Plaintiff-Appellant Rahul Dev Manchanda respectfully submits this Reply
Affirmation in Opposition to Defendant-Appellee New York State Attorney General
in their letter motion to deny the motion CA2 ECF No 60 to disaffirm (attached).
As a preliminary matter, in this case we also allege (attached) that federal
Defendant-Appellee FBI NYC Field Office worked closely with state Defendant-
Appellees to entrap, commit intentional torts and crimes, and other acts prohibited by
the Federal Tort Claims Act ("FTCA") in order to manufacture a disciplinary case
against Plaintiff-Appellant, and this demonstrates the requisite "bad faith, harassment,
or some other extraordinary circumstance that would make abstention inappropriate."
Plaintiff-Appellant has more than shown that the disciplinary charges against
him are frivolous and fraudulent (see attached) in order to overcome Younger v
Harris.

A handful of powerful businessmen pushed New York City Mayor Eric

Adams to use police to crack down on pro-Palestinian student
protesters at Columbia University, donating to the politician and
offering to pay for private investigators to help break up the
demonstrations, the Washington Post has reported, based on leaked
WhatsApp conversations.

The story, published on Thursday, says that several billionaires

seeking to influence public perception of Israel's war in Gaza
discussed means of pushing the mayor and the university's president
to end the protests, which were eventually cleared last month amid
criticism of the police's heavy-handed response.
"One member of the WhatsApp chat group told The Post he donated
$2,100, the maximum legal limit, to Adams that month," the story
reads.
"Some members also offered to pay for private investigators to assist

New York police in handling the protests, the chat log shows - an
offer a member of the group reported in the chat that Adams
accepted." The story states that city authorities denied that private
investigators were used to help manage the protests.
The report comes as universities across the country continue to

employ force against pro-Palestine activism, raising concerns over
the repression of political expression. A number of universities have
successfully negotiated with student encampments, which have
called for divestment from companies involved in Israel's war in Gaza
and boycotts of Israeli institutions.

The WhatsApp chat cited by the Washington Post included

prominent businessmen such as former CEO of Starbucks Howard
Schultz, Dell founder and CEO Michael Dell, hedge fund manager Bill
Ackman and Joshua Kushner, brother of former President Donald
Trump's son-in-law and adviser on Middle East issues, Jared Kushner.
Other leaders, such as snack company founder Daniel Lubetzky,

hedge fund manager Daniel Loeb, billionaire Len Blavatnik and real
estate investor Joseph Sitt also said that they held a video meeting
with Mayor Adams on April 26.
Sending in the police has done little to dampen the spirits of pro-
Palestine protesters, and in some cases, has led to heightened
support from faculty and fellow students.
While supporters of the crackdowns say they are necessary to ensure

the safety of Jewish students, some of whom say they have felt
discomforted by anti-Israel rhetoric at the protests, pro-Palestine
students - many of them Jewish - have faced the brunt of the
violence at protests across the country, with few expressions of
concern from authorities.

Earlier this week, a union representing about 48,000 graduate

student workers in California, authorised a strike over the treatment
of student protesters at universities such as the University of
California at Los Angeles (UCLA), where a pro-Israel mob attacked a
pro-Palestine encampment with metal pipes and mace while police
stood by. Several pro-Palestine activists were hospitalised.
The following day, police moved in to clear the pro-Palestine

encampment.

• T he number of NYPD cops on the job this year and last is the
lowest it's been in more than three decades - with about 200
cops leaving each month, according to data obtained by The Post.
The current NYPD headcount is 33,695, just 154 more than last year
- and the lowest since 32,451 in 1990, stats from the department
and city Independent Budget Office show.
The problem is getting worse as retirements this year have surged

11%.

RE: Letter Demand For Recusal
Chief Justice Dianne Renwick:
In accordance with the attached, we are hereby requesting your formal
Recusal as Chief Justice on this case.
As stated in the attached, I filed legitimate government complaints with
federal, state, and local law enforcement and government agencies against
organized African-American bias, discrimination, racism, sexism, and
prejudice within the legal and judicial system of New York City against
undersigned because I am Indian American, as well as bona fide civil
rights lawsuits for the same reason in the state and federal courts (as
well as with the forum NYSDHR), and in retaliation, you, New York Supreme
Court Appellate Division First Department Chief Justice Dianne Renwick
(African-American female judge) are openly, blatantly, flagrantly,
retaliating against me in our court case 1336.2021 arbitrarily and
capriciously.
Because I filed civil rights lawsuits in New York state and federal
court, as well as formal government complaints with local, state, and
federal law enforcement and regulatory agencies alleging discrimination
by African-American judges, law clerks, magistrates, law enforcement
officers, and others, I was retaliated against by the Attorney Grievance
Committee First Department and the New York County Supreme Court
Appellate Division First Department by predominantly African-American
leaders of those institutions in order to suspend, disbar, or otherwise
take away my law license for daring to complain, even after these people
responsible took my children away from me and forced me to pay 1000% of
the federally mandated child support standards act for kids, that I have
not even seen or spoken to in 7 years.

