Dear Mr. Olaño,

This responds to your email dated May 8, 2021, as referred/endorsed to this


Office of the Register of Deeds by Atty. Cedrick Justice U. Capiral, City Legal Officer,
City Government of Antipolo, Rizal, thru his letter dated 22 July 2021.

To begin with, the Office of the Register of Deeds under the Land Registration
Authority (LRA), is an organic governmental unit. The office cannot just file a suit
without the consent of the State and, in which suit, be represented by the Office of the
Solicitor General. Your proposition that the office of the Register of Deeds files an
annulment case against the OCT No. P-1085 registered in the name of Ramoncito G.
Tagle on the basis of the findings and recommendation in LRA’s Task Force Titulong
Malinis (TFTM) Report No. 09-060, if done without the representation or imprimatur of
the Office of the Solicitor General, would open a danger of counter-suit (counterclaim)
against the State without its consent. And, in same way, would open the Registrar of
Deeds who files the suit as filing on his/her own personal capacity and own liability in
counter-suit or counterclaim.

The LRA’s TFTM has its own procedure to follow. The extent of the authority and
operational procedure of the Task Force Titulong Malinis (TFTM) which was created
pursuant to the Memorandum Agreement executed on September 15, 1998 by and
among the Department of Justice (DOJ), Office of the Solicitor General (OSG),
Presidential Anti-Organized Task Force and LRA, and implemented through LRA
Memorandum Order dated January 14, 1999, is equally clear and categorical. Under the
said Memorandum Order, which provide for the “Operational Guidelines of the Task
Force,” upon receipt of the case folder, which may involve “fake, spurious or irregular

issued land titles,” among others, the Task Force’s Investigation Team shall proceed to
investigate/verify the authenticity or genuineness of the questioned certificate of title or
other related documents. Thereafter, its findings, which shall be in the form of a
report with recommendation, together with the supporting documents and case
folder, shall be forwarded to its Litigation team, through the Secretariat, for evaluation
and drafting of appropriate complaint for annulment, if warranted. Once finally approved
by the Overall Head/Administrator, the draft complaint shall be forwarded to the OSG for
evaluation and the appropriate filing of the appropriate case in court [emphasis
added, quoting from LRA Circular No. 21-2007; DOJ Memorandum dated September
13, 2007].

As of now and with due respect to the recommendation in TFTM No. 09-060
report, this Office of the Register of Deeds awaits the action and/or approved
representation of the OSG against OCT No. P-1085, in accordance with TFTM’s own
operational procedure.

In the record (as well as has been revealed in TFTM No. 09-060 report), OCT
No. P-1085 that is registered in the name of Ramoncito G. Tagle was issued as patent-
Kaloob Patente Blg. 045802-98-3591 on December 21, 1998 by PENRO-Province of
Rizal, which the PENRO transmitted to the Registry of Deeds of Marikina City on
January 19, 1999. Its original registration was later inscribed in November 2001 in the
registration book of the Office of the Register of Deeds of Marikina, by RD Edgar D.
Santos. The office file copy of the OCT was later transferred to the Office of the
Register of Deeds of Antipolo City, following its creation in 2001. In the findings in the
TFTM No. 09-060 report, it was shown that the lot covered by OCT No. P-1085 overlaps
several titled private land. Having real interest on the outcome of any case against OCT
No. P-1085, any or all of the owner of the titled land enumerated in the TFTM No. 09-
060 report that had been overlapped by the OCT No. P-1085, if these private land
owners so desire, may initiate a complaint for the annulment of title by their own,
independently of what the TFTM/OSG shall file.
