ደንብ አውጥቷል፡፡
1. Short Title
፩. አጭር ርዕስ
This Regulation may be cited as the “The

ሊጠቀስ ይችላል፡፡

፪. ትርጓሜ 2. Definition
በዚህ ደንብ ውስጥ የቃሉ አገባብ ሌላ ትርጉም In this Regulation unless the context otherwise
የሚያሰጠው ካልሆነ በስተቀር፡- requires:
፩/‘‘ባለሥልጣን” ማለት በኢትዮጵያ ፌዴራላዊ
1/ “Authority” means the Environmental
ዲሞክራሲያዊ ሪፐብሊክ የአስፈጻሚ አካላትን Protection Authority established under Article
ሥልጣንና ተግባር ለመወሰን በወጣው አዋጅ 59 (1) of Proclamation No.1263/2021 on the

፪/ “የአካባቢ ጥበቃ ” ማለት የሰው ልጅን ጨምሮ 2/ “Environmental Protection” means the
የማንኛውም አካል ሕይወት እና እድገት protection of land ,water, air, climate system
የሚወስኑ የመሬት፣ የውሃ፣ የአየር፣ የአየር and similar other environmental resources,

interests of the present generations without
የመጪውን ትውልድ ዕድል ሳያሰናክል
compromising the opportunity for the future ;
እንዲሟላ ማስቻል ነው፤
3/ “Environmental Laws” means; environment
፫/“የአካባቢ ሕጎች” ማለት ከአካባቢ ጥበቃ ጋር
related Policies, Strategies, Proclamations,
ተያያዥነት ያላቸው በሥራ ላይ ያሉ እና
Regulations and Directives that are currently
ወደፊት የሚወጡ ፖሊሲዎች፣ ስትራቴጂዎች፣
under implementation and that will be
አዋጆች፣ ደንቦች እና መመሪያዎች ነው፤ promulgated in the future;
፬/ “መጤ ወራሪ ዝርያ” ማለት የስነ-ምህዳር 4/ “Invasive Alien Species” means a plant, an
ተወላጅ ያልሆነ እፅዋት፣ እንስሳት እና ደቂቅ animal or microbe that is non-native to an

5/ “Ecosystem” means a complex natural or

6/“Climate Change” means a change of climate
፮/ “ የአየር ንብረት ለውጥ ” ማለት ከተፈጥሮ
which is attributed directly or indirectly to
የአየር ንብረት ተለዋዋጭነት ባሻገር በዋናነት
human activity that alters the composition of
በሰው ልጆች ቀጥተኛም ሆነ በተዘዋዋሪ ከሚደረግ
the global atmosphere and which is in
እንቅስቃሴ የተነሳ በረጅም አማካይ ወቅት addition to natural climate variability
በአየር ንብረት ላይ የሚከሰት የከባቢ አየር observed over comparable time periods;
ይዘት ለውጥ ነው፤

፯/ “የአየር ንብረት ለውጥ ማጣጣሚያ” ማለት በአየር 7/ “Climate Adaptation” means adjustments in
ንብረት ለውጥ ምክንያት ለተከሰቱ እና ecological, social, or economic systems in
እንደሚከሰቱ ለሚጠበቁ ተፅዕኖዎች በሥርዓተ- response to actual or expected climatic

፰/“የአየር ንብረት ለውጥ ማስተሰርያ” ማለት 8/ “Climate Mitigation” means any efforts to
የሙቀት አማቂ ጋዞች ልቀትን ለመቀነስ ወይም reduce or prevent emission of greenhouse

ለመከላከል የሚደረግ ማንኛውም ድርጊት ነው፤ gases;

፱/ “የሙቀት አማቂ ጋዞች ” ማለት በከባቢ አየር 6/ “Greenhouse Gases” means those
ውስጥ በተፈጥሮ እና በሰው ሰራሽ የሚገኙ ጋዞች gaseous constituents of the atmosphere,
ሆነው የረዥም ሞገድ ጨረሮችን ለረጂም ጊዜ both natural and anthropogenic, that absorb

የሚይዙ እና መልሰው ወደ ምድረ ገጽ የሚለቁ and retain for a long period of time and re-

ጋዞች ናቸው፤ emit long wave radiation to the earth;

