SMS-P-20240519-827-18 and W20240522-280-11

I. AUTHORITY:

1. Inherent function of PNP under RA 8551; and

2. SMS Complaint with Reference Number SMS-P-20240519-827-18 and


W20240522-280-11.

II. MATTERS TO BE INVESTIGATED:

3. To determine the facts and circumstances surrounding the above-cited SMS


Complaint from anonymous individual;

4. To identify of the police officers involved and were mentioned in the said SMS
compliant;

5. To determine whether the said policemen involved had extorted money from
the persons they had arrested as claimed by the SMS sender; and

6. To look for possible criminal and administrative liabilities of the police officers
involved and the command responsibility of their superior based on evidence;

III. FACTS OF THE CASE:

7. On May 20, 2024, this Station received a memorandum from OIC, DIDMD,
NPD regarding SMS Complaint with Reference Number SMS-P-20240519-827-18
which reads:

Details: “Agency: Station Drugs Enforcement Caloocan City Police Station,


Location/Address: Samson Road, Caloocan City. Nais ko lamang ireklamo ang
pamunuan ng Drug Enforcement ng Caloocan City Police Station. Dahil may mga hinuli
sila dito sa aming lugar sa J. Ramos, Barangay 7, Caloocan City na tulak ng droga na si
alyas Rey Puto Bondoc pamangkin nitong alyas Uda Bondoc, si alyas Nante Songsong
at dalawang babae na hindi namin kilala habang nagpapot session. Umuugong kasi dito
sa aming lugar ba hinihingan sila ng Php 35,000.00 bawat isa para sa kanilang
Kalayaan. Dapat ay matigil na ang ganyang kalakaran upang hindi na makalabas ng
kulungan ang mga ganyang klase ng salot sa Lipunan.”
8. That upon receipt of the said memorandum, PCOL RUBEN B. LACUESTA,
Chief of Police directed the Investigation and Detective Management Section (IDMS) to
conduct validation and investigation on the said complaint. At about 11:21 AM of May
21, 2024, personnel of IDMS thru the supervision of PMAJ JANSEN OHRELLE F
TIGLAO, Chief, IDMS proceeded at Barangay 7 Hall located at Velasco Street,
Caloocan City and able to converse with Barangay Chairman Delfin C Zamora, Jr about
the said complaint. Chairman Zamora, Jr averred that at about 6:00 PM of May 19,
2024, unidentified male persons believed to be police officers conducted police
operation at J. Ramos Street, Barangay 7, Caloocan City wherein the said policemen
arrested Reynaldo Bondoc @Rey Puto who is at the drugs watch list of Barangay 7,
@Uda, @Songsong and two (2) unidentified female persons. He further claimed that at
the very same date, few hours upon the apprehension of said drug personalities of his
Barangay, @Uda and one (1) unidentified female were already released for unknown
reason. @Rey Puto, @Songsong and one (1) unidentified female were also released
the following day of May 20, 2024. Barangay Chairman Zamora, Jr further claimed that
he received a gossip that the aforesaid personalities were released upon pay off
amounting to Php 35,000.00 each. Barangay Chairman Delfin C Zamora, Jr showed to
the investigating personnel of IDMS the recorded footage from the installed CCTV in the
Barangay along J. Ramos and Velasco Street, Barangay 7, Caloocan City. He also
added that he will provide the copy of the said recorded footages for the reference of
this Station and also issue a certified copy of the Barangay Drugs Watch List which
include Reynaldo Bondoc alias Puto.

9. Based on the assessment of this Station on the recorded footage viewed, the
policemen captured in the CCTV were personnel of the Station and Drug Enforcement
Unit of this Station identified namely PSSg Jason Taguba, PSSg Pepito Vallarta, PSSg
Roger Lagarto, PSSg Jeffrey Saguitan together with their Regular Confidential
Informant (RCI) namely @Andoy.

10. After validated the SMS complaint, this Station made a formal memorandum
to the following personnel above together with their superior PCPT EMMANUEL
ALDANA to explain why no administrative sanction shall be imposed against them
based on the SMS complaint.

