EXEMPTION FROM “MAKE IN INDIA (MII) CLAUSE” FOR PROCUREMENT OF VARIOUS

GENERIC IT HARDWARES AND SOFTWARES

1. Pl ref to Govt of India, Department of Military Affairs OM No B/04001/Policy/MII/DDGIT

(T&P)/ D(O-1)/DMA dt 28 Mar 2024 (copy encl).

2. The Govt has issued Public Procurement (Preference to Make in India) Order 2017 vide
the Department for Promotion of Industry and Internal Trade (DPIIT) Order No P-45021/2/2017-
BE-II dated 15.06.2017, as amended by Orders dated 28.05.2018, 29.05.2019, 04.06.2020 and
16.09.2020 to encourage ‘Make in India’ and promote manufacturing and production of goods
and services in India with a view to enhancing income and employment.

3. During the ACC held in Nov 2022, case for MII waiver of generic IT eqpts was proj as an
agenda pt by HQ Southern Comd. Subsequently, on 11 Nov 2022, case was taken up with MoD
for exemption from “Make in India (MII) Clause” for procurement of various generic IT Hw and
Sw in order to avoid delay in proc of IT peripherals reqd by lower fmns and not avlb with
requisite local content.

4. To this effect inputs for the same were also obtained from all Comds and Line Dtes and a
consolidated case for MII waiver for twenty (20) items was taken up with MoD through DMA.

5. DMA vide OM u/r at Para 1 above has conveyed sanction of Hon’ble Minister of Defence
for the exemption from “Make in India (MII) Clause” for procurement of generic IT Hw and Sw
listed at Annexure-I of OM ibid.
