INTRODUCTION

We find ourselves in a different time full of challenges that requires constant


preparation to face the new demands of everyday life. Faced with these demands of
the new century, we are forced to improve adequate writing for the preparation of
different documents that are necessary when demanding rights and/or services.

This work contains information for the appropriate writing of the application or types of
application that one wishes to present to a public or private entity. Its purpose is to
contribute and improve the proper preparation of applications through schematic
application models, varied examples and different concepts extracted from various
bibliographic sources.

It presents a coherent thread on the concepts, parts, structure, types and application
models that are presented in certain administrative and/or legal circumstances for
personal and collective benefit. The fundamental contents deal with the parts of the
application and its constituent elements of the fundamental aspects, examples and
special annexes abound.

THE GROUP

CHAPTER I

APPLICATION

1.1 Etymology

It derives from the Latin sollicitudo (diligence or careful instance). Memorial in


which something is requested.

The request is understood as a type of request or claim for something, whether


economic, labor, material or immaterial.

It is then understood that a request is that document that is sent to a public body, a
company or an authority, in whose body a favor is requested or a claim is also
made, always presenting the causes on which these requests are based.

1.2 Concept

“The request is a written document that is addressed by any person to another


person who holds a position, a public or private function, to request something
that, by right or by grace, he or she expects to receive” (Soto, 1996:23).

For Ortiz Dueñas (1967:196), the request is a document addressed to official


institutions, in which the appellant makes a request, that is, it is a document or
resource through which one addresses superiority, asking or managing for the
laws and regulations.
Also called instance; A request is a written document that is addressed to a public
body or authority from which something is requested or to which a claim is made
with an explanation of the reasons on which it is based. (Gutiérrez 2009:162)

The right of Peruvians to petition is protected by Art. 2nd inc. 20 of the current
Political Constitution which states that every person has the right to “formulate
requests, individually or collectively, in writing before the competent authority,
which is obliged to give the interested party a response also in writing within the
legal period, under responsibility. Members of the armed forces and the national
police can only individually exercise the right to petition” (Valladares, Otto,
1997:74-75)

The application is written on A4 paper, handwritten or typed, and is used in both


public and private administration. Generally, the text of the application takes up
only one page; However, there may be larger requests that require an additional
page. Previously, the application was written on sealed paper. On the other hand,

there are public and private entities that use printed sheets or valued papers for
requests addressed to them.

1.3 Function .

“The specific function is to request or manage some personal benefit, supporting


the motives or reasons that determine it” (Cibelar 6eddiciones, 2011:7).

To satisfactorily achieve said request, it is recommended that the request be


submitted within its due time, so that it is not rejected as untimely.

1.4 People involved

The request establishes a relationship between the applicant or applicants and the
authority to whom it is addressed, which is the recipient. (Soto 1996:35)

Are two:

A. The Sender is also called recurring . It is any person who has to ask or request
something, doing so as a natural person, with individual rights and
responsibilities, regardless of the position they could hold in the institution or
outside of it.

B. The Recipient is a person who holds a specific position, heads and represents
a public or private institution or a main part of it. A Ministry, a Director of the
Ministry or of an educational institution, a Dean of Faculty, a Rector of a
University, etc., may be recipients of a request.

1.5 Application submission

The request begins in the process of a non-contentious action. It can be delivered


personally by the interested party, through another person or sent via fax or by
mail, in the latter case, as “certified correspondence.”

The request can be submitted by any member of an institution, and even by a


person outside of it, depending on the nature of the request.

Anyone who is not a member of an institution submits their request through the
“parties table” and its server can do so through the “parties table” or through his or
her immediate boss. If the latter is the channel, the boss processes the request
through a document, “procedure sheet” or other document, with his favorable or
unfavorable opinion.

Every application must be submitted with at least one copy, which must be sealed,
signed and numbered by the person receiving the original. This copy is the only
proof of the submission of the application and remains in the possession of the
applicant to make any claim if attention is lost or delayed .

When sent by mail, it must be deposited before the expiration of the deadline
established for its submission. If the application reaches its destination after the
deadline set for its delivery, it will be taken into account as if it had been submitted
on the date of its deposit in the mail, which is proven with the respective proof of
receipt of the mail or its certification.

