Philippine Importation Reminders for Air Freight

Importers which importation are either under PEZA


(Philippine Economic Zone Authority), Free port Zone
or for local Consumption are required to be accredited
with the Bureau of Customs.
For first time customers, it is recommended to check
with NNR PH first if the consignee are duly registered
with the Bureau of Customs.
Importation of unregistered importers will be hold
Import Accreditation until he/she complies with the accreditation Import Air /Manila
requirements.

Please note: Customs Broker will not be able to start


the customs clearance without the customs
accreditation/registration. Failure to lodge an entry
within 7 days (from day of discharge of the last
package from the vessel or aircraft) will results to an
automatic abandonment of cargo.

To continue the customs clearance, broker/consignee


must apply for lifting of abandonment which entails
additional processing cost and will take at least 1 to 3
days processing.

NNR PH needs to lodge the e-inward manifest prior to


cargo arrival, hence Origin office must send complete
and accurate copy of Pre-Alerts (MAWB, HAWB,
Invoice and Packing list) at least one day prior to arrival
for Asia and 2 days for US, Middle East and Europe.
Sending of Pre-Alert Import Air /Manila

We also need to request to send your pre-alert on a


separate email. Please don’t send your pre-alerts
(copy of MAWB,HAWB, Invoice and Packing list) on
previous or first communication for us to avoid to miss
out the pre-alert due to long thread of email
communications.

Wrong encoding or late manifest will be subject for


customs clearance and entails additional processing
cost and Penalty.
Penalty

1st offense: PHP 100,000.00


2nd offense: PHP 200,000.00
3rd offense: PHP 300,000.00

It is recommended that overseas office to check with


NNR PH first if the Name and Address of Consignee
reflected in the HAWB are same with the Name and
Address in Importer’s BCOR (Bureau of Customs
Certificate of Registration), especially those
importation that are for local consumption.
Erroneous AWB with wrong consignee’s name and
Name of Consignee in the address will be subject for amendment processing. Import Air /Manila
AWB must match with the As such error will cause delay in the customs clearance
BCOR processing and entails additional processing cost and
Penalty.

Penalty USD 220.00

A proof of payment such as, Bank Transfer, purchased


order or sales contract are a mandatory requirement
for importation which are subject for payment of
duties and taxes and if the value declared falls under
the Bureau of Customs National Value Verification
Proof of Payment. System (NVSS). As such proof must match with what Import Air /Manila
value declared in the commercial invoice.

If no such proof can be provided, the Bureau of


Customs may re-asses and upgrade the value of the
goods.

The Bureau of Customs requires an accurate


information in the invoices and packing lists, including
the weight, quantity, volume, description and
measurements of items.

- Generic Names are not allowed (e.g.


Machine, parts, etc.), invoice and packing
list should show the exact description of
the products. (e.g Conmed System 7550
Electrosurgical Generator, O-ring, etc.).
- Net weight per item/unit and
not net weight per box should be declared
in the packing list.

Example:

Allowed: O-ring ---- net weight 120


grams
Cables ----- net weight 300
Invoice and Packing List grams Import Air /Manila

Not allowed: 1 box (O-rings and


Cables) --- net weight 420 grams

- Gross weight in the invoice and packing


list must match with what was declared in
the AWB.

- Better not to declare Software, programs


and apps. In the invoices and packing list.
Since the mentioned items are intangible
and there's no way to declare
the net weight, it is better to add the value
of the software/apps to the unit/product
itself to avoid problems during the
declaration of entry.

- The BOC will impose a USD 110.00 penalty


for any clerical errors including the above-
mentioned issues.

Recently NNR PH is encountering amendment of


Manifest due to wrong BL nature code declared by
Airline at Origin. For Direct AWB, it is recommended
that Shipper to check the Correct AWB with the
Consignee and inform Airline prior to departure and
Direct AWB’s BL Nature Code lodgment of E-Manifest. Import Air /Manila
Failure to do so will result for the amendment of the
E-Manifest and entails additional cost and Penalty.

