stipend will be refund as subsidy from Government of India.
• Government will reimburse the 50% subsidy (up to Rs. 4500/-) of the total
paid stipend to the Establishment.

NATS – Apprentice Trainee – Important
Points:
As per Government Policy the prescribed stipend rates for Apprentice Trainee under NATS:

A Sandwich course is one which takes one more year than the usual course. In Engineering, Sandwich
course often have 6 year of course of Study.

• The During Apprentice Trainee’s Industry Program is 1 Year for General Degree (Graduate) & Diploma Candidate and
06 month for Sandwich *Degree Candidate.
• If an new NATS Trainee join any organization & if he/she quit from the training after working only for few month (not
completing the 1 Year duration), then he/she will be disqualified for the lifetime for NATS program
• In case; any Apprentice work in two organization under NATS program, and if his/her total working duration crosses the
prescribed program duration, that current organization as well as current organization can ask him/her to reply all the
stipend paid by the organization as well current organization can also terminate him/her with immediate effect.

PROVISIONS IN APPRENTICES ACT, 1961

Eligibility of Apprentices
• 14 years and above and 18 years and above for hazardous industries
• Class V and above
• Apprentices are trainees not employees

The main objectives of the Apprentices Contract


Contract between establishment and apprentice is the mandatory requirement

SOME LEGALITIES ON APPRENTICESHIP

Each Apprentice undergoing apprenticeship training in designated/ optional trade in an establishment shall be
a trainee and not to be considered as a worker

The provision of any law with respect to labor shall not apply to or in relation to such apprentices

An apprentice engaged under the Apprentices Act, 1961 is not counted for coverage under the ESIC Act,
1948 (Section 2(9)(1)

Companies are advised to take WC Policy

APPRENTICES ACT: FLEXIBLE-DISCRETION TO
COMPANIES TO DESIGN/PLAN

Band Can engage apprentices within a band of 2.5% to 15% of its workforce.

Duration of apprenticeship between 6-36 months. Left to establishment discretion. Can conduct
Flexibility Basic Training in-house; Basic Training can be conducted sequentially or simultaneously with
on-the-job training. (*Tenure is the subject of job role under the candidate is engaged)

Design Over 500 trades available. In addition, industry has flexibility to Design own Courses
in line with their Technologies / Future requirements.

SCOPE OF WORK UNDER NAPS

Role of TPA / DISTIL as a TPA (Third Party Aggregator):


• Assist the establishment to get register on apprenticeship portal.
• Mobilization, Counseling of Trainees.
• Assist the candidates for registration on portal.
• Upload contracts of apprenticeship on the apprenticeship portal on behalf of the establishment.
• Assist the establishments to get approval for Basic Training Centers (BTCs).
• Arrange the basic training under Apprentices Act.
• Furnish all the returns on the portal-site on behalf of the establishment.
• Submit reimbursement claims on behalf of establishment towards stipend paid to apprentices.
• Submit reimbursement claim for basic training cost in case establishment is the basic training provider under
NAPS.
• Assist the establishment to conduct assessment and issue certificates.

Scope of Company:
Enter into contract of apprenticeship with apprentices

Provide on-the-job training /practical training at his workplace (or at a common place as coordinated on his behalf by

Reimbursement of Rs. 1500/- per trainee per month

NATS No Statutory Applicability (No PF, ESIC, Bonus, Gratuity, Leave Etc. Any Graduate/Diploma pass 1 Year 15% of total strength

Reimbursement of Rs. 4500/- per trainee per month