Sometimes the request is presented accompanied by the requirements demanded


by the institutions, to process or meet the request we make. For example, when
requesting a certificate of studies, you must attach the receipt of the payment that
has been made for that concept. These requirements may be certificates,
certificates, receipts, photographs, files, sworn statements, curriculum vitae of the
interested party, etc. The documents that accompany the application must be
presented properly organized (in the order in which they are required), numbered
and stapled, or placed in a folder so that they are not lost or confused.

If, in the course of processing the application, it is noted that the applicant has not
complied with all the requirements necessary to respond to his or her request, the
authority may notify him or her, ex officio, so that the omission can be corrected
within a reasonable period of time. (In accordance with article 46 of the single
ordered text of the Law of General Standards of Administrative Procedures).

2.1. AUTHORITY TO SIGN APPLICATIONS


This faculty is available to any capable natural person over 18 years of age.
Likewise, the legal representatives on behalf of those they represent.
Minors under 18 years of age exercise their right to request through their parents;
except that some institutions allow it to be exercised in certain cases, such as
schools so that they request their study certificates upon completing their
secondary education.

CLASSIFICATION OF THE APPLICATION

3.1. CLASSES :
We know two types of requests (individual request and collective request).

3.1.1 Individual Application:

 Applications:
It serves to manage the attention of a right individually, even if an administrative
measure affects two or more people equally, each person must submit their
request separately.

 Drafting of the Sumilla :

The summary summarizes what you ask for through the request. It is the
“subject” of the other documents. “Its use is of utmost importance, because it
facilitates the classification of the request and guides its treatment (The
summary: directs the matter on the right track, discussion of the request).”

It is worth emphasizing that every request, like any other administrative


document, must develop only one issue, or must contain only one request; or
two, if these are closely linked to each other. (Valladares, 1997).

Observations:

a. The summary includes the word “request” or the word “request” and the
mention of the right being invoked. The sumilla is written in the first or third
person singular.

Example:

 I request a certificate of studies.


 I request a license.

b. It is located in the upper right part of the first sheet of paper. Your writing
should not exceed two lines; It should be short, concise, “telegram-like.”
c. The summary is written in different ways, looking for ways to make it stand
out.

d. Strictly speaking, after the words “request” or “request” it is not appropriate to


place a colon, because they do not lead a list or textual quote; However, the
widespread use of the colon after the indicated terms could be justified by
analogy with the wording of the “subject” in the other documents. Therefore,
we leave the use or omission of the colon after these words to the discretion
of the editor.

“The summary is important because in many things it prevents reading the


entire content of the application.”

 Recipient's Wording :

The request must be addressed to the highest representative authority of an


institution, regardless of the request made. However, there are organizations
and companies that, through the application of decentralization and
deconcentration of powers policies, allow the request (especially its members)
to be directed directly to the person responsible for attending to what is
requested. For example, the National University of Engineering allows you to

direct the request for a study certificate directly to the dean of faculty; Just as
there are companies that allow you to request a work certificate directly from the
personnel manager.

Observations:

i. The treatment and position of the authority receiving the request are written
in all capital letters:

elements concludes with a courtesy phrase followed by a colon. For example:

b) The names and surnames, as far as possible, should be ordered as follows: first the
surnames (paternal and maternal) and then the names, separating the surnames
from the names by means of a comma; like this: PÉREZ LÓPEZ, Cristian Eduardo .
This arrangement offers two advantages:

1) Facilitates quick and immediate location or alphabetical classification of the


applicant.
2) Avoid confusion that could be created by analogous first and last names.

c) Notwithstanding what has been expressed up to this point, the elements of the
exordium may vary according to the circumstances, adapting to the request that is
formulated and taking into account the connection that one has with the center
where one works. For example:

d) The inclusion of the Single Taxpayer Registry (RUC) number in the exordium is
mandatory only when the request deals with commercial, financial, tax or other
purposes.
e) Depending on the case, the application summary may also include nationality,
places of birth, age, marital status, profession or occupation, military record number
or other additional information about the applicant.

f) Finally, as seen in our example, the petitioner's data is separated by commas.

