THE CORRECT POSITION/INFORMATION OF THE PURPORTED
COMPLAINT BY MY ELDER BROTHER MR. TUNDE SUNDAY OHIJEI
AS RECORDED IN THE MINUTES AS READ BY THE SECRETARY MR.

I wish to correct the wrong impression that I was summoned to the quarter
Egwai more than five (5) times and I failed to turn up since the last date I appear
with my elder brother to answer why I was not in attendance when the quarter
gathered for the burial ceremony of our Late Mother Madama Zelebu Dauda Nee
Izevbekhai at his residence.
I wish to put the records straight as follows:
(A)
(1) That my first invitation to appear before the elders and members of
Ogwounu family was through phone calls by the Ukor Mr. Deboy Iholevbo
on the 19th February, 2022 on why I was absent at our mother’s burial
ceremony.
(2) That I informed the elders on that day through phone conversation that I was
indisposed.
(3) That I was prompted to appear the next day 20 th February, 2022 to honour
the invitation.
(4) That I was again prompted to appear in two (2) weeks after the above date.
(5) That I promised to make myself available whenever I get well.
(6) That on the 1st day of May, 2022, I honoured your invitation of 19th
February, 2022 when I was strong enough to attend Egwai.
(7) That on the 1st of May, 2022, the quarter looked into the matter of 19 th
February, 2022 and found out that my elder brother and two junior sisters
never informed me about the said burial ceremony.
(8) That it was later resolved that the quarter will intervene on the lingering
problems between me and my elder brother at a date to be communicated to
us. The minutes of on the 1st May, 2022 should be revisited.
(B)

(1) On the 26 of October, 2022, Mr. Atolokhai Sado who has sworn to be my
enemy since the death of my mother on the 27 th of November, 2021
approached me in the main road about 3:00pm. He said he volunteered to
inform me of my summons to Egwai on the 30th October, 2022.
(2) That I challenged him on why he who has been keeping malice with me
since the demise of my mother should volunteer to carry this message and
more so he could not tell me who summoned me to Egwai.
(3) His reply was that no other person agreed to take the message to me even
when himself has my phone numbers. He said he was going to tell the Egwai
that I said I was not going to attend the summons. There was no known
insults Mr. Atalokhai Sado did not rain on me.
(4) I immediately left him to the residence of the Regent Mr. Imonikhe Idonije
to report the conduct of Mr. Atalokhai Sado to him where I informed him
that 30th October, 2022 was not feasible to me since I have an engagement in
Benin City that day. His reactions equally shocked me.
(5) That on the 13th of November, 2022 being the next date of the Egwai sitting,
I made myself available to where I was accused of:
a. Not honouring summons by my elder brother Mr. Tunde Sunday Ohijei
for over five (5) times.
b. That I transfered the case between me and my siblings at Afuze police
station to Edo State Police Command, Benin City Headquarters which
you have earlier settled.
c. That all my efforts to put the records straight about the chronicle of
events proved abortive.
d. A verdict of one she goat (Odieghe) and Ten Thousand (N10,000) Naira
Only was imposed on me even when I tried to tender the video record of
our late mother to set the records straight.
e. That what happened at Egwai on the 13th of November, 2022, was not
only an ambush but a premeditated verdict of which I earlier complained
about to you on my first appearance on 1st May, 2022, which you all
denied.
Note that our late mother’s video was recorded by Agboidebama’s son.
 f. That from on the 27th November, 2021 at 3:00am till about 2:00pm, the
day our mother died in my house and even till date, none of you paid me
condolence visit except Ms Justina Omage Oikerhe.
g. That I incident the case of the attack on myself and my properties at
Afuze police station on the 30th December (4th day after the attack) with
only two(2) prayers as follows;
(i) That my siblings should write undertaking about the safety of my
life and.
(ii) The safety of my properties.
h. That even when I complained about my ill health on the 19 th February,
2022 on the day my elder brother and my junior sisters were doing the
burial ceremony of our mother at Ivbiogwounu Quarters, none of you
deemed it fit to verify my claims, this was after your refusal to honour
my invitation through the Regent Mr. Imonikhe Idonije and the most
senior woman of the quarter, Mrs. Oheneta Daniel Idonije about the 40 th
Muslim Burial Ceremony of our Late Mother which took place on the 7 th
January, 2022 in her father’s residence at Ovongbuan Quarters Ihievbe,
according to Ihievbe custom and tradition.
i. That even throughout the period the matter lasted at Afuze police station
and later transferred to the office of the commissioner of police Edo State
command, none of you visited the police stations as it has been in other
cases between member of Ogwounu family to broker peace.
j. That I make bold to state that there are numerous police cases amongst
members of Ogwounu family at various stages that were withdrawn at
the intervention of Ogwounu Egwai. Why my own case is different is to
confirm the popular adage “that in the court of Lions, Tigers and Hyenas,
a goat can never get justice”.
However, I wish to place the record straight by this write up as follows:

