WOMEN RIGHTS IN INDIA: CONSTITUIONAL RIGHTS

The rights and safe guards enshrined in the constitution in India are listed below:

1. The state shall not be discriminated against any citizen of India on the guard of sex [Article
15(1)].

2. The state is empowered to make any special provision for women in other words: this provision
enables the state to make affirmative discrimination in favour of women [Article 15(3)].

3. No citizen shall be discriminated against for any employment or office under the state on the
guard of sex [Article 16(20].

4. Trafficking human being and forced labour are probhited. [Article 39(a)].

5. The state to secure equal pay or equal work for both Indian men and women [Article39(d)].

6. The state is required to ensure that the health and strength of women workers are not abused
and that they are not forced by economic.

7. The state shall make provisions for securing just humane conditions of work and maternity relief
[Article42].

8. It shall be the duty of every citizen of India to renounce practice derogated to the dignity of
women [Article 51-A(e)].

9. One-thirds of the total number of seats to be filled by direct election in every Panchayat shall to
reserved for women [Article243-D(3)].

10. One-third of the total number of seats to be filled by direct election in every Municipality shall be
reserved for women. [Article-243-T(3)].

11. The offices of chairperson in the Municipality shall be reserved for women in such manner as the
State Legislative may provide [Article-243-T(4)].

WOMEN RIGHTS IN INDIA: LEGAL RIGHTS

1. Sexual Harasment of Women at Workplace (Prevention, Probhition and Redressed, Act


2013). Provides protection to women from harassment at all workplaces both in public and privates
whether organised or unorganised.

2. Protection of Women from Domestic Violence Act (2006). This is a compressive


legislation to protect women in India from all forms of domestic violence. It also covers women who
have been/are in a relationship with the abuser and are subjected to violence any kind-physical sexual,
mental, verbal and emotional.

3. Pre-conception and Pre-Natal Diagnostic Techniques (Probhition od Sex Selection


Act(1994). Probhited sex selection before or after conception and prevents the misuse of pre-natal
diagnostic for sex determination leading to female foeticide.

4. Legal Services Authorities Act (1987). Provides for free legal services to Indian women.

5. Independent Representation of Women (Probhition Act 1986). Probhits indecent representation


of womenthoughadvertisementorinpublicationswriting,paintingfiguresorinanyothermanner.
6. Family Court Act (1984). Provides for the establishment of family Courts for speedy settlement
of family disputes.

7. Equal Remuneration Act (1976). Provides for payment of equal remuneration to both
men and women workers for same work or work of a similar nature. It also prevents discrimination on
the ground of sex against women in recruitment and service conditions.

8. Code of criminal Procedure (1973). CrPC 1973 has certain safeguard for women like
obligations of a person to maintenance his wife, arrest of women by female police as on.

9. Medical Treatment of Pregnancy Act(1971). This act provides for the termination of certain
pregnancies by registered medical practitioners on humanitarian and medical grounds.

10. Dowry Probhitation Act (1971). Probhits the giving or taking of dowry at or before or any time
after the marriage of women.

11. Maternirty Benefit Act(1961). This act regulated the employment of women in certain
establishments for certain periods before and after child-birth and provides for maturity benefit and
certain other benefits.

12. Indian Penal Code(1980). Contains provisions to protect Indian women from dowry death, rape,
kidnapping, cruelty and other offence.

13. Immoral Traffic (Peventation) Act 1956) . This is the premier legislation for preventation of
trafficking for commercial sexual exploitation. In other words, it prevents trafficking in women and girls
of the purpose of protection as an organised means of living.

14. Hindu Marriage Act(1955). This act introduced monogamy an allowed divorce on certain
specified grounds. It provides equal rights to Indian a man and woman in respect of marriage and
divorce.

15. Minimum Wages Act 1948). This act does not allow discrimination between male and
female of different minimum wages for them.