፲/ “ ካርበን ” ማለት ሕይወት ባላቸው እንዲሁም 7/ “Carbon” means a chemical element found
በሌላቸው አካላት ውስጥ የሚገኝ ከኦክስጅን ጋር in living and non-living things that creates a
ሲዋሃድ ሙቀት የማመቅ ባህሪይ ያለው ጋዝ gas with a nature of heat absorption when
የሚፈጥርና በከባቢ አየር ውስጥ ያለው mixed with oxygen; that results warming;
ተፈጥሮአዊ ክምችት በሰው ሰራሽ ምክንያቶች
ሲጨምር የምድር ሙቀት መጨመርን
የሚያስከትል ንጥረ-ነገር ነው፤
፲፩/ “ የካርበን ንግድ ” ማለት ወደ ከባቢ አየር 8/ “Carbon Trade” means a carbon market
ሊለቀቅ የሚችል የካርበን መጠንን መቀነስ ወይም system in which payment is made for carbon
ማስወገድ ወይም የተለቀቀውን የካርበን ልቀት emissions reduced, removed, or avoided;

መጠን በመቀነስ ክፍያ የሚፈፀምበት የግብይት

ሥርዓት ነው፤
፲፪/“የሚመለከታቸው ተቋማት” ማለት የአካባቢ 9/ “Relevant Institution” means any Federal
ጥበቃን በተመለከተ በህግ ሥልጣን የተሰጣቸው or Regional Government organ entrusted by

፲፫/ “ሰው” ማለት የተፈጥሮ ሰው ወይም በሕግ 10/ “Person” means natural or legal person;
የሰውነት መብት የተሰጠው አካል ነው፤
፲፬/ ማንኛውም በወንድ ፆታ የተገለፀው አገላለፅ 14/ Any expression in the masculine gender

ሴትንም ይጨምራል፡፡ includes the feminine.

፫. ዋና መሥሪያ ቤት 3. Head Office

The Authority shall have its head office in
የባለሥልጣኑ ዋና መስሪያ ቤት በአዲስ አበባ ሆኖ
Addis Ababa and may have branch offices
በሀገሪቱ ውስጥ በተለያዩ ቦታዎች ቅርንጫፍ ሊኖሩት
elsewhere, as may be necessary.

፬. የባለሥልጣኑ ዓላማ 4. Objective of the Authority

የባለሥልጣኑ ዓላማ ማኅበራዊና ኢኮኖሚያዊ The objective of the Authority is to issue

activities that require environmental licensing
ደህንነትን በዘላቂነት ሊያራምዱ እና ሊያጎለብቱ
which foster social and economic
የሚያስችሉ የአካባቢ ደረጃዎችን የማውጣትና
development in a manner that enhance the
በወጣው ደረጃ መሠረት መተግበሩን ማረጋገጥ እና
welfare of humans and the safety of the
ፍቃድ በሚያስፈልጋቸው አካባቢያዊ ጉዳዮች ላይ
environment, and regulate their

፭. የባለሥልጣኑ ሥልጣንና ተግባር 5. Powers and Duties of the Authority

ባለሥልጣኑ የሚከተሉት ሥልጣንና ተግባራት The Authority shall have the powers and duties
to:
ይኖሩታል፡-
1/ Propose recommendations to relevant
፩/ የአካባቢ ጥበቃ ጉዳዮች ፖሊሲዎችን፣ ስልቶችንና
institutions on environment related policies,
ሕጎችን አስመልክቶ ምክረ ሐሳብ ለሚመለከተው
strategies, laws and upon approval, regulate
አካል ያቀርባል፣ ሲፀድቁም በሥራ ላይ their implementation;
መዋላቸውን ይቆጣጠራል፤

2/ In consultation with relevant institutions, set

፪/የአካባቢ ደረጃዎችን አዘጋጅቶ ለኢትዮጵያ
environmental standards and regulate
ደረጃዎች ምክር ቤት እንዲጸድቅ ያቀርባል፣
compliance with those standards;
በጸደቀው መሠረት መከበራቸውንም
ይቆጣጠራል፤
3/ Regulate the implementation of
፫/ የአካባቢ ጥበቃ ሕጎችን አተገባበር ይከታተላል፤
environmental laws ;
ይቆጣጠራል፤
4/ Where projects are subject to federal
፬/ የሥራ ፈቃድ የመስጠት፣ የመተግበር ወይም
licensing, execution or supervision or where
ክትትል የማድረግ ሥልጣን የፌደራል they are likely to entail inter- regional
መንግሥት የሆነባቸው ወይም ክልል ተሻጋሪ impacts, review environmental impact study

