WHEREAS, Sec. 391 (1) of the Local Government Code of 1991 provides that the
Sangguniang Barangay, as the legislative body of the Barangay enact ordinances as may be
necessary to discharge the responsibilities conferred upon it by law or ordinance and to
promote the general welfare of the people inhabiting therein;
WHEREAS, Republic Act (RA) 9710, otherwise known as the Magna Carta of Women, is
a comprehensive women’s human rights law that seeks to eliminate discrimination against
women by recognizing, protecting, fulfilling and promoting the rights of Filipino women,
especially those in the marginalized sectors. Section 12 D, Rule IV of the Rules and
Regulations Implementing the Magna Carta of Women provides for the establishment of a
VAW desk in every barangay to ensure that violence against women cases are fully
addressed in a gender-responsive manner;
WHEREAS, a VAW Desk is a facility that would address VAW cases in a gender-
responsive manner, managed by a person designated by the punong barangay. It is situated
within the premises of the barangay hall. In the absence of a barangay hall, the VAW Desk
shall be established within the premises where the punong barangay holds office.
WHEREAS, the Sangguniang Barangay recognizes the state policy that values the
dignity of women and children and guarantees full respect for human rights, including the
recognition of the need for the State, through its barangay, to protect the family and its
members, particularly women and children, from violence and threats to their personal
safety and security;
WHEREAS, to this end and in accordance with RA 9262 on the Anti-Violence against
Women and their Children Law 2004 and other applicable laws and ordinances, the State,
through its barangays, shall exert efforts to address violence committed against women and
their children in keeping with the fundamental freedoms guaranteed under the constitution
and other human rights instruments;
Funding. The cost of the establishment and operations of the VAW Desk shall be
charged to the LGU’s Gender And Development (GAD) budget, which shall be at least five
percent (5%) of their budgetary allocation. As such, it shall be included in the annual GAD