I filed legitimate government complaints with federal, state, and local law enforcement and government agencies
against organized African-American bias, discrimination, racism, sexism, and prejudice within the legal and judicial
system of New York City against undersigned because I am Indian American, as well as bona fide civil rights lawsuits
for the same reason in the state and federal courts (as well as with this forum NYSDHR), and in retaliation, New York
Supreme Court Appellate Division First Department Chief Justice Dianne Renwick (African-American female judge) is
openly, blatantly, flagrantly, retaliating against me in our court case 1336.2021 arbitrarily and capriciously. Please
urgently investigate and advise.

Because I filed civil rights lawsuits in New York state and federal court, as well as formal government complaints with
local, state, and federal law enforcement and regulatory agencies alleging discrimination by African-American judges,
law clerks, magistrates, law enforcement officers, and others, I was retaliated against by the Attorney Grievance
Committee First Department and the New York County Supreme Court Appellate Division First Department by
predominantly African-American leaders of those institutions in order to suspend, disbar, or otherwise take away my law
license for daring to complain, even after these people responsible took my children away from me and forced me to pay
1000% of the federally mandated child support standards act for kids, that I have not even seen in 7 years.

What is the with NYS Supreme Court, Appellate Division, First Department Presiding Judge
Dianne Renwick, an African-American Uncle Tom who will not even allow me to file an APPEAL (or
even a letter requesting to file an appeal, attached and below) when ADR Justice (Retired) Rosalyn
Richter, even when there is absolutely no proof or evidence that any of opposing counsel AGC Staff
Attorney Remi Shea can attribute to me the various pleadings, book chapters, anonymous website
posts, and op-eds that she finds so offensive, rather than my paid attorneys, of counsels, associates,
search engine optimization/online reputation management contractors, and per diem law firms that
she finds so offensive to her sisters' ultra extreme feminist, "Karen" white racist hatred of me and my
conservative value systems/political beliefs, which clash with hers (and by proxy, Dianne Renwick and
Rosalyn Richter's)?
Please immediately intervene in this extremist, feminist, lesbian, left-wing, communist kangaroo
court, where they are crucifying me, robbing me of my license to practice law, simply because I have
conservative, christian, catholic value systems, and am a republican politically opinionated attorney,
practicing successfully for 22 years in my own law firm in Manhattan, New York City?

Respondent Rahul Manchanda, under penalty of perjury, affirms the
following:
Preliminary Statement
1. Pursuant to § 1240. 8 (b) (1), the Referee has not found, by a fair
preponderance of the evidence, each essential element of the
charges.
2. Therefore, further to § 1240. 8 (b) (1), undersigned Respondent
hereby makes such motion to disaffirm the referee's ruling as
permitted by the Court.
Rebuttal
3. Literally, not even one of the frivolous, fraudulent ~charges"
that Attorney Grievance Committee First Department Staff
Attorney Remi Shea has lodged against me, can even be
attributable to me.
4. Each and every single piece of her fabricated and sullied

