THE BELOW NAMED COMPLAINANT BEING DULY SWORN, ON INFORMATION AND BELIEF
STATES THAT:

Count 1: FIRST DEGREE RECKLESSLY ENDANGERING SAFETY, USE OF A DANGEROUS


WEAPON

The above-named defendant on or about Wednesday, June 19, 2024, at 1859 North 40th Street, in the
City of Milwaukee, Milwaukee County, Wisconsin, did recklessly endanger the safety of NMS, under
circumstances which show utter disregard for human life, contrary to sec. 941.30(1), 939.50(3)(f),
939.63(1)(b) Wis. Stats.

Upon conviction for this offense, a Class F Felony, the defendant may be fined not more than Twenty
Five Thousand Dollars ($25,000), or imprisoned not more than twelve (12) years and six (6) months, or
both.

And further, invoking the provisions of sec. 939.63(1)(b) Wis. Stats., because the defendant committed
this offense while using a dangerous weapon, the maximum term of imprisonment for the felony may be
increased by not more than 5 years.

Count 2: POSSESSION OF A FIREARM BY ADJUDICATED DELINQUENT

The above-named defendant on or about Wednesday, June 19, 2024, at 1859 North 40th Street, in the
City of Milwaukee, Milwaukee County, Wisconsin, did possess a firearm, having been adjudicated
delinquent for an act committed on or after April 21, 1994, that if committed by an adult in this state
would be a felony, contrary to sec. 941.29(1m)(bm), 939.50(3)(g) Wis. Stats.

Upon conviction for this offense, a Class G Felony, the defendant may be fined not more than Twenty
Five Thousand Dollars ($25,000), or imprisoned not more than ten (10) years, or both.

Count 3: SELL/POSSESS/USE/TRANSPORT MACHINE GUN

The above-named defendant on or about Wednesday, June 19, 2024, at 1859 North 40th Street, in the
City of Milwaukee, Milwaukee County, Wisconsin, did use a fully automatic firearm, contrary to sec.
941.26(1g)(a) and (2)(a), 939.50(3)(h) Wis. Stats.

Upon conviction for this offense, a Class H Felony, the defendant may be fined not more than Ten
Thousand Dollars ($10,000), or imprisoned not more than six (6) years, or both.

Count 4: BAIL JUMPING (FELONY)

The above-named defendant on or about Wednesday, June 19, 2024, at 1859 North 40th Street, in the
City of Milwaukee, Milwaukee County, Wisconsin, having been charged with a felony and released from
custody under Chapter 969 of the Wisconsin Statutes, did intentionally fail to comply with the terms of
his bond, contrary to sec. 946.49(1)(b), 939.50(3)(h) Wis. Stats.

Upon conviction for this offense, a Class H Felony, the defendant may be fined not more than Ten
Thousand Dollars ($10,000), or imprisoned not more than six (6) years, or both.

Probable Cause:

Complainant is a sworn law enforcement officer and bases this complaint upon the reports and
investigation of the complainant as well as other deputies from the Milwaukee County Sheriff’s Office,
whose reports complainant has found reliable in the past.

On June 19, 2024, Detective Joseph Blanchar responded to Washington Park, 1859 North 40th Street,
City and County of Milwaukee, Wisconsin. Prior to arriving, Detective Blanchar arriving at the scene,
dispatch alerted that there were approximately 50 people on the northside of the park who were
fighting. Detective Blanchar got to the intersection of 40th Street and Roberts, once he moved onto
Lisbon Avenue, he saw the group of people, juveniles between 14-18 years old, yelling and moving in
groups.

While monitoring the crowd to determine the aggressors in the fight, Detective Blanchar heard
approximately five gunshots to his immediate left (east). Detective Blanchar tried to determined where
the shots originated and then heard fully automatic gunfire from the same area to his left and observed
a black male with a thin build wearing a grey hooded sweatshirt with his arm in the air and holding a tan
and black pistol. Detective Blanchar could see a silver device on the rear of the slide, which he knows
to be “switch” that makes a semi-automatic firearm function as a fully-automatic weapon.

The individual with the automatic firearm, later identified as the defendant, ONTERIO GIRLEY, dob
10/9/2006, continued to fire multiple bursts of gunfire from the weapon that he was holding in his hand.
With the defendant’s back to Detective Blanchard, the defendant leveled his weapon out towards the
crowd as he was running in a northeast direction. Detective Blanchard, still in an unmarked squad car,
followed the defendant to try and apprehend him, while sending information over the broadcast radio.
The defendant continued through the lanes of traffic on Lisbon Avenue and Lloyd Street before going
into a gangway by 4226 West Lloyd Street.

Detective Blanchard located the defendant sprinting from his right (east) as they both entered the alley
proper behind 4226 West Lloyd Street. Detective Blanchard positioned his vehicle in a way to disrupt
the defendant’s flight path which caused the defendant to be hit by the vehicle. Detective Blanchard
exited his vehicle with his firearm and the defendant was taken into custody. The defendant no longer
had a firearm on his person.

Deputies searched the flight path of the defendant and located a firearm next to the residence, to the
east, at 4220 West Lloyd Street. The firearm was recovered close to the fence, about three feet from
the direction of travel by the defendant. Detective Blanchard saw the firearm and identified it as the
same tan Glock pistol with the black slide that he saw the defendant shooting earlier.

The defendant was medically cleared by the Milwaukee Fire Department.

On June 20, 2024, Detective John Gillot spoke to NMS, dob 4/23/2009, at Children’s Hospital of
Wisconsin. NMS was being treated for gun shot wounds sustained the previous day at Washington
Park. NMS said that while at the park, there was a fight that broke out and at one point he heard a
barrage of automatic gunfire. As NMS was running from the park in the southeast direction, he was
shot and ultimately taken to Children’s Hospital for treatment. NMS was also placed into custody
related to a shooting that took place the same night at Washington Park that resulted in the death of
SDT, dob 10/6/20061.

Based on the review of drone surveillance video from the incident, NMS appears to have been shot by
gunfire coming from the automatic firearm used by the defendant. Complainant has reviewed the
surveillance video that captures the movements of both NMS and the defendant during this incident
and does not see any other individuals who could have shot NMS other than the defendant.

This investigation is ongoing and the complaint does not reflect all of the information known to law
enforcement at this time. Charges may be amended or added as the investigation continues.

PRIOR JUVENILE ADJUDICATION

Complainant has reviewed the records related to Milwaukee County Case No. 2022JV310, State of
Wisconsin v. Onterio M. Girley, dob 10/9/2006. Those records indicate that the defendant was
adjudicated delinquent of Armed Robbery – Party to a Crime, in violation of Wis. Stat. 943.32(2) and
939.05. That adjudication occurred on July 7, 2022, and remains of record and unreversed. Armed
Robbery in violation of Wis. Stat. 943.32(2) is a felony when committed by an adult, and having been
adjudicated of that offense, prohibits the defendant from possessing a firearm.

OPEN FELONY CASE

Complainant has reviewed the Wisconsin Circuit Court Access Program (CCAP) records for Milwaukee
County Case No. 24CF2445, State of Wisconsin v. Onterio M. Girley, dob 10/9/2006, which reveal that
the defendant is charged with one count of Possess Firearm – Adjudicated Delinquent of a Felony, a
felony in violation of Wis. Stat. 941.29(1m)(bm). The records show that the defendant was released
from custody on a $750 cash bail on May 24, 2024 with conditions of bail to include that he no commit
any new crimes and that he not possess a firearm.
