No. 593 REAR ADMIRAL MOHAMMAD MUSA, son of Md. Aman Ullah &
Mrs. Amena Begum, a client of Trust Bank Limited, Mirpur Branch,
Dhaka.

Dear Sir,

WHEREAS, P No. 593 REAR ADMIRAL MOHAMMAD MUSA, son of Md. Aman
Ullah & Mrs. Amena Begum, Date of Birth- 01.09.1967, bearing National ID No.
8203620714, & TIN No. 840437849392, having his permanent address at House-
36/1, Road-01, Baitul Aman, New Hajiganj, Post Office-Fatulla, Narayanganj Sadar,
Narayanganj, and present address at Taranga Building, Flat No. 7B, Naval
Headquarters, Banani, Dhaka, By Religion- Islam, By Profession- Retired Army
Officer, By Nationality- Bangladeshi by Birth, i.e. the BORROWER has
approached to the TRUST BANK LTD., Mirpur Branch, hereinafter referred to as
the ‘BANK’ to avail credit facilities for an aggregate amount of Tk. 1,20,00,000/-
(Taka One Crore Twenty Lac) only and the Bank has approved the same as per
Sanction Letter No. TBL/MIR/ADV-RBU-HBL/2023/909 dated 09.04.2023.

AND WHEREAS, the BORROWER i.e., P No. 593 REAR ADMIRAL MOHAMMAD
MUSA, son of Md. Aman Ullah & Mrs. Amena Begum, do hereby agrees and
undertakes as follows: -

(a) That the BORROWER shall provide Insurance policy from the reputed
Insurance Company acceptable to the bank as per PPG and the policy
papers to be assigned in favor of the Bank. In this case, the BORROWER
hereby also confirms that he shall bear all loses due to non-coverage of
Insurance clause, and if any loss occurs due to non-coverage of the said
clause, the Bank shall be indemnified against such losses;

(b) That the BORROWER hereby explicitly confirms that all the information
supplied to the Bank in connection with the proposed credit facility is correct;

(c) That the BORROWER hereby agrees that the Bank shall have the right to call
back the facility extended at any time without assigning any reason whatsoever
and in such case he shall settle all the outstanding with the Bank immediately;

(d) That the BORROWER hereby agrees that any cost overrun to complete the
project to be solely born by them from his own sources and he will not approach
to any bank/financial institutions for any further finance;

(e) That the BORROWER hereby agrees that he will keep the property in good
conditions during the tenure of the facility;

(f) That the BORROWER shall pay monthly installment from the rental income or
his own sources, as the case may be;

(g) That the BORROWER shall regular pay of utility bills and all other Municipal
tax and rents etc.;

(h) That the BORROWER fail(s) to deposit any installment, 2% penal interest
shall be charged on the defaulted amount; or as per schedule of charges.

(i) That the BORROWER hereby agrees that if they fail to deposit any installment,
penal interest shall be charged on the defaulted amount, or as per schedule of
charges/PPG;

(j) That the BORROWER hereby agrees that the Bank is authorized to debit clients
A/C, if bank have to take Insurance Policy in future for situation demand.

(k) That the BORROWER hereby agrees that if any liability is found in the CIB
report other than that was declared or anything adverse is found in the CIB
report which may adversely affect the DBR, the approval of the credit limit will
be treated as cancelled;

(l) That the BORROWER shall regularly pay WASA, DESCO, TITAS bills and all
other City Corporation Taxes and rents etc.;

(m) That the BORROWER hereby undertakes that he/they does not has/have any
relationship as Director or Sponsor with the bank;

(n) That the BORROWER hereby undertakes that the said building mentioned in
the sanction letter constructed/to be constructed with compliance of RAJUK
Plan, The Building Construction Act, 1952, Bangladesh National Building
Code, 2006, Imarat Nirman Bidhimala -2008, Agni Protirodh O Nirbapon Ain-
2003, Private Housing Project Land Development Rules, 2004, Local
Government Paurashava Act-2009, Real Estate Act 2010 and other related
Laws and Rules;

(o) That the BORROWER shall comply with all the terms and conditions of the
Sanction Letter of the Bank, any violation of which shall default the loan
amount;

(p) That the BORROWER shall comply with all the rules and regulations of
Bangladesh Bank.

(q) That the BORROWER shall not avail any credit/credit facility from any other
bank or financial institution or NGO without prior consent of the bank;

(r) That the BORROWER hereby authorize the Bank to debit from his/their
account to renew the insurance policy from time to time;

(s) That the BORROWER shall not approach to any bank/financial institution for
any further finance without prior consent of the bank;

(t) That the BORROWER hereby confirms that he has no liability with any bank or
financial institution excepting as declared;

(u) That the BORROWER shall comply with and follow all the terms & conditions
imposed / to be imposed from time to time by the Bank, otherwise the Bank
shall have the right to call back facility;

(v) That the BORROWER hereby agrees that the Bank reserves the right to include
any other terms and/or stop/withdrawal or cancel the limit at its discretion at
any time during the currency of the limit without assigning any reason to you;

(w) That the BORROWER hereby agrees that the Trust Bank Ltd. is authorized to
debit the account as may be warranted from time to time;

(x) That the BORROWER hereby undertakes that he bears all legal charge;

(y) That the BORROWER hereby further undertakes that he shall not sell or
transfer the ownership of the property until bank’s dues are fully paid or
without NOC of the bank;

THIS UNDERTAKING SHALL BE IRREVOCABLE AND UNCONDITIONAL ON THE


BORROWER SUCCESSORS-IN-INTEREST AND THE BORROWER AND BE IN
FORCE TILL FULL AND FINAL ADJUSTMENT OF THE ABOVE FACILITIES
SUBJECT TO THE WRITTEN SATISFACTION OF THE BANK.

IN WITNESSES WHEREOF, THE BORROWER DO HEREBY EXECUTE THIS
IRREVOCABLE AND UNCONDITIONAL UNDERTAKING ON THIS THE _____ DAY OF
