Moot Problem-1

Peekaboo Co Ltd was an Agency that managed big celebrities in the famous city of Janta Land.
They entered into a contract with Mr Jim Bim who was a very popular singer in the country and
had a huge social media influence. The contract entered between them was for 10 shows across
the world for which Mr Bim was promised an amount of Rs 2,50,00,000. Peekaboo was also
respomsible for the management and hospitality of the celebrity.

The first show happened in New York City which was a great success. Next show was lined up
in Tehran which was an underdeveloped country and without a strong fan base. Mr Bim asked
the Agency to shift the location but because all the arrangements were made, this could not be
shifted.

At the time of the event, a large number of residents of Tehran were infected with ‘Pharyngitis’.
After the event Mr Bim observed some issues with his throat and he decided to take some rest in
his room. But soon, he started facing severe health issues for which he had to be taken to the
hospital.

He was admitted to Peekaboo Hospitals but the discomfort increased because the room was not
very well ventilated and the medicines which were provided to him were affecting him
negatively. Therefore, Mr Bim left the city with his team for better treatment. Assuming the
infection to be a minor one, the organizers started preparing for their third and flagship line-up
which was to be conducted in Sweden.

Later on, when the organizers came to know that the artist had left and had no intention to
continue the performances with the organizers they called up the manager of the artist and
threatened them to face appropriate consequences if the artist did not make himself available for
the next event

The next day, the artist went live on social media and told that he had been treated poorly by the
organizers and that organizers are planning to harm the artist. The artist said - “I signed up for
this event to reach out to maximum fans of music, I signed up to give power to the people
through our music. The New York City event was a great success; I don’t know what made them
treat me and my staff poorly. Tehran was a black chapter of my career, the facilities were worst.
Doctors here have told me that medicine provided in Tehran didn’t suit my body and the
infection is serious. My career is on stake, maybe money is the only thing which those inhumane
capitalists care about”

This went viral and a social media campaign was launched against the Peekaboo Groups.
Triggered by the message, fans of the artist pelted stones on the property of Peekaboo Groups.
Hashtags like #Inhumanpeekaboo and #Boycottpeekaboo started trending over social media

This led to the cancellation of the entire tour and therefore, Peekaboo Groups had to face severe
financial loss. This led to Peekaboo Groups sue Mr Jim Bim for breach of contract, civil
defamation.
