Extrajudicial Settlement of Estate 500k
This AGREEMENT made end and entered this _____ day of ________ 20__, in
_______________________________________, by and between:
LEONARDO S. ANGCAYA, married to Stella Arandez Angcaya, Filipino, of legal age and
with residence at Barangay I, Amadeo, Cavite and RENE S. ANGCAYA, single Filipino, of
legal age and with residence at Barangay I, Amadeo, Cavite, hereinafter collectively referred
to as the “SELLER”;
- and -
ARNOLD THOMAS C. IBAY, Filipino, of legal age, single and with residence at 15 A
Molave Tower PGMH Penafrancia St., Paco, hereinafter referred to as the “BUYER”;
WITNESSETH, that:
WHEREAS, SELLER are the children and sole heirs of LUCIANA SUMAGUI ANGCAYA
who passed away on May 21, 2023 at Barangay I, Amadeo, Cavite;
WHEREAS, at the time of her death, deceased LUCIANA SUMAGUI ANGCAYA owned
the following real properties, to with:
Residential lot and improvements located in Poblacion 1, Amadeo Cavite, covered by Tax
Declaration No. AA-02 0001 00155 and AA-02 0001 00156 (copy attached as Annex “A” and “B”
hereof);
WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the Philippines,
and being with full capacity to contract, we do hereby adjudicate unto ourselves the parcel of land
described above, in equal shares.
The Parties agree that a true copy of this Extrajudicial Settlement of Estate with Absolute
Sale shall be published once a week for three consecutive weeks in a newspaper with general
circulation.
NOW, THEREFORE, for and in consideration of the above premises and the terms and
conditions hereunder-stated, the parties hereby declare, that:
ARTICLE I
PREMISES AND CONSIDERATION
The SELLER undertake to sell to the BUYER the above-described property for the sum of
PESOS: FIVE HUNDRED THOUSAND ONLY (Php 500,000.00) Philippine Currency.
All taxes and expenses for the transfer to the BUYER shall be at the buyer’s sole expense.
ARTICLE II
OCCUPANCY
The SELLER shall turn-over the above described-property clear and free of any
tenants/occupants 30 days after payment. SELLER undertake that the property including
improvements shall be turned-over without any part thereof being destroyed or removed.
ARTICLE III
BINDING EFFECT AND NON-WAIVABILITY
This deed shall be obligatory and binding upon the heirs, successors, administrators and
assigns of the respective parties.
Any act of tolerance or condonation by any of the parties herein of any violation or breach of
this Contract by the other party shall not constitute or be interpreted as a renunciation or waiver by
the aggrieved party of any of its rights under this Contract.
ARTICLE IV
REPRESENTATIONS OF THE SELLER
The SELLER hereby guarantee that there is no existing lien, encumbrance or claim,
registered or unregistered, against the subject property and they undertake to render free and
harmless the BUYER against any such lien, encumbrance or claim.
IN WITNESS WHEREOF, the parties hereto set their hands on these presents on the date
and at the place hereinabove indicated.