11. That on May 22, 2024 another memorandum from OIC DIDMD, NPD was
received with the subject Citizen’s Complaint with Reference Number W20240522-280-
11 which reads:

Details: “Irereklamo ko ang pamunuan ng Caloocan City Police Station partikular na ang
Drug Enforcement Unit. Sa kanilang ginawang moro-morong panghuhuli sa isang pot
session dito sa aming lugar sa J. Ramos Street, Barangay 7, noong May 19 ng gabi.
Nahuli nila ang isang talamak na tulak na si Reynaldo Bondoc alias Rey Puto kasama
ang pamangkin nitong si Uda ngunit nakalabas din sa halagang Php17,000 pesos at
isang Nante Songsong na nakalabas naman sa halagang 20,000 pesos. Bilang isang
naninirahan dito sa aming lugar paano matatahimik at magiging drug free ang aming
lugar kung ganyan lamang po ang magiging kalakaran? Sana pakibigyang aksyon ang
mga ginagawang ganyan ng iilang tiwaling pulis at kung maaari po ay hulihin na po nila
ng totoo ang mga drug pusher na yan na ginagawang one stop shop ang aming lugar.
Kung nais po ninyo ng patunay sa aking sinasabi ay malugod po namin kayong
iniimbitahan sa tanggapan po ng aming barangay upang ipakita ang kuha ng aming
CCTV sa mga naging kaganapan. Aksyon po ang aming kailangan dito.”

12. Upon receipt of the said SMS complaint Chief IDMS PMAJ JANSEN
OHRELLE TIGLAO and PLT JOSELITO BARREDO, Asst, Chief IDMS immediately went
to Barangay 7 located at Velasco Street, Caloocan City and discussed with Barangay
Chairman Delfin Zamora, Jr about the another SMS complaint. The conversation
yielded with good result promising that the said incident will not be happened again and
the Station will conduct a just and fair investigation on the matter.
IV. DISCUSSION:

13. On May 23, 2024, PCPT EMMANUEL W ALDANA, Chief SDEU submitted
his counter Affidavit stating that on May 19, 2024 at about 7:00 PM, he was approached
by PSSg Jason Taguba and informed him about the validation they had conducted
based on the information given unto them with their Regular Confidential Informant
(RCI). Said information was about the rampant selling and using of illegal drugs at J.
Ramos Street, Barangay 7, Caloocan City involving drug personalities. Accordingly, they
have invited personalities they caught at J. Ramos Street for clarification and upon
validation they subsequently released them since they have not involved in illegal drugs
activities. He instructed PSSg Jason Taguba to release the personalities officially to their
respective relatives.

14. On same date, PSSg Jason Taguba, PSSg Pepito Vallarta, PSSg Jeffrey
Suguitan and PSSg Roger Lagarto submitted also their Joint Affidavit stating among
others that on May 19, 2024 at 5:00 PM, their Regular Confidential Informant (RCI)
arrived in their office at SDEU, Caloocan and informed them about the rampant illegal
drug activities at J. Ramos Street, Barangay 7, Caloocan City. Subsequently, they
immediately dispatched to conduct validation on the veracity of the given information of
their RCI. And upon arrival thereat some of the people they had found in the area
immediately scampered and only five (5) personalities left and they subsequently invited
to the SDEU office at Caloocan City Police Station for clarification. Reportedly, during
interview with the said persons invited, they found out that the said personalities have
no involvement in illegal drugs activities and the said personalities cannot give any
information relative to the illegal drugs at the area. The said personalities were
subsequently released before their relatives. That at about 7:00 PM of same date, they
informed their Commander PCPT EMMANUEL W ALDANA about the validation they
had made and ordered them to release the said personalities before their relatives. The
following policemen categorically denied the information from the SMS complaint which
they believed to be malicious allegation and maligning the office which aims just to
tarnish their reputation. They have also seek the help of the person they have invited
and gave their statements that reduce into writing to refute the same.

15. On the Statement of Ma. Theresa Daez which was taken on May 21, 2024 at
about 9:00 PM, she stated that she was playing an online game when unidentified male
persons introduced as policemen came then subsequently frisked them and invited at
their office at SDEU Caloocan Police for some questioning and after giving some details
they were allowed to go home.

16. On the Statement of Mark Lester Filomeno Bondoc that was taken on May
21, 2024 at about 9:20 PM, he stated that he was inside his house together with his
friends identified as Ma. Theresa Daez, Nante Songsong and Reynaldo Bondoc and
were playing online games when unidentified male persons identified as policemen
came inside their house and frisked them. Subsequently they were invited at SDEU
Caloocan City office for questioning. He further claimed that after giving their details
they were all allowed to go home with no monetary consideration.

