Sub: Lease Rent Accommodation facilitv for residential accommodation taken by


Officers either i n Bank's name or in personal name

HIGtlUGHTS OF CIRCULAR
Enhancement in monthly lease rental amount in all Scales.
Re-categortzation of places.
Introduction of local transportation charges once in 3 years.
Brokerage charges once in 3 years.
Provision for payment of security deposit amount for Officers on
probation.
In case of retirement, Officer can avail the lease facility upto 1 month
from their date of retirement.
In case of transfer, the eligibility of previous place of posting can be paid
maximum upto 2 months from the date of relieving.
In case of demise of an Officer, the family of the Officer can avail the
lease facility upto 6 months from the date of demise of Officer.

In terms of Regulation 25 of Union Bank of India Officer's (Service) Regulations, 1979,


Bank's accommodationis provided to eligible Officers by the Bank, subject to availability
of Bank's flat. Where Bank is not in a position to provide residential accommodation,
Officers are allowed to arrange residential accommodation on their own, on lease basis
and can claim the rent from the Bank as per their entitlement. Rental limits are entitled
as per the place of posting or ptace of residence, subject to the fixed rental ceilings or
actual rent, whichever is lower. The Scheme for lease rent accommodation facility for
residential accommodation taken by officers was circulated vided Staff Circular no. 7490
dated 31.08.2021.

We are now pleased to inform that Board has approved enhancement in the lease rental
ceiling and other modifications in the Scheme. The revised limits, other modifications
in the Scheme and other Annexures are enclosed as mentioned below:

The revised Scheme will be effective from 01.09.2023 onwards and the revised rental
ceiling will be provided for monthly rent amount payable for the month of September
2023 onwards. The increase in rental limit, will ease the financial burden on the officers,
who are not having their own accommodation.

Therefore, Officers who are bearing the additional expenditure towards Lease rental
accommodation (as per the lease rent agreement) will be provided with the enhanced
monthly rental limits (as per their revised eligibility) from the month of September 2023
onwards without submission of any applicationlrequest.

ALL concerned are advised to take a careful note of the above and be guided accordingly.

LEASE RENT ACCOMMODATION FACILITY FOR RESIDENTIAL ACCOMMODATION TAKEY


BY OFFICERS EITHER IN BANK'S NAME OR IN PERSONAL NAME

All Officers including probationary officers will be eligible
for taking up Bank's residential quarters. In case Bank's
residential quarters are not available, the Officers including
on probation may take residential accommodation on lease
basis i n Bank's name or i n personal name as per their
eligibility. However, i n below mentioned circumstances,
officers are not eligible for availment of Lease rent facility:

a) If any officer owns a house i n the city of hislher place


of posting, helshe is not eligible for leased
accommodation.
b) If any officer is having accommodation i n the name of
hislher spouse or if spouse of the officer i s provided
with residential accommodation from hislher
employer, the officer is not eliable for leased
accommodation i n the same city.
c) If parents1 parents-in-law (for both male 8 female
employees) of the officer own any accommodation in a
city where the officer is posted, normally the officer i s
not eligible for lease rent facility. However, sanctioning
authority may permit the lease rent facility i n
exceptional cases, subject to satisfaction of the
Sanctioning Authority of the reasons for staying
inlavailing a separate accommodation on Lease rent
basis a t the centrelplace.
d) If both wife and husband are working i n the Bank a t the
same place of posting and one of them is provided with
leased accommodation by the Bank, the spouse is not
eligible for Leased accommodation.
e) If an Officer takes leased accommodation for a house
owned by his father1 motherlspouselchildrenlparents-
in-law (for both male & female employees) the officer
is not eligible for leased accommodation.
f) If an officer takes leased accommodation of a house
owned by hislher other close relative (other than the
close relatives as mentioned above a t point no. e),
where the house owner resides with himlher, the
officer is not eligible for leased accommodation.

Employees who are posted at Mumbai & Delhi shall be paid


brokerage amount upto the extent of two month rent
eligibility. The brokerage shall be paid once i n 3 years from
the date of last sanction at the same citylstation, subject to

I General Conditions for Payment of Brokerage

The Brokerage amount can be claimed by the Officer & paid


through below mentioned modes:

provided with the eligibility of Area-l as mentioned
above. Further, branches which are not falling under the
ambit of Municipal CorporationlNagar Palika where
Regional Office is located will be provided with their
eligibility as per aforesaid categorization only.