ይገመግማል፣ ለፈቃድ ሰጪው አካል ውሳኔውን and, as may be appropriate, audit and
ያሳውቃል፤ እንደተገቢነቱም የትግበራው regulate their implementation in accordance

person seeking to engage in consultancy
፭/ በአካባቢና ማህበራዊ ተፅዕኖ ግምገማ እና በአካባቢ
services in the areas of environment and
ኦዲት ዘርፍ በማማከር አገልግሎት ለመሰማራት
social impact assessment, environmental
ለሚፈልግ ሰው ወይም ተቋማት የብቃት
audit and regulate the same;
ማረጋገጫ ይሰጣል፣ ይቆጣጠራል፤

፮/ በደንብ ቁጥር ፭፻፯/፪ሺ፲፬ ለቴክኖሎጂ ባለስልጣን 6/ Notwithstanding powers and duties

የተሰጠው ሥልጣንና ተግባር እንደተጠበቀ ሆኖ designated to Energy Authority in

accordance with Regulations No 507/2024
የኢንዱስትሪ ኬሚካል ወደ ሀገር ውስጥ ማስገባት፣
issue certificate of competence to a person
ወደ ውጭ በመላክ እንዲሁም ማከፋፈል ሥራ
seeking to engage in the importation,
ለመሰማራት ለሚፈልግ ሰው የብቃት ማረጋገጫ
exportation, transportation and storage of
ምስክር ወረቀት ይሰጣል፣ ይቆጣጠራል፤
industrial chemicals and regulate the same;

7/ Issue license to any person seeking to

፯/ አደገኛ ቆሻሻ መሰብሰብ፣ ማጓጓዝ፣ ማከማቸት፣
engage in the collection, transportation,
በድጋሚ ጥቅም ላይ ማዋል፣ መልሶ ጥቅም ላይ
storage, reuse, recycling, disposal and trans-
ማዋል፣ አወጋገድ እና ድንበር ዘለል የአደገኛ
boundary movement of hazardous waste
ቆሻሻ እንቅስቃሴ ለመሰማራት ለሚፈልግ
and regulate the same;
ማንኛውም ሰው ፈቃድ ይሰጣል፣ ይቆጣጠራል፤
8/ Issue license to any person seeking to
፰/ ልውጥ ሕያው መስራት ወይም ለዝግ
engage in any making or use of any
አጠቃቀም፣ወደ አካባቢ ለመልቀቅ፣ ወደ ሀገር
modified organism for contained use,
ውስጥ ለማስገባት፣ ወደ ወጭ መላክ፣ ትራንዚት፣ release into the environment, import,
ማጓጓዝ እና ማከማቸት ለሚፈልግ ማንኛውም export, transit, transportation and storage
ሰው ፈቃድ ይሰጣል፣ ይቆጣጠራል፤ and regulate the same;
9/ In collaboration with relevant institutions,
፱/ ከሚመለከታቸው ተቋማት ጋር በመቀናጀት የመጤ
regulate, monitor and verify the expansion
ወራሪ ዝርያዎች መስፋፋት እና ቅነሳ ላይ
and reduction of invasive alien species;
ክትትል፣ ቁጥጥር እና የማረጋገጥ ሥራ ይሰራል፤

፲/ በአካባቢ ሕጎች መሠረት የአካባቢ ጥበቃ 10/ In accordance with environmental laws,

ግዴታዎች መከበራቸውን ለማረጋገጥ ወደ enter any land, premise or any other place,
inspect anything and take samples as
ማናቸውም መሬት፣ ቅጥር ግቢ ወይም ሌላ ቦታ
deemed necessary with a view to

requirements; a professional who performs
ሥራውን እንዲሰራ ስለመታዘዙ ደብዳቤ የማቅረብ
this mandate is obliged to submit a letter
እና ማንነቱን የሚገልጽ መታወቂያ የማሳየት
about being instructed to do so and to show
ግዴታ አለበት፣ an identity card.
፲፩/ የዘርፍ መሥሪያ ቤቶች እና ሌሎች ባለድርሻ 11/ Monitor and regulate the proper
አካላት የአካባቢ ጥበቃ ጉዳዮችን በአግባቡ implementation of environmental protection
መተግበራቸውን ይቆጣጠራል፤ issues by relevant institutions and other
stakeholders;

