JUDICIAL AFFIDAVIT

I, Gino Delima, of legal age, single, and a resident of Purok Sampaguita, Barangay
Matiao, City of Mati, Davao Oriental hereby depose and state that;

PREPARATORY STATEMENT

The person examining me is Atty. IGNACIO M. LOZADA with office address at Barangay
Dahican, City of Mati. The examination is being held at the address stated therein. I am
answering his questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.

QUESTIONS were propounded by Atty. Jocsin Awangan in English which the affiant fully
speaks and understands.

Q1: What is your current profession?

A: I am a Forensic Fingerprint Examiner 11 of the Davao City Crime Laboratory Sir.

Q2: Where did you go for academic attainment and further criminalistics training?

A: I finish my Criminology Course at the Davao Oriental State University and Master of
Science in Criminalistics specialized in Forensic Fingerprint Examination at the
Philippine College of Criminology; also I have undergone training locally and abroad
which was facilitated by accredited agencies.

Q3: How long have you been practicing your profession?

A: 8 years Sir.

Q4: What are the principal functions and duties of your profession?

A: To conduct examination on submitted Fingerprints and prepare laboratory reports.

Q5: Have you conducted examination on several fingerprint evidence before?

A: Yes Sir.

Q6: Have you been qualified to testify as an expert witness?

A: Yes Sir.

Q7: Where you assigned on April 25, 2024?

A: I was assigned at the Dactyloscopy Division of Davao City Crime Laboratory Sir.

Q8: What position did you hold then?

A: Fingerprints Examiner Sir.

Q9: I have here a technical report dated April 25, 2024, from the Davao City Crime
Laboratory Office, was this one of those technical reports you have prepared?

A: Yes Sir.

Q10: If I show you such a document will you be able to identify it?

A: Yes Sir.

Q11: I am showing you the document entitled Fingerprint Case No. 021-24, is this familiar
to you?

A: Yes Sir

Q12: At the bottom right of the document, there appears a signature above the typewritten
name, Gino Delima, whose signature is it?

A: My Signature Sir.

Q13: Below your typewritten name and signature, appears the signature above the
typewritten name, PLT ROMUEL N. BANSALAN, whose name and signature is it?

A: The signature of PLT ROMUEL N. BANSALAN, Sir.

Q14: How did you know that it was the signature of PLT ROMUEL BANSALAN?

A: It was signed in my presence Sir and I personally witnessed him signed the document.

Q15: What is your relation to him?

A: He is the Head in Dactyloscopy Division Sir.

Q16: What is the purpose of the document you presented?

A: It serves as a technical report containing my findings and conclusion on the

examination and comparison that I have conducted on the specimen submitted in our
office Sir.

Q17: Please explain to the honorable court your findings as they appear in that report?

A: The questioned latent print developed and lifted at the crime matches the left thumb
fingerprint of the suspect. The questioned and standard are loop patterns and have
identical fingerprint characteristics.
Q18: What are your bases for these findings, briefly explain the procedures arriving at
such findings?

A: The findings were based on the scientific laboratory comparative examination and
analysis at the Davao City Crime Laboratory. The questioned latent print developed and
lifted at the crime matches the left thumb fingerprint of the suspect. The questioned and
standard are loop patterns and have identical fingerprint characteristics.

Q19: Based on the examination result, what is now your conclusion in relation to the
findings of such case?

A: Per Comparison of the QUESTIONED LATENT FINGERPRINT and STANDARD

FINGERPRINT of the suspect taken from the fingerprint files of PNP are the same, it is
clear and convincing to conclude that the suspect, Mr. BARTOLOME, BERTO is the
owner of the questioned latent fingerprint.

Q20: How sure are you in your conclusion?

A: Very sure Sir.