For Examole; Guntur falls under Area-ll as per aforesaid


classification (based on Census 2011). Therefore, it will
be provided with the eligibility of Area-I.

In Mumbai & Delhi, i f an Officer owns an accommodation


at a district under Urban Agglomeration of Mumbai &
Delhi, other than the district of hislher place of posting,
helshe will be eligible for lease accommodation facility at
hislher place of posting subject to fulfillment of other
eligibility conditions ti: satisfaction of the lease
Sanctioning Authority.
Local If an Officer who has taken up residential accommodation

charges personal name chooses to shift to another location at the
same citylstation due to various administrativelpersonal
reasons helshe will be entitled for reimbursement of
local transportation charges for shifting of household
items from old residence to new residence once i n 3 years
from the date of last availment a t the same place of

For the said purpose, the maximum transportation

charges provided for local shifting are as under:
DETAILS
The transportation charges i n shifting shall be permitted
as per the ceiling mentioned above or actual amount paid
whichever is lower on submission of valid transportation
billslreceipts from the vendor. The payment should be
routed through the account of the Officer. The aforesaid
limits are inclusive of all taxeslcharges.

The local transportation charges as mentioned above, can


be claimed by the eligible employee, only through Union
Parivar. The necessary modifications i n the module are
being carried out and informed i n due course. The
Competent Authority for the sanction of the same will be
same as lease sanctioning authority. Till the
development o f said changes, no manual applications
will be processed/sanctioned.

I The local transportation charges will not be provided i n


below mentioned circumstances:

a) When local shifting of residence is made before

shifting is made after 01.09.2023.
Lease eligibility Officers can get the lease eligibility of previous place of

lease is continued at previous place of posting, the lowest
limit between the new & previous place of posting will be
provided, subject t o a condition that their leave & license
agreement is valid and they are not availing any lease
facilityIHRA a t new place of posting.

In such case, employee should request the lease


sanctioning authority of new place of posting to continue
the lease at previous place of posting and provide the
eligibility of previous place of posting for 2 months,
subject to a condition that their leave & license
agreement is valid and they are not availing any lease
facilitylHRA at new place of posting.

After lapse of maximum 2 months from date of relieving,


if the employee continues with the lease of previous place
of posting, the officers will be entitled for rental Limits as
per the place of posting or place of residence, subject to
the fixed rental ceiling or actual rent, whichever is lower. *,

10 Lease eligibility In case of retirement, the officer can get the lease facility
on Retirement upto one month from the date of retirement. This clause i s
not applicable in case of ResignationlVRS cases.
Lease eligibility in case of demise of an Officer, the family of the Officer shall

General Leave and License Agreement to be made either i n

Execution of an If Leave I3 License Agreement is executed in Personal

kept with Bank whereas i f leave & license agreement ir
executed in Bank's name then the original agreement ir
required to be kept with the Bank.

The applicant has to apply for lease rent application


within 90 days of execution of leave Ft license
agreement. In case of renewal of lease also, applicant
has to request for the same within 90 days after expiry
of previous lease.

Leave and License Agreement should mandatorily be


executed i n the name of the officer as Licensee singly
who is availing the lease rent facility from the Bank.

The Leave and License Agreement to be executed as per


respective state norms.

The format of leave ti. license agreement as enclosed is


indicative. The format of actual leave i 3 license
agreement while execution may vary in different States.
Sanctioning Authorities must ensure that all the points
as mentioned in the indicative format must be covered
in the agreement submitted by Officer and also ensure
that if any additional clauselpoint i s mentioned therein,
it must not contradict the extant guidelines.

In case the property in Joint Name:


a) In normal circumstances, both the owners should
sign the leave and license agreement. However, in
case of non-availability of 2ndowner, the same can
be signed by one owner subject to submission of
from other co-owner.

b) If the property is i n joint name and both the owners
request to pay the bifurcated lease rent amount in
two separate accounts, the same can be bifurcated
between the joint owners. The clause pertaining t o
the same should also be invariably mentioned i n the
lease agreement.

c) If the property is i n joint name and monthly rent i s


to be credited in account of the single owner, NOC
from other co-owner of the property should be
obtained.

d) If the property is a single name and the monthly rent


amount is to be credited i n account of the Joint
account, NOC from other account holder to be
obtained.

Officers may be permitted to avail lease rent facility for


self or hislher family at a place other than hislher place
of posting subject t o their eligibility.

