1]. That the above named petitioners have filed the F.C.M.C.No. 66 of
2008 for granting maintenance Under Section 125 of Cr.P.C. against the
above said respondent before the Hon’ble Family Court, Karimnagar. After
conducting trial and enquiry the Hon’ble Family Court was partly allowed
and pleased to pass order in the above case, on 30-12-2008. The Family
Hon’ble Court passed order in favour of petitioners against the respondent
directing him to pay Rs. 1200/- per month for the 1 st respondent and Rs.
800/- per month for the 2nd respondent towards maintenance from the date of
filing of the petition i.e., from 05-09-2008. As per orders passed by the
Hon’ble Court the respondent has to deposit an amount of Rs. 2000/- per
month to the petitioners.
2]. The petitioners have filed a petition u/sec 127 of Cr. P.C to enhance
maintenance from Rs. 1,200/- to Rs. 3,000/- to the petitioner no. 1 and Rs.
800/- to Rs. 2,000/- to the petitioner no. 2 per month vide Crl.M.P. No. 148
of 2016. Accordingly on 24-06-2020 the Hon’ble Court has allowed the
petition by enhancing the amount from Rs. 2,000/- to Rs. 5,000/- per month
to the petitioners i.e., Rs. 2,500/- each and directed the respondent to pay the
said maintenance amount to the petitioners no. 1 & 2 from the date of the
petition i.e., [10-04-2016] and he shall pay the maintenance amount to the
petitioners on or before 10th of every month. The respondent is further
directed to pay the arrears of difference amount of maintenance which is
enhanced to the petitioners within two months. Accordingly the respondent
is liable to pay arrears @ Rs. 3,000/- per month from 10-04-2016 to 10-04-
2019 is Rs. 1,08,000/- [3 years] to the petitioners.
3]. The petitioner no.1 submit that she is an house-hold lady and she is
living by borrowing amounts from others and mercy of her parents and the
petitioner no. 2 is minor and they will wait more time for getting the
amounts as they are leading miserable life. The petitioners are unable to
maintain themselves and they need minimum basic needs like food, clothes,
education and medical aid etc., immediately as such the amount is very
much required to them. According to the calculation the respondent has to
pay Rs. 1,08,000/- to the petitioners. It is just and necessary to direct the
respondent to pay the said amount to the petitioners immediately.

Hence in the interest of justice this Hon’ble Court may be pleased to
pass an order for directing the respondent to pay an amount of Rs. 1,08,000/-
to the petitioners or in case of failure by the respondent this Hon’ble Court
may be pleased to send the respondent to jail.

1]. That the above named petitioners have filed the F.C.M.C.No. 66 of
2008 for granting maintenance Under Section 125 of Cr.P.C. against the
above said respondent before the Hon’ble Family Court, Karimnagar. After
conducting trial and enquiry the Hon’ble Family Court was partly allowed
and pleased to pass order in the above case, on 30-12-2008. The Family

by borrowing amounts from others and mercy of her parents and the
petitioner no. 2 is minor and they will wait more time for getting the
amounts as they are leading miserable life. The petitioners are unable to
maintain themselves and they need minimum basic needs like food, clothes,
education and medical aid etc., immediately as such the amount is very
much required to them. According to the calculation the respondent has to
pay Rs. 16,000/-. It is just and necessary to direct the respondent to pay the
said amount to the petitioners immediately.

Hence in the interest of justice this Hon’ble Court may be pleased to
pass an order for directing the respondent to pay an amount of Rs. 16,000/-
to the petitioners or in case of failure by the respondent this Hon’ble Court
may be pleased to send the respondent to jail.

case. I am deposing this affidavit on behalf of petitioner no. 2 and I am

court. After conducting trial and enquiry this Hon’ble Court was partly
allowed and pleased to pass order in the above case, on 30-12-2008 in our
favour against the respondent directing him to pay Rs. 1200/- per month for
the 1st respondent and Rs. 800/- per month for the 2 nd respondent towards
maintenance from the date of filing of the petition i.e., from 05-09-2008. I
submit that as per orders passed by the Hon’ble Court the respondent has to
deposit an amount of Rs. 2000/- per month to us, but the respondent filed

month. I submit that I am a house-hold lady and I am living by borrowing

minor and he is studying in a private school as such we are leading
miserable life. I am unable to maintain ourselves and we need minimum
basic needs like food, clothes, education and medical aid etc., with the
meager amount of Rs. 2,000/-. The petitioner no. 2 is studying and cost of
living is increased enormously as such the maintenance amount granted was
very meager and it is not sufficient to us to fulfill our basic needs. Hence it
is just and necessary to enhance monthly maintenance amount from Rs.
2,000/- to Rs. 5,000/- from the date of the petition.

1]. That the above named petitioners have filed the F.C.M.C.No. 66 of
2008 for granting maintenance Under Section 125 of Cr.P.C. against the
above said respondent before the Hon’ble Family Court, Karimnagar. After
conducting trial and enquiry the Hon’ble Family Court was partly allowed
and pleased to pass order in the above case, on 30-12-2008. The Family
Hon’ble Court passed order in favour of petitioners against the respondent
directing him to pay Rs. 1200/- per month for the 1 st respondent and Rs.
800/- per month for the 2nd respondent towards maintenance from the date of
filing of the petition i.e., from 05-09-2008.
2]. As per orders passed by the Hon’ble Court the respondent has to
deposit an amount of Rs. 2000/- per month to the petitioners, but the
respondent filed appeal before the Hon’ble High Court of Andhra Pradesh,
Hyderabad and as per the orders of High Court of AP the respondent is
directed to pay an amount of Rs. 1,000/- per month. Accordingly the
respondent is paying the amount at the rate of Rs. 1,000/- per month and
recently the Hon’ble High Court at Hyderabad dismissed the petition filed
by the respondent as such he has to pay Rs. 2,000/- per month.
3]. The petitioners submit that she is an house-hold lady and she is living
by borrowing amounts from others and mercy of her parents and the
petitioner no. 2 is minor and they will wait more time for getting the
amounts as they are leading miserable life. The petitioners are unable to
maintain themselves and they need minimum basic needs like food, clothes,
education and medical aid etc., immediately as such the amount is very
much required to them. The petitioner no. 2 is studying and cost of living is
increased enormously as such the maintenance amount granted was very
meager and it is not sufficient to the petitioners to fulfill their basic needs.
Hence it is just and necessary to enhance monthly maintenance amount from
Rs. 2,000/- to Rs. 5,000/- from the date of this petition.

Hence in the interest of justice this Hon’ble Court may be pleased to
pass an order directing the respondent to enhancement of maintenance
amount from Rs. 2,000/- to Rs. 5,000/- to the petitioners from the date of
this petition, in interest of justice.