"evidence," "witnesses," and "testimony" only confirm and
underscore the hollow nature of her allegations, and betray the
real reason that she has launched her crusade against me and my
successful law practice of more than 22 years - politics and
value systems.
5. Remi Shea has couched and abused her power and position under
color of law and authority in order to drive out of law practice
someone whom she disagrees with politically, culturally, and
with regards to value systems.
6. This became more and more evident as she, while the case
progressed and she began to lose every argument, which were
blunted and repelled on each piece of her "exhibits" evidence,
and even had her own in-court and out-of-court witnesses support
my position of innocence, even where she broke the laws and
rules and desperately began to last-minute insert even more
"evidence" and "witnesses" to offset and buffer her failing
case, all approved and granted by the presiding Justice Rosalyn
Richter in her "discretion," of course.
7. Specifically, every single piece of garbage inadmissible
"evidence," without even one exception, spanning my 22 year old
legal career as a law firm small business owner and employer of
hundreds of employees, was either written, drafted, or counseled
by someone else.
8. Those people were named by Respondent, and Remi Shea either
called them in to testify, or they refused to come to court out
of fear.
9. Similarly, any and all legal pleadings that Remi Shea
introduced, were either written, drafted, counseled, or prepared
by someone else, and this was proven when even her own last-
minute witnesses testified under oath to that effect, thus again
upending her arguments that Respondent did these pleadings all
by himself.
10. Even if offering a legal defense or offense within the protected
realm of local, state, and federal court proceedings, or filing
legitimate complaints of bias and discrimination to regulatory
and law enforcement agencies, or writing first amendment
protected books and op-eds, or responding naturally to crime,
was somehow "unethical," which of course they are not, the only
thing that was unethical, was for Remi Shea to charge Respondent
with ethical violations for the legal work, pleadings, wording,
arguments, and verbiage of third parties and hired lawyers who
counseled Respondent, sometimes even when Respondent admonished
them in writing or filed formal complaints to her own Grievance
Committee when, and if, they went against his wishes, will, or
instructions, and did their thing anyway, without either
Respondent's knowledge or permission, often using his name or
signature stamp without his knowledge or permission.

11. This was also proven in court, with Remi Shea's own witnesses
and exhibits against Respondent, such as Luis Ricardo Trujillo
(see the transcripts), who eventually testified in support of
Respondent.
12. But for some reason, Respondent's own multiple complaints to the
Committee and other agencies went unanswered, unprosecuted, or
unheard, only instead, those complaint targets were routinely
given "immunity" from their own misconduct in order to offer
testimony against me, the Respondent, such as Luis Ricardo
Trujillo, and countless other criminals.
13. The question is, who was making those decisions?
14. Which brings up another point, Remi Shea's constant use of
violent, threatening, harassing, intimidating criminals and
agent provocateurs as her "witnesses" against Respondent, simply
to punish Respondent for his natural and biological responses to
violent crime.
15. This does not even begin to address the fact that Respondent
hired third party Online Reputation Management ("ORM") and
Search Engine Optimization ("SEO") professionals, who were also
named, who routinely answered and responded to the constant,
cowardly, anonymous, criminal cyber attacks, cyber terrorism,
and cyber harassment of online Google Reviews and other gripe

websites, and whose behavior was often reported and complained
about to FBI IC3, the NYPD, and other cyber complaint agencies
if they went too far in terms of law and ethics, and were
quickly either removed, or edited, to comport with law and
ethics, as per the nearly 22 years of legal ethics and
professional responsibility lawyers that Respondent has paid
and/or hired, also named in these proceedings by Respondent,
whom Remi Shea for some reason could not get any of them to
testify against me, or on her behalf, ethics professional
luminaries such as Richard Maltz former assistant chief of the
attorney disciplinary committee first department, Hal Lieberman
also a former chief of the attorney disciplinary committee first
department, Lew Tesser, Michael Ross, Kelly Mccollum, Pery
Krinsky, David Lewis, Richard Grayson, and her own fellow
Committee members Jeremy Garber, Normal Lopez, Joel Peterson,
Elizabeth Palladino, Devika Kewalramani, and scores of other
nameless and faceless grievance committee first department staff
members who manned their ethics hotlines and phone call
inquiries.
16. Same for Respondent's books and online op-eds, which were all
mainly intellectual academic exercises in First Amendment
freedom of speech, political opinions, value systems, cultural
and religious commentary, and other personal and protected
opinions, not offensive to anyone not having a thin skin and
thick skull, unlike Staff Attorney Remi Shea and her backers.
1 7. Respondent had also discussed at length, providing names of
people that had altered a few of Respondent's book and op-ed
articles without his knowledge, permission, or authorization
before they went to publication, such as Nicole Matties, Joe
Hendrix, Andre De Castro, Nicola Shapiro, and Douglas Senderoff.
18. True, some of Respondent's paid lawyers, senior managing
attorneys, and of counsel's legal arguments and pleadings in the
courts over the past few years have been legally and equitably
progressive, or even controversial, but as Guy Fawkes once said,
~a desperate disease, sometimes requires a desperate remedy."
19. Without this type of aggressive creative lawyering, much of
which has taken place in New York City, women would not have the
right to vote, African slavery would still be legal, and
homosexuals would not have the right to marry.
20. By being relatively passive and docile in the courts for the
vast majority of Respondent's legal career as both lawyer and
litigant, he has lost more than could possibly even be imagined
- losing one's children, business, reputation, and family, have
driven more people than can be counted, to destruction, but
Respondent persevered, became stronger, and survived the pain
including a heart attack at age 47, high blood pressure,
clinical anxiety, diabetes, and other physical health problems
brought on by the retaliatory stress of this Committee, judges