17. On the statement of Reynaldo Temporas Bondoc which was taken on 22 nd of


May 2024 at about 12:50 PM, he stated that he was inside his house at no. 67 J.
Ramos Street, Barangay 7, Caloocan City on May 19, 2024 at about 6:00 PM together
with his live-in partner Mau Dela Cruz and watching TV when unidentified male person
who introduced themselves as operatives of SDEU Caloocan Police went inside their
abode and held them for alleged using of illegal drugs. They peacefully come along with
the policemen at the SDEU office since they believed that they were innocent. They
were reportedly released after the interview had completed with no monetary
consideration. That on May 20, 2024, he was reportedly invited at Barangay 7,
Caloocan City for questioning of the policemen about the incident, however he claimed
that he did not give any details of the incident since they were innocent.

18. A copy of the recorded CCTV footages were obtained by the IDMS of this
Station and based on the materials at about 6:24 PM of May 19, 2024, PSSg Jason
Taguba, PSSg Pepito Vallarta, PSSg Roger Lagarto, PSSg Jeffrey Suguitan together
with their RCI alias Andoy appeared on board three (3) motorcycles. They immediately
got off their motorcycle, led by their RCI alias Andoy followed by PSSg Taguba, PSSg
Lagarto, PSSg Suguitan and PSSg Vallarta passed through a group of people in front a
store and went inside a house thereat. And after couple of minutes, showed on the
CCTV footage PSSg Vallarta together with PSSg Taguba came out from the house with
the two (2) male persons identified as Reynaldo Bondoc alias Rey Puto and Nante
Songsong who were handcuffed and one (1) unidentified female person. Another two
more minutes, PSSg Lagarto together with PSSg Saguitan were seen coming out from
the house with Mark Lester Bondoc alias Uda. They all boarded in their motorcycle with
the above-named personalities and left the area.

V. CONCLUSION:

19. Based on the foregoing, the following are the findings based on the
statements obtained by the prober.

19a. There are discrepancies on the statement given by PSSg Jason


Taguba, PSSg Pepito Vallarta, PSSg Roger Lagarto and PSSg Jeffrey Suguitan versus
the statement of the personalities they have been reportedly invited in their office and
the gathered documents and recorded CCTV footage of Barangay 7, Caloocan City.
The policemen stated that upon arrival at J. Ramos Street, they found a group of people
who immediately scampered and the (5) five individuals were left behind wherein their
three (3) witnesses are among the five (5) they invited at their office at SDEU Caloocan
Police. While in the statement of Ma. Theresa Daez, Mark Lester Bondoc alias UDA and
Reynaldo Bondoc alias Rey Puto, they were all inside their house when they were
reportedly invited the policemen. In the recorded CCTV footage that was obtained
showed that Reynaldo Bondoc alias Rey Puto and Nante Songsong were handcuffed
contrary to the allegation of the policemen that they only invited them for questioning in
their office (Attached is the printed photo from the portion of the recorded CCTV footage
of Barangay 7, Caloocan City).

19b. The policemen involved claimed that they conducted validation on


the above-named individuals who they brought in their office and upon validation they
released them upon finding that all of them has no involvement in the illegal drugs
activities at the area. Contrary to the documents obtained by the IDMS with regards to
the Drug Watch List of Barangay 7, Caloocan City. Reynaldo Bondoc alias Rey Puto
was among the drug personalities of Barangay 7, Caloocan City categorized as
PUSHER (Attached is the certified true copy of the Barangay 7 Drug Watch List).

19c. As to the claimed of the policemen of having invited the above-cited


personalities for questioning and clarification, it contrary with the recorded CCTV
footage obtained which clearly shows that the said personalities were handcuffed,
therefore restrained or arrested.

19d. Even the subject personalities gave statement in favor to the erring
policemen it does not qualifies that there are no irregularities in the action of the
policemen. Considering that they were all operatives of Drug Enforcement Unit, they
should always make pre-operational plan which is absent, whether it was a validation
process or police operation. There is no such invitation in every police operation. The
taking of a person in the police custody considered an arrest. The action made by the
said erring policemen in entering a dwelling without any valid search or arrest warrant
constitute misconduct.

VI. RECOMMENDATION:

20. WHEREFORE, premises considered based on the investigation conducted


that PSSg Jason Taguba, PSSg Pepito Vallarta, PSSg Roger Lagarto and PSSg Jeffrey
Saguitan are administratively liable for Conduct Unbecoming of a Police Officer and
Serious Irregularities in the Performance of Duty.

21. Likewise, PCPT EMMANUEL E ALDANA, the Chief SDEU is also


administratively liable under the Doctrine of Command Responsibility.

22. Further, recommends the approval of paragraph 20 and 21 above and the
administrative relief of the aforesaid police officers.