(a) That what transpired on the 1 May, 2022 at Egwai was my refusal to
participate in our mother’s burial ceremony on the 19 th February, 2022
which was not disputed by my elder brother that I wasn’t informed.
(b) That it was equally resolved on that day that the quarter will schedule
another date to settle the lingering quarrel between me and my elder brother
on a date to be communicated to us. You may revisit the minutes of on the
1st of May, 2022 for proper understanding.

(a) On the 26 of March, 2022, Mr. Shaka Dauda Alabi my half brother,
restituted for his/their willful and malicious damage of my Camry Car with
Reg. No. KRD 964AA at the Afuze Police Station.
 (b) That instead of the police to keep the (N91,000) the money in their custody
as earlier agreed and documented by Mr. Shaka Dauda Alabi, they cajoled
me to take the money and go after the repairs of my damaged car.
(c) The DCO further advised my elder brother Mr. Tunde Sunday Ohijei to as a
matter of urgency, pay visit to my Auchi residence, (where I have been
taking care of our mother for several years, which he was yet to known till
date) and then gather all his junior ones, since Mr. Adamu Izevbekhai at
whose instances the case has been adjourned severally could not broker
peace.
(d) That my elder brother fixed 18 th April, 2022, being Easter Monday for
harmonious settlement at his residence.
(e) That the DCO Afuze further advised us to come back for a feedback and
then close the case file. All these happened in the presence of Mr. Muminu
Dauda Alabi the half brother to Mr. Shaka Dauda Alabi, my half brother.

(a) That my petition to the Commissioner of Police Edo State was dated 12 th of
April, 2022 – 24 days before 1 st of May, 2022. Photocopies of my petitions
to the DPO Afuze and the Commissioner of Police Edo State and the
chronicle attached.
(b) That their first appearance at the Area Command Benin City was 9 th August,
2022 – 4 months of the transfer.
(4) That as at the time of my petition to the Commissioner of Police Edo State
command, it was obvious that the police at Afuze have already compromised
the case before it as follows;
(a) That the police failed to invite two of the suspects Messrs. Friday Elijah and
Odion Elijah to make their formal statements.
(b) That the police equally failed to visit the scene of incident despite being
adequately mobilized till the case was transferred.
(c) That the police refused the custody of the N91,000 as contained in the
written statements of my half brother Mr. Shaka Dauda Alabi.
(d) That my elder brother Mr. Tunde Sunday Ohijei failed to pay a visit to my
house at Auchi and equally failed to convey the settlement meeting he
schedule for 18th August, 2022 as promised at Afuze Police Station till date.
(e) In all these, there is no where I acted as erroneously believed in certain
quarters and by some of you that I claimed to be the sole care giver to our
mother nor seized the corpse of our mother. If that was the case, I would
have made attempt to bury our mother at my residence between 3:00am of
27th of November, 2021 and 2:00pm when I was attached.
(f) That the withdrawal letter at Benin City Area Command was at the instance
of our mother’s elder brother, Alhaji Abibu Bello and Alhaji Nashiru Eroje
 the most senior elder of Ovongbuan Quarters (where our mother was born)
and all Ovongbuan community. Photocopy of the withdrawal letter is hereby
attached.
(5) For your information, the DCO Afuze, Mr. Reuben Aitakhiamen has since
apologized to me about the way and manner they handled the case in writing
and verbally. Those who claimed to know the DCO, may go and verify from
him.
