AN ORDER ESTABLISHING A BADAC REFERRAL REHABILITATION DESK AND


DESIGNATING ITS DESK OFFICER

WHEREAS. DILG Memorandum Circular No. 2017-151 Sec. (A) (7) of DBB
Regulation No. 03 Senes of 2017 provides for the establishment 7 %- Habitation
Referral Desk in every barangay to endorse drug dependents to the duly authorized
representatives of DDB pursuant to article VIll of RA 9165 and pertinent issuance of the
Board;

WHEREAS, this Circular is issued to monitor compliance of barangays with the


above-mentioned DDB Regulations and to ensure the inclusion of the following
mandates in the BADAC Plan of Action, such as the following:
1. Establishment of Referral Rehabilitation Desk;
2. Designation of Duty Officer;
3. Organization of House Clusters; and
4. Designation of Cluster Leader

NOW THEREFORE, I TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, City of Balanga, Bataan, by virtue of the powers vested upon me by
law, do hereby designate a Barangay Rehabilitation Referral Desk Duty Officer.

SECTION 1. Composition. The Barangay Rehabilitation Referral Desk Duty Officers are
composed of the following:

SECTION 2. Functions. The Barangay shall have the following functions:

2. Conduct an interview to solicit personal information from the surrenderer,


3. Immediately inform the Punong Barangay in case the surrenderer is included
in the Target List, Wanted List and Watch List Personalities of law enforcement
agencies, such as but not limited to PDEA, PNP, and NBI; or has any other
pending criminal case;
4. Refer or endorse drug dependents to the City Anti-Drug Abuse Council
5. Log and maintain a record book containing all personal information of
surrenderers.
6. Ensure confidentiality of all information of surrenderers;
7. Monitor progress of surrenderers; and
8. Perform other duties and functions as may be deemed necessary.

SECTION 3. Effectivity. This executive Order shall take effect immediately.

AN ORDER ORGANIZING THE BARANGAY ECOLOGICAL SOLID WASTE


MANAGEMENT COMMITTEE (BESWMC)

WHEREAS, Section 389 (b) (9) provides that, for efficient, effective and economical
governance, the purpose of which is the general welfare of the Barangay and its
inhabitants pursuant to Section 16 of the Local Government Code of 1991, the Punong
Barangay shall enforce laws and regulations relating to pollution control and protection
of the environment.

WHEREAS, Section 6 and 7 of IRR of RA 9003 provide the creation of Barangay Solid
Waste Management Committee and its functions and responsibilities.

WHEREAS, Section 10 of RA 9003 stipulates that segregation and collection of solid


waste shall be conducted at the barangay level specifically for biodegradable,
compostable and reusable wastes.

WHEREAS, DILG MC No. 1996-119 dated June 27, 1996 enjoining all Provinces, cities,
Municipalities and Barangays to adopt a comprehensive Solid Waste Management
System.

WHEREAS, DILG MC No. 2000-117 dated August 2000 provides the implementation of
Zero-waste Management.

WHEREAS, DILG MC No. 2001-38 dated April 10, 2011 provides the creation of the
Ecological Solid Waste Management Committee (ESWMC) at the barangay level.

WHEREAS, DILG MC No. 2009-168 dated October 27, 2009 provides the strict
implementation of Section 17(H) and 32 of RA 9003 known as the Solid Waste
Management Act of 2000.

WHEREAS, for the implementation and enforcement of the provisions of the RA 9003
will be achieved through the reorganization of the BESWMC and to update them on
their duties and functions to RA 9003, and other related policies, laws and issuances.

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of Barangay

SECTION 2. DUTIES AND FUNCTIONS OF THE BESWMC


1. Formulate a community solid waste management program consistent with the
municipality.
2. Be responsible for the segregation and collection of solid waste specifically for
biodegradable, compostable and reusable wastes.
3. Establish within the barangay or cluster barangays a Material Recovery Facility, a
redemption or eco-centers in a barangay owned or lease land or any suitable open
space to be determines by the Sangguniang Barangay.
4. Allocate barangay funds for the barangay ecological solid waste management
program, approved by the Sangguniang Barangay.
5. Organize a Core Area/Street Coordinators to assist BESWMC in the implementation
of their programs and activities.
6. Conduct trainings for barangay residents on segregation, composting, recycling
and livelihood opportunities from use of recyclable waste and to monitor their
implementation.
7. Integrate the Ecological Solid Waste Management Program in the Barangay
Development Plan (BDP) and/or Annual Investment Plan (AIP).

8. Find alternative sources of funds other than the regular barangay budget.
9. Submit a monthly report to the City ESMC on the progress of the program, copy
furnished City DILG Office.
10.Implement policies and plan on the following:

Education
a. Develop and disseminate IEC materials on solid waste management to every
household, business establishments, and other institutions in the barangay;
b. Conduct of community trainings and seminars on ecological solid waste
segregations, composting, reduction of waste disposal and recycling; and
c. Issuance of community policies that will patronize ecologically friendly products
and packaging.

