MEMORANDUM OF UNDERTAKING AND UNDERSTANDING

This Deed of Memorandum of Undertaking and Understanding


is made and executed on this day of May, 2024 by:

Sri Alampally Pandu S/o. Alampally Ramaiah aged about 49


years, Occ: Agriculture, R/o. H. No.1-10, Enkatala Village, Mominpet
Mandal, Vikarabad District, TS.

(Hereinafter called as “FIRST PARTY” which term shall mean and


include his heirs, administrators, assignees etc. on One Part)

AND

Sri Gunthala Pasha S/o. Raheem, aged about 60 years, Occ:


Agriculture, R/o. H. No. 3-70/b, Enkatala Village, Mominpet Mandal,
Vikarabad District, TS.

(Hereinafter called as “SECOND PARTY” which term shall mean and


include her heirs, administrators, assignees etc. on Other Party)

(HEREINAFTER called the SECOND PARTY)


The FIRST and SECOND PARTY which expression shall mean and
include otherwise repugnant to the context all their/his legal
representatives, successors, administrators, executors, assignees etc., on
their respective parts.

Whereas the First is the absolute lawful owners and possessor of


Agriculture land in Survey No. 294/A/3 admeasuring about Acs. 00.01 Gts
situated at Enkatala Village, Mominpet Mandal, Vikarabad District, TS.
This is more clearly delineated in the Schedule Property.

Whereas Allampally Ramaiah was father of the First Party and


Alampally Sayanna and Alampally Ashok who was the original Pattadhar
and Possessor of 15 Gts in Survey No. 294/A/3, situated at Enkatala
village, Mominpet Mandal, Vikarabad District. The said land is near the
village Enkatala adjoining to the R & B Road leading from Mominpet to
Shankarpally. The said land is herein after called the schedule property.

Whereas the Allampally Ramaiah (Pattadhar) died about 34 years


ago leaving behind his three sons i.e., 1) First Party 2) Alampally Sayanna
and 3) Alampally Ashok and Later Alampally Sayanna died leaving behind
his son A. Venkatesham and two daughters A. Andalu & A. Eshwaramma
who have a right and title over the schedule property. Further later
Allampally Ashok was also died leaving behind one son A. Mahender and
one daughter who have a right and title over the property and since then
they are in peacefull possession.

Whereas the second party is no-way concern with the schedule


property he was interfered to occupy the Schedule of Property in this
Regard the first party and others had filed a suit for perpetual Injunction
against the second party and others Vide O.S. No. 215 of 2020 which is
pending on the file of the Hon’ble Addl Junior Civil Judge At: Vikarabad
after receiving the summons the second party filed a Vakalat and written
statement and thereafter intervention of Village elders and Well wishers
and Friends and Respective Councils and the Second Party admitted that
he has not having any rights and titles and whatsoever over the schedule
property and assured the he will not interfere with the schedule property,
further if the second party will interfere with the Schedule Property the
First Party shall take appropriate legal actions against the Second Party.
SCHEDULE OF PROPERTY

All that the Agriculture land in Survey No. 294/A/3 admeasuring


about Acs. 0.01 Gts situated at Enkatala Village, Mominpet Mandal,
Vikarabad District, TS and bounded by:

NORTH : Land of Alampally Pandu

SOUTH : Alampally Eshwaramma

EAST : Houses

WEST : Alampally Ananthaiah

IN WITNESS WHEREOF both the parties hereto have put their


respective hands unto this Memorandum of Undertaking and
Understanding with their free will and consent in the presence of the
following witnesses on the day, month and year hereinabove mentioned
before the following witnesses:
