INTRODUCTION

The Philippine Drug Enforcement Agency (PDEA) was created by virtue of

Republic Act 9165, otherwise known as “ The Comprehensive Dangerous

Drugs Act of 2002.” The enactment of RA 9165 reorganized the Philippine drug

enforcement system with the new Dangerous Drugs Board (DDB) that serves as the

policy and strategy formulating body and the establishment of a single mission drug

agency – the Philippine Drug Enforcement Agency (PDEA) as its implementing arm.

HISTORY

The Philippine Drug Enforcement Agency (PDEA) was created by virtue of Republic Act 9165,
otherwise known as “ The Comprehensive Dangerous Drugs Act of 2002.” It was signed into law
on June 7, 2002 and took effect on July 4,2002. The enactment of RA 9165 reorganized the
Philippine drug enforcement system with the new Dangerous Drugs Board (DDB) that serves as
the policy and strategy formulating body and the establishment of a single mission drug agency –
the Philippine Drug Enforcement Agency (PDEA) as its implementing arm. The PDEA is a regular
law enforcement agency responsible for the efficient and effective law enforcement against any

dangerous drug and/or controlled precursor and essential chemicals. The PDEA was officially
activated on July 30, 2002 when its first Director General was appointed with a rank equivalent to
an Undersecretary.

POWER AND FUNCTION

The Philippine Drug Enforcement Agency (PDEA) is responsible for the efficient law

enforcement of all provisions on any dangerous drugs and/or precursors and essential chemicals.
Philippine Drug Enforcement Agency is the implementing arm of the Dangerous Drugs Board
(DDB). The DDB is the policy-making and strategy formulating body in the planning and
formulation of policies and programs on drug prevention and control. PDEA and DDB are both
under the supervision of the Office of the President of the Philippines. The Philippine Drug
Enforcement Agency as the lead agency for investigating and combating any dangerous drugs
operation in the country, it will going to discuss their organizational set-up, mandates, power and
function.

FUNCTIONS OF PDEA

1. Implement or cause the efficient and effective implementation of the national drug control
strategy formulated by the Dangerous Drugs Board;

2. Undertake the enforcement of the provisions of Article II of RA 9165 relative to the unlawful
acts and penalties involving any dangerous drug and/or controlled precursor and essential
chemicals;

3. Administer oath and issue subpoena and subpoena duces tecum relative to the conduct of
investigation involving the violations of RA 9165;

4. Arrest and apprehend as well as search all violators and seize or confiscate the effects or
proceeds of the crimes as provided by law;

5. Take charge and have custody of all dangerous drugs and/or controlled precursors and
essential chemicals seized, confiscated or surrendered to any national, provincial or local law
enforcement agency;

6. Establish a forensic laboratory in each PNP office in every province and city in order to
facilitate action on seized or confiscated drugs, thereby hastening their destruction without
delay;

7. Recommend to the DOJ the forfeiture of properties and other assets of persons and/or
corporations found to be violating the provisions of RA 9165 and in accordance with the
pertinent provisions of the Anti-Money Laundering Act of 2001;

8. Prepare for prosecution or cause the filing of appropriate criminal and civil cases for violation
of all laws on dangerous drugs, controlled precursors and essential chemicals, and other
similar controlled substances;

9. Monitor and if warranted by circumstances, in coordination with the Philippine Postal Office
and the Bureau of Customs, inspect all air cargo packages, parcels and mails in the central
post office;

10. Conduct eradication programs to destroy wild or illegally grown plants from which dangerous
drugs may be extracted;

11. Initiate and undertake the formation of a nationwide organization which shall coordinate and
supervise all activities against drug abuse in every province, city, municipality and barangay;

12. Establish and maintain a national drug intelligence system in cooperation with law
enforcement agencies, other government agencies/offices and local government units that will
assist in the apprehension of big-time drug lords;

13. Establish and maintain close coordination, cooperation and linkages with international drug
control and administration agencies and organizations;

14. Create and maintain an efficient special enforcement unit to conduct an investigation, file
charges and transmit evidence to the proper court;

15. Require all government and private hospitals, clinics, doctors, dentists and other practitioners
to submit a report to it;

16. Coordinate with the DDB for the facilitation of the issuance of necessary guidelines, rules and
regulations for the proper implementation of RA 9165;

17. Initiate and undertake a national campaign for drug prevention and control programs, where it
may enlist the assistance of any department, bureau, office, agency or instrumentality of the
government, including government-owned and/or controlled corporations; and

18. Submit annual and periodic reports to the DDB as may be required from time to time, and
perform such other functions as may be authorized or required under existing laws and as
directed by the President.

MISSION

To conduct intensified Anti- Illegal Drug Operation, ensure the successful prosecution of drug
cases and enhance public awareness on the harmful effects of dangerous drugs in partnership
with the community.

VISION

To be a professional, effective and well-respected agency working for a drug-free Philippines.

Department of Budget and Management (DBM) or the Office of the President for evaluation and

 The Office of the Director General: The Office of the Director General shall be responsible
for the general administration of PDEA. It shall direct and control the utilization of PDEA’ s
resources for the accomplishment of it’s mission in accordance with R.A 9165.

 The Office of the Deputy Director General for Administration : The Office of the Deputy

Director General for Administration (ODDGA) shall assist the Director General in the general
supervision of the various administrative functions of PDEA.

