Introduction

Criminology is a science whose function is to explain and prevent crime, to intervene in the
person of the delinquent and to evaluate the different models of response to crime. "For
whose application new professions are needed: psychologist, social worker, criminologist,
educator". This science allows us to act in the prevention and not just the repression of
crime by fighting the causes.

In the present work, matters related to Crime and Punishment will be addressed, where in
the course of the same it will only deal with matters found to be pertinent to the subject in
question, not forgetting the respective criminal types and prevention as a factor in reducing
crime.

Crime and Punishment

Crime is an infraction of greater offensive potential and a type of species of the genre
Criminal Infraction, which is all conduct that generates criminally relevant injury to a legal
asset protected by the state, which is previously typified as illicit and that expressly
determines the primary concept and secondary of the criminal type.

The word comes from the Latin term crimen, or delict, considered as the violation of a
penal norm - criminal law, not punishable by law or by a state or other authority when the
facts are not committed with intent or negligence but are determined for an illegality or
violation of the rights of others. If the illegality is committed by himself and against
himself, or against third parties, and he reacts to this illegality or promotes the opposite
reaction of third parties, he alone is responsible, and therefore punished for all the
following facts by reason of authorship ( person who starts all the facts in sequence until
the end of the crime, event, catastrophe or monstrosity).

In short, we all commit crimes, even in our daily lives, whether through deceit or lies or
abuse of power. But a “punishable crime” is committed illegally or in a manner prohibited
by criminal law and therefore with conscience or responsibility and always to achieve an
illegitimate purpose, or against the law, or for example simply to cause harm to a third
party. On the contrary, the reaction to a malicious act (legitimate defense or the state of
necessity), or the reaction to a punishable crime, are facts committed legitimately and often
with courage, which is why they are not punishable and often even to their agents are
assigned the title of heroes of good or humanity.

Law is a power, but a power of legitimacy and not of illegality, which is why, by law,
consent to the commission of a punishable crime, against oneself or against third parties, is
always also a punishable crime. Because the law prohibits the commission of any
punishable crime and for whatever reason.

Some Types Criminal

Each criminal type generates a harmful result to some different legal interest, and therefore
the way of planning, executing and consummating are different, some generate more severe
results and others less severe, some damage material and financial goods, others damage
the human body, or mental health, as well as the morals and customs of a society. For this
reason, for the purpose of studies and to support criminal legislation, the conducts
considered as crimes were grouped according to the legal interest achieved.

Crimes against the person

 Homicide - killing someone


 Infanticide - killing one's own child, during childbirth or soon after, under the
influence of the puerperal state
 Manslaughter - when there is no intention to kill, the death being caused by
malpractice, negligence or imprudence
 Intentional homicide - when there is intent to kill or when the agent assumes the
risk of causing death

Crimes against honor

 Injury (verbal, written or staged offense)


 Slander (falsely attributing a crime to someone)
 Defamation (disgraceful propagation against someone's good reputation).

Crimes against property

 Pilfer - subtraction of someone else's mobile.


 Theft- subtraction of someone else's movable property through violence.

Prevention as a crime reduction factor

The repression of crime by the police is limited, first, by the lack of personnel to contain
crime. Second, due to the lack of working conditions: obsolete weapons, vehicles in small
quantities, lack of fuel, etc. And third is the lack of prisons capable of absorbing the
criminal population. The increased judicial apparatus means more prisoners and not
necessarily less crimes. The solution to crime does not lie in strengthening the police in all
its aspects, but in an effective form of prevention.

"Effective crime prevention does not depend so much on greater effectiveness of formal
social control, but on better integration or synchronization of formal and informal social
control" ( MOLINA, p.124)

Simple prevention starting only at school is also not recommended, as the child must be
assisted in all his developmental aspects and not just the educational one.

"The approach to preventing conflicts associated with violence must be interdisciplinary;


from mental health services to social protection institutions and formal education centers
should be involved in prevention" (ORTEGA ; DELREY , 2002, p. 22).

It is necessary to associate the educational area, the health area, social protection
institutions and the police in the fight against crime by acting directly on its causes.

The school's role in crime prevention - between the ideal and the real.

The school is a space where critical citizens and human beings should be formed,
contributing to social inclusion. Seeking in the construction of equality the management of
interests, rights and duties of the individual.

By building a democratic collective project and valuing the school, it is possible to train
professionals for society capable of taking a stand in decision-making processes and
conflict management committed to the public space. Within this perspective, the school
would cultivate a space for culture and human relations permeated with social values such
as: respect, justice, solidarity, commitment, equality, democracy.

"The institution must partner with associations of parents, residents and youth groups, so
that students have different experiences. It is also necessary to invest in multiplied
professional training courses. Teachers have to bring a positive culture to schools".

"The school has not only the role of transmitting knowledge, but also the objective of
training the subject. The student must be a partner of the institution and not an opponent of
it".

Conclusion

After carrying out the present work, it is concluded that criminality, taking into account the
latest developments, is beginning to take shape which, without alarmism or lack of control,
needs transversal responses involving economic, social and police measures, to mitigate the
wave growing.

Alongside the advanced solutions above, there is no doubt that human behavior on the part
of potential victims of crime can also make all the difference. Maintaining vigilance,
leading an honest life, avoiding situations that could eventually stir up or transform the
opportunity for the thief, among other defensive practices, can significantly reduce the
possibility of being the next victim.
