FACTS:
Whether Mortigas had unlawfully entered serra’s property and whether serra was
entitled to remedies for the alleged tresspass.

ISSUE:
1. Did mortigas unlawfully enter and occupy serra’s land.
2. Is serra entitled to damages or any form of legal remedy for the encroachment.

CRIMES:
Vicente Serra filed a complaint against Isidro Mortigas, accusing him of the crime of
libel. Serra claimed that Mortigas had written and published defamatory statements
about him, which damaged his reputation.

RULE:
1.The Supreme Court ruled in favor of serra.
2. The Court found sufficient evidence that mortigas had encroached on Serra’s
property. As a result, Serra was entitled to legal remedies, including damages for the
unlawful occupation of his land.