Officers are entitled for rental limits as per the place of


posting or place of residence, subject to fixed rental
ceilings or actual rent, whichever is lower.

In case any cityltownlarea falls under two categories,


higher of the two limits will be applicable.

Tax i s deducted as per Income Tax ruleslguidelines.

In case of pre-mature termination of Leave and License


Agreement by any Officer for reasons other than
transfer/purchase of own accommodation1 allocation of
staff quarterlcessation of servcies due to any reason, the
recomrnendinglapprovingIsanctioning authority should
exercise due caution while

Officers who are officiating i n higher Gradeslscales shall
be eligible for the rental limit as applicable to their
original Gradeslscales.

suspension. Renewal of lease facility shall also be
allowed during the period of suspension. However,
sanction for fresh lease shall not be permitted. This
clause shall be applicable prospectively.

Where an officer is provided with residential


accommodation by the Bank, a sum equal to 0.50% of the
basic pay i n the first stage of the scale of pay i n which
the officer is placed or standard rent for the
accommodation (as specified i n SC 4397 dated
17.10.1997), whichever is Less, will be recovered from
himlher.

If the annual rent paid by the employee exceeds


Rs.2,40,000/- per annum, it i s mandatory for the
employee to report PAN of the landlord to the employer.

This limit of Rs.2,40,000/- is derived from the Limit till
which tax deduction was exempted as per Income Tax
Act w.e.f. 15.04.2019 and hence PAN of the landlord i s
required only if rent exceeds Rs.2,40,0001- p.a.
However, this limit is subject t o revision as per Income
Tax guidelines.

In case the renewal of Lease Agreement is not made by


the Officer, the payment of the monthly lease rent
cannot be made. Hence, all concerned authorities should
ensure that the monthly rent payments are made only
after sanction of lease rent applications.

I In case of any doubt with regard to the application or(


interpretation of any of the terms and conditions stated
above, it shall be referred t o Chief General Manager (HR)
and hisiher decision shall be final and binding.

Paying Authority has to ensure that they are making
payment for the staff posted under their jurisdiction
only.
In case of relieving, staff should give written request to
concerned officials a t previous place of posting to stop
the lease rent payment. However, if 2 months' rent i s to

clause no. 9 as mentioned above will be applicable.

5. The licensed premises will be used only for residnetial purpose

desires to have any additional fittings and fixtures, the Licensee may do so at hislher
cost and in compliance with the rules. The Licensee shall remove such fittings and
fixtures on the termination of the license failing which they shall be deemed to be
the property of the Licensor.

7. The licensed premises are given to the Licensee on personal basis and the Licensee
will not be entitled to transfer the benefit of this agreement to anybody else or will
not be entitled to allow anybody else to occupy the premises or any part therof.
Nothing in this agreement shall be deemed to grant a lease and the Licensee agrees
and undertakes that no such contention shall be taken up by the Licensee at any time.

8. The Licensee shall be deemed to be in the exclusive occupation of the licensed


premises and the Licensor shall enter the flat1 house with the consent of the Licensee
during the day to inspect the premises.

9. ~ h r eLicensee shall maintain the licensed premises in good condiition and will not
cause any damage thereto. If any damage i s caused to the premises or any part thereof
by the Lice-nseeor hislher employees, servants or agents, the same will be made good
by the Licensee at the cost of the Licensee either by rectifying the damage or by
paying cash compensation as may be determined by the Licensor's Architect.

10. The Licensee shall not carry out any work of structural repairs or additions or
alterations to the said premises. Only such alterations or additions as are not of
structural type or of permanent nature may be allowed to be made by the Licensee
inside the premises with the previous permission of the Licensor.

of the said flatl house on leave and license basis. The Licensor shall refund the said

delievery of the vacant physical possession of the flatl house to the Licensor after
clearing the outstanding dues, if any.

12. This agreement shall not be terminated by reason of sale or mortage of the licensed
premises.

13. If the Licensee commits a breach of any term of this agreement then, not withstanding
anything contained herein, the Licensor will be entitled to terminate this agreement
by giving ...............
days' prior notice to the Licensee.

14. If, at any time, during the continuance of this agreement, the Licensee1 Licensor
intends to vacate the licensed premises, helshe may do so by giving one month's
calendar notice.
15. On the expiry of the said term or period of the License or earlier termination thereof,
the Licensee shall hand over vacant and peaceful possession of the Licensed premises .*
to the Licensor in the same condition in which the premises now exist