RECRUITMENT, TRAINING and PROMOTION

 Sec 8. Trainings of PDEA Academy- The PDEA Academy shall include training

programs classified as Career Courses, Specialized Courses, Skills Enhancement

Trainings and Seminars and Foreign Sponsored Trainings. The PDEA Drug

Enforcement Officers Basic Course comprises basic management and leadership, communication
enhancement skills, community-based anti-illegal drug advocacy,

legal studies, anti-illegal drug intelligence and tactics, interdiction operations and

investigation, and other non-academic activities.

REQUIREMENTS IN APPLYING IN PDEA

1. Must be a college graduate. Must be 21 to 35 years old.

2. Must be at least 5'2 for men and 5′0 for women.

3. Must have passed any of the following:

a. Bar Exam. b. Board Exam. c. Civil Service Professional Exam.

4. Must be physically fit. Must be of good moral character.

5. Must be computer literate.

PROMOTION

 Sec 5. Merit and Promotion Plan - shall be promulgated by PDEA based on applicable laws,
rules, regulations and standards set by the commission to ensure that every employee is given

a fair and equal opportunity in career advancement particularly in promotions. Promotions shall
be primarily based on merits and fitness. No spot promotion shall be allowed. Outstanding
performance of a personnel shall only be considered as traditional point and should not be sole
basis of promotion.

PDEA BENEFITS

1. Basic Salary: PDEA personnel receive a basic salary determined by their rank and years of
service. Salaries are typically aligned with government pay scales.

2. Allowances: PDEA employees may receive different allowances such as:

Hazard pay: Additional compensation for working in high-risk environments or situations.

Subsistence allowance: Reimbursement for necessary expenses incurred while on duty,


particularly when away from their usual place of work.

Transportation allowance: Assistance with commuting expenses.

3. Healthcare Benefits: PDEA personnel and their dependents are often entitled to healthcare
benefits.

These may include: Access to government healthcare facilities for medical


consultations, treatments, and hospitalization. Health insurance coverage for certain medical
expenses.

PDEA RETIREMENT

1. Sec. 30. Optional Early Retirement - A Personnel may be optional to retire upon

reaching the age of 56 provided that he has rendered at least 15 years of government service
and be paid retirement benefits in accordance with the existing law.

2. Sec. 31. Compulsory Retirement - Upon attainment of the age of 65, personnel shall retire
from service and be paid retirement benefits in accordance with the existing law.

3. Sec 32. Consultation with the GSIS - in the promulgation of the IRR of this Act, consultation
with the GSIS shall be made in order to establish a retirement scheme deemed applicable and
appropriate for the retirement of PDEA personnel.

CURRENT NEWS AND EVENTS

In Davao City - Anti-narcotics agents seized P6.8 million worth of suspected shabu

from two illegal drug smugglers in Barangay Saduc in Marawi City last week. According to Gil
Cesario Castro, director of the Philippine Drug Enforcement Agency-Bangsamoro Autonomous
Region in Muslim Mindanao, the suspects Abdul Diongaan, 47, and 49-year-old Panarigan Radia,
were quickly arrested in an entrapment operation, and they did not resist when the operation is
performed. A PDEA personnel pretended to buy drugs worth P6.8 million and when he handed

over what he bought, the suspects were immediately arrested. PDEA has already

prepared charges for violation of the Comprehensive. Dangerous Drugs Act of 2002. Drug officials
in Davao Region has identified Marawi City and Other areas of Lanao

del Sur as the sources on illegal drugs entering the region, as the record of the

border checkpoint also showed. Barangay Saduc is a residential area in Marawi City

that belongs to the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM). According to
Castro, the successful operation happened because of the help of Lanao del Sur Gov. Mamintal
Adiong Jr., and Brig. Gen. Prexy Tanggawon, director

of the Police Regional Office- Bangsamoro Autonomous Region.

LAWS RELATED

 Republic Act No. 9165 (July 4, 2002)- reorganized the Philippine drug enforcement

system with the new Dangerous Drugs Board (DDB) that serves as the policy and

strategy formulating body and the establishment of a single mission drug agency –

the Philippine Drug Enforcement Agency (PDEA) as its implementing arm.

 Executive Order No. 206 (May 15, 2003)- is hereby repealed. All orders, rules, regulations
and issuance's, or parts thereof, which are inconsistent with this Executive Order are hereby
repealed or modified accordingly.

PDEA CONCLUSION

1. The PDEA Conclusion was The PDEA programs on supply and demand reduction are well
implemented.

2. The Community are aware about the agency’ s advocacies and other drug- related concepts.

3. The agency had accomplished well through the substantial arrest made, amounts of drugs
seized , buy bust operation conducted, and case filed in courts.

4. These programs are related to the community’s level of awareness but not the agency
accomplishments.

5. The agency is also confronted with basic problems like lacks of facilities and personnel.

PDEA RECOMMENDATION

1. It is recommended that relevant and reasonable budget should be appropriated by Congress


to PDEA to augment it Manpower, and procedure the needed and appropriate vehicles.

2. It is equally important to consider a Special Court to exclusively attend to all drug - related
cases for speedy yet judicious resolution of the same.

3. Another study is likewise suggested to perhaps explore the apparent effect of government
allocation to drug- related crime.
