Defilement case of sanga phiri.

Sanga phiri,who stays in jack compound ,who sexually abused his niece Alice tembo aged 12years, of the
same residential address.the wife to the acused tina tembo refused that the child was sexually
abused .then the accused denied the act.The Accused further stated that their was no objection against
the evidence presented .The accused further asked the question to the witness .the accused was further
put on defence and further stated that his wife was and is his witness.Evidence was provided by
insepector Funny nyimbiri in prosecution of the accused who committed a very serious offence which is
carnal knowledge with his niece and according to the penal code chapter 87 of the laws of zambia
section 138 Any person who unlawfully and carnally knows any girl under the age of sixteen years is
guilty of a felony and liable to imprisonment for life.

Any person who attempts to have unlawfull carnal knowledge of any girl under the age of sixyeen years
is guilty of a felony and is liable to imprisonment for fourteen years.

Provided that it shall be a suffient defence to any charge under this section if it shall be made to appear
to the court before whom the charge shall be brought that the person so charged had reasonable cause
to believe and did infact believe that the girl was of or above the age of sixteen years.