and law clerks, and others.
21. But through it all, Respondent carefully hired, retained, and
was counseled by a multitude of lawyers and Of Counsel, who
guided him on each and every legal and equitable step, most
often taking the reigns of legal analysis, research, writing,
drafting, presenting, and arguing to the courts themselves - all
of them again, being named in these proceedings, and invited to
testify.
22. Lawyers such as Anthony Motta, Robert Androsiglio, Dominic
Sarna, Luis Trujillo, Mawash Jaffery, Marcus Nussbaum, Elliot
Schlissel, Paul Carty, John Fazzio, Adam Edelstein, Todd Spodek,
Kelly Mccollum, Michael Ross, Pery Krinsky, David Koch, Samson
Freundlich, and countless others from per diem companies, online
attorney matching services, all of whom were specifically named
as the authors, preparers, and signatories of the pleadings that
Remi Shea seeks to punish and charge Respondent for.
23. Indeed, the only witnesses that Remi Shea managed to bring in to
the Committee to "testify against Respondent," Luis Ricardo
Trujillo (Latin American), Paul Carty (African American), and
Elliot Schlissel (German Jewish American), only confirmed with
Remi Shea's own last-minute, controversial pleadings exhibits,
that yes, they were either authors or assisters of.

24. So how again, has Respondent been either "anti-semitic" or
"racist," when the actual architects, drafters, writers,
lawyers, and presenters were from the actual
racial/ethnic/religious/sexual groups that Remi Shea accuses
Respondent of disrespecting in his government complaints, or
civil rights lawsuits?
25. Such was the case, with all of Remi Shea's "witnesses,"
"exhibits," and "testimony," which only underscored her own
culpability as an unethical prosecutor, who should not only be
removed from her job, but also imprisoned by the New York State
Commission on Prosecutorial Misconduct, and other law
enforcement agencies.
26. Dismissal of this case, and all of Remi Shea's frivolous and
fraudulent charges, is simply not enough to compensate
Respondent Rahul Manchanda for the 5 year rape of his finances,
reputation, law firm, family, employees, and physical health.
27. Respondent demands something more, in terms of remedies both
legal and equitable, from Staff Attorney Remi Shea and the
Attorney Grievance Committee First Department.
28. Such relief and remedy is hereby and herein requested from this
presiding Appellate Division, First Department, Supreme Court,
County of New York, located at 27 Madison Avenue, New York NY

10010.
Conclusion
WHEREFORE, it is respectfully requested that this Court:
(a) reject AGC's improper, unethical and illegal Petition of Charges

in whole and entirety;
(b) dismiss AGC's improper, unethical and illegal Petition of Charges

in whole and entirety;
(c)award attorneys fees, costs, and sanctions against AGC pursuant to

Rule 130-1.1 for her frivolous, vexatious, and harassing litigation
in retaliation for Respondent's protected legal rights to file
government complaints against bias and discrimination in the judiciary
and legal system, first amendment protected books and op-eds, normal
reactions to violent crime, and acknowledgment that each and every
single "exhibit" introduced by Remi Shea was the work of someone else;
(d) grant an Order barring AGC from filing another frivolous

lawsuit/motion in this Court or any other forum without prior court
written approval pursuant to Rule 130-1.1,
(e) such other further relief as this Honorable Court deems fair and
equitable under the circumstances.

that the Committee has established a basis to proceed to an inquiry on sanction on all charges
except Charge Six, which relates to the posting of anonymous complaints. I conclude that the
Committee has failed to meet its burden of proof on that particular charge.
As set forth on the record on May 29, the Committee shall submit any documentary evidence
relating to aggravating factors and penalty no later than close of business June 3.
Respondent shall submit any evidence he has relating to any defense or mitigating factor, as
well as any response to the Committee's submission on aggravating factors, by close of business
June 5. If Respondent is submitting any character evidence or statements from others in
mitigation or as a defense and these individuals are not lawyers, their statements need not be
notarized under current NY law so long as they contain the required language indicating that
the signatory is making such statement with knowledge of the penalty of perjury.
There will be no reply by the AGC to Respondent's June 5 submissions.
Respondent and the AGC also were advised on the record on May 29 that to the extent
Respondent already has raised arguments in opening, testimony, and summation, that relate to
defenses and mitigation, I will consider those in making my recommendation to the Court on
sanction.
The procedure for correcting the transcript from the second day of testimony will be the same
as it was for the first date and this was discussed on the record on May 29. Once the full
corrected transcript is available, the Committee should provide it to me.
Proposed findings of fact should be submitted by the AGC no later than close of business June
21. Respondent's proposed findings of fact shall be submitted no later than July 2.
The parties are advised that I will be unavailable to review transcript correction disputes during
the week of June 24 and therefore any disputes about the testimony at the second day of the