፲፪/ የአካባቢ ጥበቃ ጉዳዮችን በሚመለከት በዓለም 12/ Take part in the negotiations of
አቀፍ እና በሌሎች መድረኮች ላይ ኢትዮጵያን international environmental agreements;

ወክሎ ይሳተፋል፣ እንዲሁም ዓለም አቀፋዊ monitor and regulate the implementation of
international environmental agreements;
የአካባቢ ጥበቃ ግዴታዎች በአግባቡ
መተግበራቸውን ይከታተላል፣ ይቆጣጠራል፤

፲፫/ ከሚመለከታቸው ተቋማት ጋር በመቀናጀት 13/ In collaboration with relevant institutions,

establish a system for payment for
ሀገራዊ የአካባቢ አገልግሎት ክፍያ ወይም
environmental services or payment for
የሥርዓተ-ምህዳር አገልግሎት ክፍያ የአሰራር
ecosystem services, and monitor and
ሥርዓት ይዘረጋል፣ አተገባበሩን ይከታተላል፣
regulate its implementation;
ይቆጣጠራል፤
፲፬/ በልማት እቅዶችና በኢንቨስትመንት መርሐ 14/ In cooperation with relevant institutions,
prepare or cause the preparation of
ግብሮች ውስጥ የሚካተቱ የአካባቢ የአዋጭነት
environmental cost benefit analysis
ማስሊያ ቀመሮችንና የስሌት ሥርዓትን
formulate an accounting system to be used
ከሚመለከታቸው ተቋማት ጋር በመተባበር
in development plans and investment
ያዘጋጃል ወይም እንዲዘጋጁ ያደርጋል፣
programs and, as the case may be, monitor
እንደሁኔታው በጥቅም ላይ የመዋላቸውን ሂደት
and regulate their application;
ይከታተላል፣ ይቆጣጠራል፤
15/ In consultation with relevant institutions,
፲፭/ዘላቂነት የጎደለው የተፈጥሮ ሀብቶች አጠቃቀምንና
regulate disincentive measures are taken to
ልምድን፣ የአካባቢ ጉስቁልና ወይም ብክለትን
discourage practices that may hamper the

sustainable use of natural resources or the

prevention of environmental degradation or
pollution;

16/ Shall follow-up and monitor relevant

institutions whether they properly function

፲፰/ የሙቀት አማቂ ጋዞችን የልኬት ሥራዎችን 18/ Perform verification by carrying out
measurements of greenhouse gases; approve
በማካሄድ የማረጋገጥ ሥራ ያከናውናል ፣
and control the measurements made by
በሌሎች የተደረጉ የሙቀት አማቂ ጋዞች
others. And submit report to the concerned

፲፱/ ከሚመለከታቸው ተቋማት ጋር በመቀናጀት 19/ In coordination with relevant institutions,

monitor and regulate technologies that

contribute for climate change adaptation
ማስተሳሰሪያ አስተዋፅኦ የሚያደርጉ
and mitigation are environmentally friendly
ቴክኖሎጂዎች ከአካባቢ ጋር
and free from any environmental impacts;
መጣጣማቸውንና ከአካባቢ ተፅዕኖ ነፃ
መሆናቸውን ያረጋግጣል፣ ይቆጣጣራል፤ ‹

20/ Regulate the amount of carbon stored in the

24/ Prepare and avail to relevant institutions a
ያዘጋጃል፣ ለሚመለከታቸው አካላት ተደራሽ
periodic report on the state of the

ያግዛል፣ ለድርጊት ዕቅዶቹና ፕሮጀክቶቹ

አተገባበሩን ይከታተላል፤
፳፯/ የንብረት ባለቤት ይሆናል፣ ውል ይዋዋላል፣ 27/ Own property, enter into contracts and sue
and be sued; and
በራሱ ስም ይከሳል፣ይከሰሳል፤
28/ Carry out such other activities as are
፳፰/ ዓላማውን ለማስፈጸም የሚረዱ ሌሎች ሕጋዊ
necessary for the fulfillment of its

