8.16.2 (TLO) were found to be interacting with the Front-End Loader machine
whilst loading the trucks with material.
Section 11 o Risk assessment about the use of employees as spotters at t}is mine must
be reviewed to ensure that no empioyees are exposed to a risk of being
run over or hit by a TlM whilst working at the mine.

B. The instruction(s) given

The employer is hereby instructed to urgently attend to the above-mentioned non-


compliances and ensure that measures are put in place to ensure that these non-compliances
do not occur again
The employer is firther instruoted to send a copy of the report or an action plan in response
to fl1is instruction to the ofnce of the Regional Principal Inspector on or before 20 March
2024.

1 Access Control

. Access controt found to be under the control of access officer.


. Alcohol testing is conducted prior entering the mine premises, but
there are no wipes for alcohol testing kit used at main entrance of the
mine.
. Traffic management system for the mine must be improved such that
packing at office block of the mine is addressed.

2 Legal Appointments

. Legal appointment in terms Regulation 2.6.'l (Subordinate Manager -


Mr. Gavin Watt ) is in place for the purpose of assisting the Mine
Manager in executing his duties.
. Mr. G. Watt is the holder of National Certificate in Rock Breaking,
Surface Excavations, Surface Mining and Quarrying.
. He is also attended and fulfilled the requirements for the programme
in Blasting Engineering at University of Pretoria.

. Legal Appointment in terms of Regulation 4-4{1) (Blaste. - Mr-


Hercules Johannes Coetzee) to ensure that blasting activities are
carried as per the applicable health and safety standards and
procedures is also ln place as required.

Blast Evacuation Procedure

. Blasting evacuation procedure is in place.


. Records are kept and made available at the mine as required'

Structure for engagements with the community.

. Structure for the above-mentioned purpose is in place.


. At regular intervals community get to be engaged by the mine to keep
them abreast of mining activities
. ln trying to under what the really issues are between Fairview
community and the mine - below was reported:
. The complaint emanated from fair view community.
. Fairview community is one of the .... Communities arouid the mine.

. 9!hgr communities are, Traditional Counciiliommitteel U,r,sinsir\


lzinkanyezi, Amanyoswa, Echebini, Fairview and Landowriers.
. ln engagement meeting with all communities or parties involved
around the mine, Fairview is reported to have extracted themselves
from participating.
. Umsinsin is the closest to where the blasts are carried out by the
mine,
. Fairview community is 1.5 kilometres from blasting area.

Previous Engagements

. Records (i.e,, registers, minutes, etc.) of engagements with relevant


communities are in place as required.

4 TLO - Transport Load Out Area

. Traflic management system for the mine as noted under item 1 of this
report, it's enforcement found lacking in that:
- TMM COP ltem 8.'16.2 found not being adhered to (pedestrians
working as spotters found to be interacting with operating FEL in
the TLO area.
