Whereas:
The undersigned being the Authorized Officer of the Indian Bank under the
Securitization and Reconstruction of Financial Assets and Enforcement of
Security Interest Act 2002 and in exercise of powers conferred under Section 13
(12) read with Rule 8 and 9 of the Security Interest (Enforcement) Rules, 2002
issued a Demand Notice Dated 29.05.2019 calling upon the Borrower M/s. Filo
Trading Co., C/10, Gitanjali Park, Amuja, City Centre, Durgapur - 713216,
Paschim Bardhaman, West Bengal, and also at Gostha Pal Bithi (Sail Co-Op),
City Centre, Durgapur - 713216, Paschim Bardhaman, West Bengal, Sri Babla
Balmiki, S/o. Sri Antoni Balmiki (Proprietor) & (Guarantor/Mortgaor) at 1D/24,
Vidyapati Road, B-Zone, Duragpur - 713205, Paschim Bardhaman, West Bengal
and Smt. Kamala Balmiki, W/o. Sri Niru Balmiki (Guarantor) at 1D/24, Vidyapati
Road, B-Zone, Duragpur - 713205, Paschim Bardhaman, West Begal having
Cash Credit Loan (50263042846) - with our Asansol Branch now transferred to
SAM Large Kolkata Branch to repay the amount mentioned in the notice being
Rs. 1,07,16,906.00 (Rupees One Crore Seven Lakhs Sixteen Thousand Nine
Hundred Six Rupees only) within 60 days from the date of receipt of the said
notice.
The borrower having failed to repay the amount, notice is hereby given to the
borrower and the public in general that the undersigned has taken possession of
the property described herein below in exercise of powers conferred on him / her
under Section 13 (4) of the said Act read with Rule 8 and 9 of the said rules on this
19th Day of June of the year 2024.
The borrower in particular and the public in general is hereby cautioned not to deal
with the property and any dealings with the property will be subject to the charge of
the Indian Bank for an amount of Rs. 1,07,16,906.00 (Rupees One Crore Seven
Lakhs Sixteen Thousand Nine Hundred Six Rupees only) and cost, charges and
interest thereon.
“We draw attention to the provisions of Section 13(8) of the SARFAESI Act
and the Rules framed there under which deals with your rights of
redemption over the securities.”
Description of the Immovable Property : Landed property situated at J. L.
No. 27, R. S. & L. R. Plot Nos. 4781, 4781/4925, 4781/4926, R. S. Khatian No.
453/1, L. R. Khatian No. 1794, Mouza - Debshala, P. S. Budbud, A.D.S.R Mankar
and Plot No. 109, Khatian No. 325 of Mouza - Jatgoria, P. S. - Kanksa, A. D. S. R
Durgapur measuring 4.78 Acre, in the name of Shri Babla Belmiki under the
District of Paschim Bardhaman, represented vide Deed No. 00717,Volume 3,
Book No. 1 , registered on date 05.02.2015. Butted & Bounded By - For
Khatian Number 325 : North - By Property of Kalo Bauri, South - Property of
Aashia Bibi, East - Barren Land, West - Property of Sheikh Barkat. For Khatian
Number 453/1 : North - Land of Meteder, South - Property of Kamakhya Kivkar,
East - Drain, West - Jungle.

We do hereby cancel and/or revoke our previous possession notice(s)

issued to you under section 13(4) of SARFAESI Act 2002 and the actions
taken thereafter, pursuant to the said notices, without prejudice to our
rights and remedies as available under the relevant provisions of the said
Act and rules framed there under.
