Campus giving my daughter Sheenly L. Cordova of LSPU-SCC Architectural

Drafting Technology IV-B student the permission to undergo OJT/SIT this first

semester of Academic Year of 2021-2022 at Caliraya Builders in Lumban, Laguna

under the supervision of Mr. Fernando V. Legazpi, in compliance with the

requirements of the degree Bachelor of Science in Industrial Technology major in

Architectural Drafting Technology, which she is compelling.

WAIVER

November 2021

I, SHEENLY L. CORDOVA, a student of the Laguna State Polytechnic


University, Santa Cruz Campus, hereby voluntarily agree to undergo an On-the-Job-
Training (OJT) for 720 hours at CALIRAYA BUILDERS, Lumban, Laguna. I also
understand that this OJT is a curricular requirement for graduation in the BSIT degree
and that I agree to take it under the following terms and conditions.

a. That I shall abide by all the corporation’s rules and regulations and otherwise I
shall be excluded for further participation;

b. That there is no labor-management relationship between me and the establishment

c. That I shall exercise care and diligence in any task assigned to me;

d. That I shall renounce and waive my claims against_________________ for any


inquiry that I may sustain in the performance of my duties or functions while under
training, and;

e. That I shall be made answerable or any liability or damage to property or injury to


any person while undertaking the OJT.

MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:


This Memorandum of Agreement was made and executed, by and between
LAGUNA STATE POLYTECHNIC UNIVERSITY-Sta. Cruz Campus (LSPU-SCC) is
daily organized and exists under Philippine Laws with principal address at Brgy. Bubukal,
Sta. Cruz Laguna represented solely by the will of the student trainee SHEENLY L.
CORDOVA of ADT IV-B hereinafter referred to as the FIRST PARTY
CALIRAYA BUILDERS with its principal office address Nat’l Highway, Lumban,
Laguna represented herein by its President Mr. Fernando V. Lhereinafter referred to as
SECOND PARTY.
WITNESSETH
WHEREAS, the Dual Training System Law ( R.A.7686 ) recognizes the need to balance
theoretical instruction with practical hands-on training to develop a skilled and highly
productive, and employable manpower
WHEREAS , CORDOVA, SHEENLY L., ADT student of LSPU- SCC endeavors to
establish with CALIRAYA BUILDERS depending on the company’s requirement for an On-
The-Job Training OJT of its students for the practicum exposure in the industry as part of the
college curriculum.
WHEREAS, the CALIRAYA BUILDERS depending on the company’s requirement for an
On-The-Job Training (OJT) agree to assist the student from Laguna State Polytechnic
University in developing productive and skilled future workers thru the OJT program.
NOW, THEREFORE, for in consideration of the foregoing premises and subject to
conditions hereunder set forth, the party hereto hereby agrees as follow:
A. First Party shall:

1. Issue an official endorsement vouching for the well-being of the On-The-Job student-
trainees as well as other pertinent documents that shall be used by the Second Party in
processing the application of the said OJT’S such as curriculum vitae: together with the
parent consent waive any claim for an injury that the students may sustain or suffer
whether personal or pecuniary in the performance of their duties and functions while
under training, NBI Clearance; Fit to Work Medical Certificate from Medical
practitioner
2. Provide their On-The-Job student-trainees with the basic orientation on work values,
behavior, and discipline to ensure smooth cooperation with the Second Party.
3. Endorse student-trainee to the Second Party.
4. Assist in the monitoring of the performance of the student-trainees.
B. Second Party shall

1. Accommodate trainees from LSPU-SCC depending on the company’s requirement


and qualifications for an On- - Job Training (OJT) for a minimum of three (3) months
period and a maximum of four (4) months period.
2. Assign personnel to take charge, design, implement and evaluate the training
plan jointly with the accredited establishment. Specific assignments for each student-
trainee shall be at the Second Party’s sole discretion which will be subject to change
from time to time upon written notification to the designated program coordinator.
3. Issue the certificate of training upon the completion of the program.
4. Provide uniform (T-shirt) safety gadgets, shuttle service subject to company
policies.
5. Make available free of charge consumable materials and basic hands tools and
equipment necessary for training
6. Require the trainees to keep updated report book ready for inspection at any given
time
7. Allow the OJT coordinator & placement Officer of LSPU-SCC to visit the station
at least quarterly to monitor the status of the program schedule.
9. Endure that the provision of this agreement is properly implemented and
coordinated with the training center for ensuring high standards of training.
C. Under this Memorandum of Agreement the following terms conditions are likewise
included:
1. The Second Party is not obliged to pay additional compensation of any kind. It is expressly
understood that there will be no employee-employer relationship between the Second Party
and the student-trainee of the First Party.
It is understood and agreed that the First Party shall be acting as an independent entity and not
as an agent of the Second Party and the student-trainee shall not be acting as agent or
employee of the Second Party.
The student-Trainee will be personally responsible for any liabilities or injury to the third
persons that may be occasioned by their intentional or negligent acts while in the course of
their training
2. The Student-Trainee and the First Party Program Coordinator shall abide by the Second
Party’s rules and regulations and comply with those imposed for the program otherwise they
shall be excluded from further participation.
This agreement may be terminated for convenience by the Second Party upon prior written
notice to the First Party Supervising Coordinator. As such, participation in the training
program does not imply any future employment rights of the trainee. The Second Party
neither represents nor implies any obligation to the trainees upon completion of the Training
Program
E. Effectivity
This agreement shall be effective upon the date of signing regardless of the date of
execution hereof, and shall continue thereafter up to ______, _____ provided however that
any provision of this Agreement may be amended by written consent of both parties herein
and provided further that the Second Party or First Party reserves the right to withdraw its
participation in the Agreement upon written notice.
F. Release of Information

Neither party shall publicly announce the existence of this Agreement or advertise or
release any publicly regard hereto, during, and after the existence of this agreement without
securing the written consent of the other.
G. Entire Agreement
This Agreement represents the complete and fully integrated understanding of the
parties and is intended to incorporate and supersede all previous negotiations, written or oral,
and may not be altered, change, amended, or modified except by an Agreement in writing
signed by both parties.
H. Governing Laws
The terms and conditions of the Agreement and performance hereunder shall be construed by
the laws of the Republic of the Philippines.
In WITNESS WHEREOF, the parties have signed this agreement this ___________2022 in

Lumban, Laguna, Philippines.