፮. የባለሥልጣኑ አቋም 6. Organization of the Institute

ባለሥልጣኑ፡- The Authority shall have:

፪/እንደአስፈላጊነቱ ምክትል ዋና ዳይሬክተሮች፤ 2/ Deputy Director Generals as may be

፫/ አስፈላጊው ሰራተኞች ይኖሩታል፡፡ 3/ The necessary staff.

፯. የዋናው ዳይሬክተር ሥልጣንና ተግባር 7. Powers and Duties of the Director General

፩/ዋና ዳይሬክተሩ የባለሥልጣኑ ዋና ሥራ 1/The Director General shall be the chief

executive officer of the Authority and shall,
አስፈጻሚ በመሆን የባለስልጣኑን ሥራዎች
subject to the general direction of the

Ministry, direct and administer the activities
፪/ የዚህ አንቀፅ ንዑስ አንቀፅ (፩) አጠቃላይ of the Authority.

አገላለጽ እንደተጠበቀ ሆኖ ዋና ዳይሬክተሩ፡- 2/ Without limiting the generality of sub-

article (1) of this Article, the Director
General shall:
ሀ) በዚህ ደንብ አንቀጽ (፭) የተመለከቱትን
a) Exercise the powers and duties of the

ሠ) ከሦስተኛ ወገን ጋር በሚደረግ ግንኙነት e) Represent the Authority in its dealings

8. Powers and Duties of Deputy Director
General
፩/ ምክትል ዋና ዳይሬክተሩ ከዋና ዳይሬክተሩ
1/ The Deputy Director General shall:
በሚሰጥ መመሪያ መሠረት፡-
a) Assist the Director General in planning,
ሀ) የባለሥልጣኑን ተግባሮች በማቀድ፣
organizing, directing and coordinating
በማደራጀት፣በመምራትና በማስተባበር ዋና the activities of the Authority; and
ዳይሬክተሩን ይረዳል፤
b) Lead the division that he is assigned;
ለ) የሚመደብበትን የሥራ ዘርፍ ይመራል፤
c) Perform other activities specifically

ሐ) በዋና ዳይሬክተሩ የሚሰጡትን ሌሎች assigned to them by the Director

General.
ሥራዎች ያከናውናል፡፡
2/ In the absence of the Director General, the
፪/ ዋና ዳይሬክተሩ በማይኖርበት ጊዜ ምክትል
Deputy Director General shall, act on his

9. Budget
የባለሥልጣኑ በጀት በመንግሥት ይመደባል፡፡ The budget of the Authority shall be
allocated by the Government.

10. Book of Accounts

፲. የሒሳብ መዛግብት
1/ The Authority shall keep complete and
፩/ ባለሥልጣኑ የተሟሉና ትክክለኛ የሆኑ ሒሳብ
accurate books of accounts.
መዛግብት ይይዛል፡፡
2/ The books accounts and financial
፪/ የባለሥልጣኑ የሒሳብ መዛግብትና ገንዘብ ነክ
documents of the Authority shall be
ሰነዶች በዋናው ኦዲተር ወይም እርሱ
audited annually by the Auditor General
በሚሰይመው ኦዲተር በየዓመቱ or by an auditor assigned by him.
ይመረመራሉ፡፡

፲፩. ተፈጻሚነት የማይኖራቸው ሕጎች 11. Inapplicable Provisions

ከዚህ ደንብ ጋር የሚቃረን ማንኛውም ደንብ፣ Any Regulation or Custom contrary to this
Regulation shall not apply to the matters
መመሪያ እና ልማዳዊ አሠራር በዚህ ደንብ
covered under this Regulation.
ውስጥ በተመለከቱ ጉዳዮች ላይ ተፈጻሚነት
አይኖራቸውም፡፡
፲፪. ደንቡ የሚጸናበት ጊዜ 12. Effective Date
ይህ ደንብ በፌደራል ነጋሪት ጋዜጣ ታትሞ This Regulation shall enter into force on the
