One of the objectives of a professional association (ethics


department) is to control ethics within the profession and the
regulation of the correct exercise of it, with the aim of protecting
the community.

It is also the obligation of the Department to know and disciplinaryly judge any
conduct of a member or group of members that threatens or harms the prestige
of the profession, whether due to their professional or social behavior.

For this, the Department has an Ethics Court that is made up of three full
members and at least one alternate, all active Kinesiologists with more than 15
years of membership and never sanctioned by the Order and of recognized
prestige.

The set of moral evaluations that regulate the conduct of members in their
professional actions is the "CODE OF PROFESSIONAL ETHICS OF THE
KINESIOLOGY".
CODE OF ETHICS
KINESIOLOGY PROFESSIONAL
I Preliminary title :

Art. 1º This code will apply to all Kinesiologists who have the status of
associates of the College of Kinesiologists of Chile, in accordance with the
regulations and agreements approved by the General Council.
Art. 2º Only people who hold the corresponding title granted by Universities
recognized by the State may practice the profession of Kinesiologist.

Art. 3º The Kinesiologist is obliged to observe maximum correctness in the


procedures he uses in his professional work.
Art. 4º They are your exclusive responsibility:

a) Apply the maximum of moral integrity, correctness and capacity in all activities
that are within your knowledge as a professional.

b) The Kinesiologist is subject to the legal provisions that regulate the exercise of
his activity and determine his responsibility and the limits of his profession.

c) The Kinesiologist must comply with the obligations and duties imposed by his
profession and the moral principles that all human coexistence requires.

d) The Kinesiologist must maintain, at all times, the highest degree of specific
theoretical-practical knowledge. It will be unethical to care for a patient with duly
proven ignorance or negligence. Misdiagnosis, failure of treatment and any
kinesthetic action are not synonymous with negligence.
e) You must keep in mind, in your actions, that the opinions and reports you issue must be
completely independent, adjusted to the truth and the strictest scientific rigor.

f) The Kinesiologist must refrain from granting inaccurate or incomplete certificates on


matters of his special concern or performance.

g) Professional fees will be charged regardless of treatment results.

h) It is the right of the Kinesiologist to receive fair remuneration or compensation for the
services provided. In the absence of stipulation between the parties, the value of the fee
will be stipulated by the Kinesiologist taking into account the different factors related to the
professional provision, the socioeconomic level of the patient and the prestige and
experience of the professional.

i) Professional agreements concluded between colleagues must be strictly complied with,


even if they have not followed legal and usual formalities.
Title II
Performance of the Kinesiologist before the Public Authorities and Powers.

Art. 5º You must respect the laws and regulations that govern the profession,
without prejudice to your right to fight, through its governing bodies, for their
rectifications or reforms.

Art. 6º In his private or official professional actions, the Kinesiologist must:

a) Observe and strictly comply with the official rules and disciplines of the
institutions in which you provide your services.

b) Share the responsibility, when appropriate, of professionals in adopting the


necessary measures to maintain public health, denouncing those rules or actions
that threaten the patient's integrity or their own.
Title III
Performance of Kinesiologists with their Patients

Art. 7º In relation to his actions with patients, the Kinesiologist must:

a) Treat your patients with humanity and respect.

b) Keep all information entrusted to you confidential, preserving professional


secrecy.

Art. 8º The Kinesiologist is obliged to maintain conduct aimed at avoiding and


mitigating pain, suffering and avoiding death without discrimination of any kind.

Art. 9º The Kinesiologist may not refuse to care for a patient, in case of
emergency duly qualified by a clinical professional, when there is no other
colleague who can take care of the patient.
Art. 10º It is the obligation of the kinesiologist to accept the patient's right to:

• Choosing the kinesiologist.


• Change kinesiologist

Provide all the patient's clinical information.

• Kinesiologist may refuse due to lack of personal or patient safety, either in


technical procedures or when the patient's clinical conditions present a
contraindication.

Art. 11º The Kinesiologist must perform the services that are within his
competence with the intensity, frequency and required number that emerge from
the effective evaluation for his patient, except as expressly prescribed by the
clinician.
Art. 12º It is not within the technical competence of the Kinesiologist to provide a
diagnostic opinion or clinical prognosis to his patient, however he must proceed
with extreme thoroughness in the identification of signs and symptoms,
laboratory or radiological tests that may contribute to a correct interpretation of
these, for their own knowledge or to facilitate the interaction with the
professionals responsible for the clinical management of the patient.

Art. 13º It is the obligation of the Kinesiologist to detect signs or symptoms of new
or greater compromises in the patient's health in the care process of a patient he
or she is responsible for, and to warn the clinical professional of such changes.
Failing that, the patient must be referred to another doctor for consideration.

Art. 14º The Kinesiologist may not instruct technical procedures in the clinical
area, to his patients or family members, when this would mean the substitution or
dispensing of his services.
Art. 15º The Kinesiologist, in the exercise of his clinical
activity, must disregard the personal conditions of the
patient such as his nationality, race, religious, political
beliefs and social status.

