TERMS OF REFERENCE FOR HIRING AN ADVISOR

EXTERNAL LEGAL FOR THE DISTRICT MUNICIPALITY OF YANATILE

1. OFFICE OR AREA THAT REQUIRES IT


GENERAL SECRETARY.
2. - PURPOSE OF THE SERVICE:

The main objective is to have legal advisory services, to provide professional services,
in favor of THE MUNICIPALITY, as well as provide advice, assistance, analysis and
interpretation of legal norms, policies and procedures, as external Legal Advisor of the
District Municipality of Yanatile in all specifically required cases.

3. - SERVICE FEATURES:

 Carry out legal tasks that are strictly related to the actions of Legal Advice and legal
assistance to municipal officials when required.
 Participate in meetings with natural or legal persons and in Council Sessions, when
required.
 Provide Legal Technical support to the Mayor's Office and Municipal Management.
 Respond to legal queries from the Mayor's Office, Municipal Management and the
Municipal Council.
 Support and answer queries to Managers, Sub-Managers, Divisions, Offices and the
different Areas of the District Municipality of Yanatile.
 Support and provide legal support in administrative or other procedures to the
Legal Advisory and General Secretary office.
 Issue opinions and legal reports.
 Mandatory attendance at the Municipal Palace for at least 2 (TWO) days a
week.
 Assume the defense of the Mayor, Councilors, officials and/or servants of the
Municipality in criminal complaints filed against them as a result of the exercise of
functions derived from the position.
 Visation in the agreements of the Municipal Council, resolutions of the Mayor's
Office and Municipal Management.
 Other functions assigned, inherent to the position.

4.- PRODUCT TO OBTAIN:

Legal advice specialized in legal matters.

5. -MINIMUM REQUIREMENTS THAT THE CONTRACTOR MUST MEET:

a) Vocational training:

 Professional Title of Lawyer


 Training courses received related to your specialty. Knowledge of Municipal
Management Standards and Policies.
 Knowledge of the Peruvian State Contracting Standards. Courses and/or
Diplomas in various legal subjects.

b) Professional experience:

 Minimum professional experience of five (05) years.


 Specialized professional experience in public administration, minimum of five
(05) years, directly related to legal advice to municipalities.

c) Other requirements:

 Be proactive and able to work in multidisciplinary teams


 Availability to work under the terms stipulated in the professional services contract.
 Not be prevented from contracting with the Peruvian State.
 Current professional qualification by the Bar Association.

6.- SERVICE TERM:

The service will last 04 months, during the year 2019.


7.- PLACE OF EXECUTION OF THE SERVICE
It will be at the facilities of the District Municipality of Yanatile.

8. - RECRUITMENT SYSTEM:
Lump Sum

9.-MINIMUM SERVICE WARRANTY


Not applicable

10.-Payment Method
The payment method for professional fees will be partial payment on a monthly basis.

11.-CONFORMITY OF THE SERVICE


The service conformity will be through the General Secretary, after presentation of the
monthly report.

12.- OTHER CONDITIONS


The Municipality is obliged to pay corresponding travel expenses for the time spent in
the Legal Technical advice on behalf of the District Municipality of Yanatile, on service
commission trips that require its attention.