OBSERVATIONS ON THE EXHIBITION OF THE TEXT OF THE APPLICATION

a) The exposition or development of the foundations or reasons that support the


request made through the request begins its writing with the words “That”, “For” or
“To”, for example:

That in order to continue my professional training at another university, I request


that you kindly order the appropriate party to issue my certificate of studies for the
first and second semester completed during the academic year of 2000; For this
purpose, I am attaching herewith the list of the subjects that I passed and the
other requirements.

b) The exposition considers the union of the basis of our request (why) and the
repetition, in detail, of the sumilla, for example: "Because I am in poor health, I
request leave for ten days, with enjoyment, from date; For this purpose, I attach the
corresponding medical certificate endorsed by the IPSS of this city.”

OBSERVATIONS ON THE CONCLUSION OF THE TEXT OF THE APPLICATION

The conclusion of the application text consists of two elements:

a) The phrase “AS EXPOSED” or “THEREFORE”, with capital letters and followed
by a colon.
b) Below it, a “done formula” that reiterates, invokes or summarizes the request,
which is used out of custom or courtesy.

It is used to request attention to a right that is considered of collective interest. It


is called a memorial.

 Characteristics

a) The summary and the text of the memorial are written in the first person
plural:

b) The exordium is elaborated in general terms. For example:

human settlement of “Vista Alegre”, present ourselves before you with
the greatest respect and say:

3.1.3 THE REQUEST IN FORM

Many Private Sector entities, especially financial institutions such as banks and
cooperatives, receive requests from their clients but in forms specially designed for the
purpose of their request. These forms guide the applicant, save time and collect all the

3.1.4 Simplified application as an affidavit

Public Sector institutions, under the Administrative Simplification Law (Law


25035), have been creating a series of simplified documents, with the purpose of
providing facilities to their users and rationalizing resources. So much so that the
simplified application has been created as an affidavit.

This application is a document with a simple structure that gathers only the
information necessary to achieve its objective. It is presented by the interested
party, so that the information provided is subsequently verified and evaluated by
the recipient entity. If the information given is proven to be true, there are no
problems for the applicant; but if it is verified that it is false, it is administratively
and criminally sanctioned.

The simplified application in the form of a sworn declaration, for example, is


accepted in municipalities for the granting of the municipal license to operate
microenterprises and small businesses. With the sole presentation of this
application, on simple A4 size paper, it is considered that said license has been
granted automatically, provisionally, for a period of 12 months, a period in which
the municipality must carry out the corresponding verifications and evaluations to
issue the operating license definitively.

This request contains only the following data:

a) Name of the micro or small business and its address; Also, if you have a
telephone, telefax, facsimile and/or telex.
b) RUC number (Single Taxpayer Registry).
c) Description of the activity you carry out or plan to carry out.
d) Number of workers.

3.2 ADMINISTRATIVE SILENCE AND ATTENTION TO REQUESTS

It is known as “administrative silence” when the authority does not expressly


issue a statement, within the period established by law, on a submitted request.

Administrative silence may be considered in favor of the applicant, called


“positive administrative silence”; or against him, receiving the name “negative
administrative silence.” In the first case, it means that the request submitted by
the interested party has been tacitly approved; and in the second, that it has also
been tacitly denied.

The law allows the existence of positive administrative silence, for example, when
a license, authorization, permit, conception or similar request is requested; and
allows the existence of negative administrative silence, for example, when, upon
expiration of the set period, no resolution has been issued on challenging
appeals presented to the effect that they have been denied.

Administrative silence is applied in the public administration by virtue of the


Administrative Simplification Law.

*CLARIFICATION : People or institutions that consider themselves affected by


the scope of an Administrative Resolution have the right to file challenges against
it, in order to obtain its verification or annulment.

CONCLUSIONS

 The application is a commonly used administrative document, which is used to


manage the attention of a right individually or collectively.

 The parts of the application are well defined and this allows its preparation to be
more practical and simple.

 It is important to know different types of requests since throughout our lives we


will use this instrument to interact and carry out activities in the administrative
environment either to assert our rights or make requests that benefit us.

SUMMARY SHEET: THE APPLICATION. GROUP N° 12

1.1. Etymology: Derived from the Latin sollicitudo (diligence or careful instance).

1.2. Concept: The request is a document written on A4 paper, either handwritten or typed, in which a request or claim
for something is made, presented to the administration, whether in a public or private entity. Generally, your body takes
up only one page; However, there may be larger requests that require an additional page. Previously, the application
was written on sealed paper. On the other hand, there are public and private entities that use printed sheets or valued
papers for requests addressed to them.