hearing must be brought to my attention by Friday June 14 assuming the Court reporter has
provided the transcript for the second day of testimony by then.
Once the proposed findings and final transcript are submitted to me, a full written report and
recommendation will be prepared by me and submitted to the Court within the time allowed by
the rules.
Respondent has asked about the procedures after that and while I have endeavored to explain it
to him as a courtesy since he is self-represented, at this point if he still has questions he is
directed to the applicable rules, which outline the procedure for making motions to confirm, or
disaffirm, in whole or in part, a referee's full written report once it is issued. Once my final
report and recommendation are issued, such motions are handled by the First Department.

retaliation for undersigned expressing catholic or christian value systems including but niot limited to anti-nine month
abortions, nuclear families, no transgender surgery on children, and against the wholesale slaughter of Palestinian
children by the Israelis, have sought to retaliate against me by removing my law license to practice in New York City as

I have for the past 22 years, and have engaged in actual violations of the United Nations Convention Against Torture
("UNCAT") by forcing me, under threat of "default" to testify and appear in court even when I was suffering from like
threatening and blindness threatening orbital cellulitis, fully diagnosed, being treated, and said medical evidence
submitted to them to temporarily postpone/adjourn their interrogational torture, ie, court proceedings in case 1336.2021.
This is all the while that each of these 2 would routinely last minute "take vacations" to delay the proceedings when I
was ready for court hearings. This is a textbook violation of prohibited INTERROGATIONAL TORTURE for which
these 2 individuals and their agencies should be civilly and criminally investigated and prosecuted by the ICJ and the
ICC at the Hague.

Last night and this morning, I have been once again gripped by mind
screaming migraine pain, from the top and back of my head, all the way across
my left temple, left check, and jawbone with bloodcurdling eye socket pain.
I literally can not keep my eye opened for very long, and I feel nauseous and
prone to faint at any given moment.
The rst diagnosis of this conditi on, Periorbital Celluliti s (attached medical
records), which left untreated can lead to opti c nerve damage and permanent
blindness, occurred a few weeks ago wherein I was treated rst by Urgent
Care, and then by the Emergency Room at Monteore New Rochelle Hospital,
wherein they diagnosed me with Preseptal Celluliti s, a horribly painful
conditi on only treatable by strong anti bioti cs and possibly steroids.
Well, according to the attached photograph, which I just had my wife Sylwia
take, I have once again had a renewal of this painful conditi on, and I must go
for emergency treatment yet again, and will most certainly not be able to
either drive, take a train, or sit for depositi ons/hearings today, or at anyti me in
the near future.
I will of course let you all know what happens with my treatment, and medical
conditi on, and if I will be able to complete our hearings within a reasonable
period of ti me.
But at this ti me, I am out of commission.
Since this is my rst emergency sickness necessitati ng my absence in your

enti re 5 year politi cal targeti ng and witch hunt of me since 2019, I think that
you can temporarily forgive my absence.

Last night and this morning, I have been once again gripped by mind
screaming migraine pain, from the top and back of my head, all the way
across my left temple, left check, and jawbone with bloodcurdling eye
socket pain.
I literally can not keep my eye opened for very long, and I feel nauseous and
prone to faint at any given moment.
The rst diagnosis of this conditi on, Periorbital Celluliti s (attached medical
records), which left untreated can lead to opti c nerve damage and
permanent blindness, occurred a few weeks ago wherein I was treated rst
by Urgent Care, and then by the Emergency Room at Monteore New
Rochelle Hospital, wherein they diagnosed me with Preseptal Celluliti s, a
horribly painful conditi on only treatable by strong anti bioti cs and possibly
steroids.
Well, according to the attached photograph, which I just had my wife Sylwia
take, I have once again had a renewal of this painful conditi on, and I must
go for emergency treatment yet again, and will most certainly not be able to
either drive, take a train, or sit for depositi ons/hearings today, or at anyti me
in the near future.

I will of course let you all know what happens with my treatment, and
medical conditi on, and if I will be able to complete our hearings within a
reasonable period of ti me.
But at this ti me, I am out of commission.

you can temporarily forgive my absence.
