by willful disobedience of the order of this Hon'ble Court made in
W.P.No.42571 of 2006 dated 24.07.2018.

ORDER

This contempt petition is filed alleging willful disobedience of the

order dated 24.07.2018 made in W.P.No.42571 of 2006.

2.In the order dated 24.07.2018 made in W.P.No.42571 of 2006,

this Court had directed the respondent herein to pay a sum of

Rs.2,50,000/- to the petitioner, within a period of six weeks from the

date of receipt of a copy of that order.

3.It is represented by the learned counsel appearing for the

respondent that after rejection of the approval petition in Approval

Petition No.332 of 2003 on 12.02.2005, the respondent had paid a

sum of Rs.1,50,000/- to the petitioner in the year 2008, however, this

fact was not brought to the notice of this Court on 24.07.2018 when

the order was passed in W.P.No.42571 of 2006. Hence, this Court

presumed that no amount was paid to the petitioner and directed the

respondent to pay a sum of Rs.2,50,000/- to the petitioner, within a

time frame.

4.It is further represented by the learned counsel appearing for

the respondent that in compliance of the order dated 24.07.2018

made in W.P.No.42571 of 2006, the balance amount of Rs.1,00,000/-

was paid to the petitioner on 31.07.2019, however, belatedly. Hence,

the respondent/ contemnor is ready to pay a sum of Rs.5,000/- as

costs to the petitioner.

5.In view of the fair submission made by the learned counsel

appearing for the respondent, this Contempt Petition is closed. The

respondent is directed to pay a sum of Rs.5,000/- towards belated

payment to the petitioner, within a period of four weeks from the date

of receipt of a copy of this order.