1.3 Function : The specific function is to request or manage some personal benefit, supporting the motives or reasons
that determine it.

1.4 People involved:


A. The Sender is also called recurring . It is any person who has to ask or request something, doing so as a natural
person, with individual rights and responsibilities, regardless of the position they could hold in the institution or
outside of it.
B. The Recipient: It is a person who holds a specific position, heads and represents a public or private institution.
1.5 Submission of application: The application begins in the process of a non-contentious action. It can be delivered
personally by the interested party, through another person or sent via fax or by mail, in the latter case, as “certified
correspondence.”

Anyone who is not a member of an institution submits their request through the “parties table” and its server can do so
through the “parties table” or through his or her immediate boss. If the latter is the channel, the boss processes the
request through a document, “procedure sheet” or other document, with his favorable or unfavorable opinion.

Every application must be submitted with at least one copy, which must be sealed, signed and numbered by the person
receiving the original. Sometimes the request is presented accompanied by the requirements demanded by the
institutions, to process or meet the request we make.

When sent by mail, it must be deposited before the expiration of the deadline established for its submission. If the
application reaches its destination after the deadline, it will be taken into account as if it had been submitted on the date
of deposit in the mail.

If, in the course of processing the application, it is noted that the applicant has not complied with all the requirements
necessary to respond to his or her request, the authority may notify him or her, ex officio, so that the omission can be
corrected within a reasonable period of time.

2.1. Power to sign applications: This power is available to any natural person over 18 years of age. Likewise, the legal
representatives on behalf of those they represent.

Minors under 18 years of age exercise their right to request through their parents; except that some institutions allow it
to be exercised in certain cases, such as schools so that they request their study certificates upon completing their
secondary education.
2.2. Parts : The parts of the application must be organized and structured in a certain way. It is the connection of the
different phrases with each other, whose function ensures the interpretation of each phrase in relation to the others and
the overall meaning of the text:

3.1. Classes : We know two types of requests (individual request and collective request).
3.1.1. Individual Application
It serves to manage the attention of a right individually, even if an administrative measure affects two or more people
equally, each person must submit their request separately.
 Writing the Summary : The summary summarizes what you ask for through the application. It is the “subject” of the
other documents. “Its use is of utmost importance, because it facilitates the classification of the request and guides
its treatment (The summary: directs the matter on the right track, discussion of the request).”
It is located in the upper right part of the first sheet of paper. Your writing should not exceed two lines; It should be
short, concise, “telegram-like.”
 Wording of the Recipient : The request must be addressed to the highest representative authority of an institution,
regardless of the request made.
The treatment and position of the authority receiving the request are written in all capital letters.
 Writing the Text: The text of the application consists of three sections:
a) Exordium: That particularizes the applicant.
The exordium includes the following elements: names and surnames of the applicant, their identity document
(DNI) and their address. The mention of these elements concludes with a courtesy phrase followed by a colon.
b) Exposition: That develops the foundations or reasons that support the request that is made.
The exposition or development of the foundations or reasons that support the request made through the request
begins its writing with the words “That”, “For” or “To”.
c) Conclusion: Which ends by invoking or reiterating what was requested.
The phrase “AS EXPOSED” or “THEREFORE”, with capital letters and followed by a colon.
Below it, a “done formula” that reiterates, invokes or summarizes the request, which is used out of custom or
courtesy.
3.1.2 COLLECTIVE APPLICATION (memorial)
It is used to request attention to a right that is considered of collective interest.
 Characteristics:
a) The summary and the text of the memorial are written in the first person plural: “We request installation of drinking
water.”
b) The exordium is elaborated in general terms:

3.1.3 THE APPLICATION IN FORM

Many Private Sector entities, especially financial institutions such as banks


and cooperatives, receive requests from their clients but in forms specially
designed for the purpose of their request. These forms guide the applicant,
save time and collect all the information that will be necessary. to respond to
the request.

3.1.4 SIMPLIFIED REQUEST AS AN AFFIDAVIT


This application is a document with a simple structure that gathers only the
information necessary to achieve its objective. It is presented by the
interested party, so that the information provided is subsequently verified
and evaluated by the recipient entity.
If the information given is proven to be true, there are no problems for the
applicant; but if it is verified that it is false, it is administratively and criminally sanctioned.