Art. 16º The Kinesiologist must refrain from advising or


doing anything that is beyond his professional powers or
exceeds his technical possibilities in relation to his
patients.

Art. 17º The Kinesiologist may only apply therapeutic


methods to those patients who have been referred by a
physician.
Title IV
Performance of the kinesiologist with his colleagues

Art. 18º In major conflicts in which members of the Order are


involved, the Kinesiologist must first resort to the College, without
prejudice to the legal actions that may be initiated between the
parties, in order to seek an extrajudicial and equitable solution. If
the expected agreement is not achieved, the corresponding
summary investigation will continue.

Art. 19º In your relationships with other Kinesiologists you must:

a) Comply with the bases of ethics that govern professional


relationships, mutual respect and natural collaboration between
university professionals and non-interference in another's specialty.
b)Comply with and enforce the provisions of this Code of
Ethics.

c) Refrain from making unfounded and unjustified criticism


of your colleagues.

d) Do not cause difficulties or take steps to obtain the


termination of the services you are providing, with
interventions aimed at discrediting you or obtaining your
displacement.
e) Do not associate with those who illegally practice the profession of
Kinesiologist.

f) Ensure that an atmosphere of cordiality and mutual respect is maintained


within the institutions that bring together Kinesiologists.

Art. 20º When the patient decides to change the treating Kinesiologist, the
professional who assumes this responsibility must be concerned that the patient
has fulfilled all obligations with the colleague who preceded him in said services.

Art. 21º When the Kinesiologist performs in hierarchical functions, he must


adhere to the ethical and technical standards to select, qualify and determine
promotion of his colleagues.

Art. 22º The Kinesiologist must collaborate with the training of his colleagues,
and should not reserve knowledge or useful techniques in Kinesiology.
Title V
Performance of the Kinesiologist with his Professional Association

Art. 23º The registered Kinesiologist must comply with the duties established by
the Statute and actively participate in the tasks that he voluntarily assumes.

Art. 24º When the College of Kinesiologists of Chile decides that a Kinesiologist
has been unjustly marginalized from his position, his peers will be obliged to
abide by the prohibition on replacing him, established by the College.

Art. 25º The Kinesiologist must maintain the highest moral level in his public and
official conduct in defending the prestige and dignity of the profession and his
peers.

Art. 26º No Kinesiologist may, under any pretext, claim to represent the College
of Kinesiologists of Chile, with the exception of the National and Regional
Directors and those who have been expressly designated by the National
Directory.
Art. 27º Serious breaches of ethics are those that alter
the rules that must govern the relations of Kinesiologists
with the College:

a) Not abiding by the resolutions of the National


Directory or the respective Regional Directory.

b) Assume anti-institutional attitudes and actions that


damage the prestige of the College or its leaders; official
attitudes that tend to disunity or division of the Guild,
decrease the prestige of its members or that involve
undeserved damage to the Kinesic Career.
Title VI
Performance of the Kinesiologist with Society

Art. 28º It will constitute preferential attention to the Kinesiologist, to


lend his collaboration to the progress of science and his actions
must be aimed at raising the level of Health in the country.

Art. 29º Kinesiologists are prohibited from accepting and receiving


any payment that may mean commercial convenience in
professional care.

Art. 30º The Kinesiologist, as a professional whose responsibility is


the protection of life and the recovery of health, must respect the
rights and freedoms of members of society without distinction of
race, color, sex, language, religion, political opinion or of any other
nature, national or social origin, economic position, etc.
Title VII
From professional advertising
Art. 31º The advertising of Kinesiologists must be sober, objective
and truthful, without using inappropriate resources, in order to
obtain clientele. Advertising must be to publicize your name,
place of work and hours of operation.
Art. 32º The Kinesiologist must not publish, by any means, false
therapeutic or statistical successes or inaccurate data.

Art. 33º The dissemination of all scientific work must be done


through the corresponding scientific publications.
Title VIII
Of the Sanctions

Art. 34º The sanctions applied to transgression of the rules of professional


ethics are the following:

a) Verbal admonition
b) Written censorship
c) Penalty fee
d) Suspension of membership status for a maximum period of one year e)
Expulsion from the Trade Association

Art. 35º The sanctions will be applied by the Regional Directory or National
Directory, and the mitigating or aggravating circumstances that contribute to
the reproached conduct must be weighed in each case. Recidivism will always
be considered an aggravating circumstance.
Art. 36º No sanction will be applied to the Kinesiologist, when in
the opinion of the Regional Directorate or National Directorate,
there are causes exempting from ethical responsibility.

The following are grounds for exemption from liability:


- Death
- Deprived of reason
- Fortuitous event

The provisions of this Code are assumed to be fully known


by all associated Kinesiologists, who will therefore not be
able to claim ignorance of them .