Penalty USD 220.00

Regulated Commodities can be imported only after


securing the necessary goods declaration, clearances,
licenses, and any other requirements prior to
importation. Submission of requirements after arrival
of the goods, but prior to release from the Bureau of
Customs’ custody shall be allowed, but only in cases
provided for by governing laws or regulations.
Regulated Commodities The list of Regulated Import Commodities and the Import Air /Manila
Administering Agencies is available in the Philippine
National Trade Repository (PNTR) website
(www.pntr.gov.ph). This website also contains
information on import procedures and documentary
requirements for Regulated Commodities.

Except when authorized by law or regulation,


the importation and exportation of the
following restricted goods are prohibited:
(Chapter 3, Section 119 CMTA)

a. Dynamite, gunpowder, ammunitions and


other explosives, firearms and weapons of
war, or parts thereof;
b. Roulette wheels, gambling outfits, loaded
dice, marked cards, machines, apparatus or
mechanical devices used in gambling or the
distribution of money, cigars, cigarettes or
other goods when such distribution is
dependent on chance, including jackpot and
Restricted Importation and pinball machines or similar contrivances, or Import Air /Manila
Exportation parts thereof;
c. Lottery and sweepstakes tickets, except
advertisements thereof, and lists of drawings
therein;
d. Marijuana, opium, poppies, coca leaves,
heroin or other narcotics or synthetic drugs
which are or may hereafter be declared habit
forming by the President of the Philippines, or
any compound, manufactured salt, derivative,
or preparation thereof, except when imported
by the government of the Philippines or any
person duly authorized by the Dangerous
Drugs Board, for medicinal purposes;
e. Opium pipes or parts thereof, of whatever
material;

f. Any other goods whose importation and


exportation are restricted;
g. Weapons of mass destruction and goods
included in the national Strategic Goods list
(NSGL) as provided under Republic Act No.
10697 or the Strategic Trade Management Act
(STMA);
h. Toxic and hazardous goods under Republic Act
No. 6969 or the “Toxic Substances and
hazardous and Nuclear Wastes Control Act of
1990.”
The restriction to import or export the above stated
goods shall include the restriction on their transit.

The importation and exportation of the following


goods are prohibited: (Chapter 3, Section 118 CMTA)

a. Written or printed goods in any form


containing any matter advocating or inciting
treason, rebellion, insurrection, sedition
against the government of the Philippines, or
forcible resistance to any law of the
Philippines, or written or printed goods
containing any threat to take the life of, or
inflict bodily harm upon any person in the
Philippines;
b. Goods, instruments, drugs and substances
designed, intended or adapted for producing
Prohibited Importation and unlawful abortion, or any printed matter Import Air /Manila
Exportation which advertises, describes or gives direct or
indirect information where, how or by whom
unlawful abortion is committed;
c. Written or printed goods, negatives or
cinematographic films, photographs,
engravings, lithographs, objects, paintings,
drawings or other representation of an
obscene or immoral character;
d. Any goods manufactured in whole or in part of
gold, silver or other precious metals or alloys
and the stamp, brand or mark does not
indicate the actual fineness of quality of the
metals or alloy;
e. Any adulterated or misbranded food or goods
for human consumption or any adulterated or
misbranded drug in violation of relevant laws
and regulations;
f. Infringing goods as defined under the
Intellectual Property Code and related laws;
and
g. All other goods or parts thereof which
importation are explicitly prohibited by law or
rules and regulations issued by the competent
authority.

Customs is now requiring overseas office to declare 6-


digit HS Code on the HAWB and MAWB. For multiple
HS Code which will not Due to the implementation of
Cargo Target System (A tool to identify High Risk Import Air /Manila
Cargo Targeting System shipments), the Bureau of fit on the AWBs, forwarder
may utilize an additional sheet of paper.

All regulated shipments in NAIA specially those


falls from the category of chemicals, adhesive,
battery, etc. shall strictly pass through CNIU and
EPCD. If an item is regulated, consignee or its
representative must provide necessary permits
from other government agencies.

Customs are also requiring consignee/brokers to


CNIU (Customs Narcotic
present or provide MSDS showing the CAS Import Air /Manila
Interdiction Unit) & EPCD registry number. Trade Secret or No CAS registry
(Environment Protection and number shall not be accepted unless the
Compliance Division) Manufacturer can provide a certificate of the
said Unknown CAS No attesting the CAS and
Name of the unknown chemical.

Furthermore, in Sec. 3 of the MSDS a complete


CAS number of the chemical composition /
ingredients must be indicated and at least must
have a sum of 100% of the chemical composition.

Import Air /Manila

• Please provide final and correct pre-alerts


at least a day before the arrival.
• Please don't fail to send your pre-alerts.
Late Manifest
• If the pre-alerts are only draft, please put
water mark "DRAFT" so we will not be
confused and input wrong details in the
e-manifest.
• For new customers/shipments, kindly
send a draft AWB first so we could
confirm if the consignee's name matches
the name and address shown on the
Bureau of Customs Registration
Certificate.
• For Non-Regular shipments, please
provide the complete and accurate
contact details, we must confirm the
actual BL nature code (Dutiable or Non-
dutiable shipments) and secure a copy of
their Bureau of Customs Certificate of
registration (BCOR). Kindly take note that
some of customers are off during the
weekend. Hence, please provide the
contact details of consignee on either
Thursday or early morning of Friday.
• Failure to do the third and fourth
reminder may result to amendment of
manifest that entails additional cost.
• If we cannot reach or contact consignee
to acquire the BCOR on time due to lack
or wrong contact details, we will have to
proceed the lodgment of Manifest based
on what was indicated on the AWB to
avoid the penalty for the late manifest.
But this may result to amendment of
manifest later on if ever we found that
the consignee's name and address on the
AWB doesn't match on what was
indicated on the BCOR.
• If we cannot reach or contact consignee
to verify BL Nature code on time due to
lack or wrong contact details, we will
proceed the lodgment of Manifest and
judge the BL nature code based on the
address of consignee in the AWB to avoid
the penalty for late manifest. But this may
result to an amendment of BL nature
code if ever we later find that a different
BL nature code should be applied.

In relation to our announcement, we would like to


request from all origin station to avoid declaring
General Descriptions on the AWB at the same
time on the invoice and packing list.

For example: Machines, Spare parts, Equipment,


etc....

Please declare specific description.

For Example:
• Instead of Machine should be Coats Tire
Changer.
• Instead of Spare parts should be "Beon
Aluminum Extrusion Cases.

• Instead of Equipment should be "


Automatic Glycohemoglobin Analyzer
(Medical Equipment "

Codes descriptions are also not allowed, it should


be the specific description that can easily be
understand and identify.

The declared commodity on the AWB should be


the same on what was declared on the invoice and
packing list. If there are several items and would
not fit on the allotted space on the AWB. You can
declare at least 2 or 3 items.

If we received pre-alerts of shipping documents


without the specific description, we will proceed
to lodge the manifest based on what was shown
on the documents at hand to avoid the penalty for
the late submission of the manifest. However,
there is a great chance that the AWB will be
subject for amendment which entails additional
cost.

We also need to request to send your pre-alert on a


separate email. Please don’t send your pre-alerts
(copy of MAWB, HAWB, Invoice and Packing
list) on previous or first communication for us to
avoid to miss out the pre-alert due to long thread
of email communications.

For Shipments such as Gift, Samples and


Replacements – please don’t indicate “ No
commercial value or Value for Customs Purposes
only” on the Commercial Invoices.
Commercial Value declared should be the same as
the current market value of the items. Unless
consignee or shipper can provide the purchase
order, sales contract or proof of payment for such Import Air /Manila
Declaring Non-Commercial items proving the actual value of the imported
Value for Sample, Gift and items.
replacement Importation.
According to Section 1402 of the Customs
Modernization and Tariff Act – Failure to provide
above evidences may result to additional
surcharge of twenty percent (20%) on the dutiable
value of the goods.