Engineering
a. Provision of support mechanisms for segregated collection; and
b. Setting up redemption or eco-centers (MRF) within the barangay for non-
biodegradable or recyclable materials before selling in bulk to junk shops.

Enforcement
a. Enact barangay ordinances on the establishment of ward system and other
incentives and sanctions in the barangay; and other rules and regulations to
implement the program.

Entrepreneurial
a. Establish a system of buying and selling of recyclable wastes including compost;
b. Promote livelihood activities from waste materials;
c. Networking with the private/business establishment within the barangay; and
d. Microfinancing for livelihood projects from waste

SECTION 3. SECRETARIAT
A Barangay ESWMC Secretariat shall be formed to assist the Committee in the
performance of its function. It shall provide technical and administrative support
whenever necessary. The BESWMC shall be composed of the following:

SECTION 4. FUNCTIONS OF THE PUNONG BARANGAY


1. Strictly observed the provisions of RA 9003 and related issuances.
2. Establish a Material Recovery Facility (MRF) in the barangay or in a cluster, in a
barangay-owned or leased land or in any suitable open space to be determined by
the Barangay though its Sangguniang.
3. Allocate certain parcel of land or to the cluster barangays for the MRF.
4. Initiate information campaigns through public consultations in their respective
localities.
5. Implement a Comprehensive Solid Waste Management System, enacted through an
Ordinance.
6. Communicate with the concerned City Environment and Natural Resources Officer
or DENR Regional Office for technical support in the event there is a need to train
LGU personnel on comprehensive solid waste management.

SECTION 5. EFFECTIVITY
This Order shall take effect immediately.

ORGANIZATION OF THE STRUCTURE FOR THE BARANGAY DRUG CLEARING


PROGRAM MONITORING MECHANISM (ORGANIZATION OF HOUSE CLUSTERS)

WHEREAS, Section (3) (A) of Dangerous Drug Board Regulation No. 2 Series of 2016,
mandates the whole process of voluntary surrender to authorities shall be documented
by the Duty officer (DO) of the Barangay where the individual surrendered;

WHEREAS, Section (6)(A)(3) of Dangerous Drug Board Regulation No.3 Series of 2017
provides for the basis in the organization of house clusters with designated cluster
leaders in each barangay;

WHEAREAS, Section (A) (7) of Dangerous Drug Board Regulation No.3 Series of 2017
further provides for the establishment of Rehabilitation Referral Desk in every
Barangay to endorse Drug Dependents to the duly authorized representative of DDB
pursuant to article III of RA 9165 and other pertinent issuance of the board;

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of Talisay,


City of Balanga, Bataan, by virtue of power vested in by law, do hereby organized the
mechanism structure in the implementation of Barangay Drug Clearing Program.

AN ORDER PROVIDING THE GUIDELINES ON THE IMPLEMENTATION OF HALINA'T


MAGTANIM NG PRUTAS AT GULAY (HAPAG) SA BARANGAY PROJECT OF
BARANGAY ________, CITY OF BALANGA, BATAAN

WHEREAS, he economy of the Philippines depends heavily on the agricultural sector,


thus challenges encountered, especially by farmers, have negative effects on the food
security in the country. Given its geographic location, the Philippines experienced
numerous threats to food security brought about by strings of natural calamities that
have rendered farm produce unusable or increased food prices due to food shortage

WHEREAS, COVID-19 pandemic has further worsened the country’s food security,
disrupting the availability and access to free and nutritious foods at affordable process.

WHEREAS, the Philippines ranks 68th of the 116 countries assessed for experiencing
hunger globally. With a score of 16.8, the Philippines had a moderate level of hunger
(2021 Global Hunger Index). In addition, the result of the latest Social Weather Stations
(SWS) National Survey released on September 11, 2022 with 1500 respondents shows
that 11.6% of Filipino or about 2.9 million households have experienced involuntary
hunger in the past three months.

WHEREAS, to address the problem of hunger and food insecurity in the Philippines, the
national government enacted several laws and implemented various initiative and
strategies to ensure sustainable and resilient production and food availability
throughout the country. However, food insecurity remains a challenge in the country
due to food shortage and rising food prices brought by natural calamities and disasters,
health crises such as the COVID-19 pandemic, among others, hindering economic
growth and national development.

WHEREAS, the Department of the Interior and Local Government thru its Memorandum
Circular 2023-001 shows its support in cognizant of the role of barangay as essential

food security in the country thru the Halina’t Magtanim ng Prutas at Gulay (HAPAG) sa
Barangay Project;

WHEREAS, HAPAG project aims to strengthen the capacities of barangay towards


sustainable agriculture initiatives. One of which is the intensification and fostering of
agricultural activities and communities will be encourage to produce fresh, healthy and
affordable fruits and vegetables from their backyard spaces, through the establishment
of community gardens in the barnagays with vacant areas.

Section 2. Roles and Functions. The Barangay Talisay HAPAG Team shall have
the following roles and functions:
1. Establish and maintain a HAPAG Barangay Community Garden (BCG) which
shall be at least two hundred square meters (200 sqm) of land area with
continuous or thru vertical gardens;
2. Set-up a community garden in a vacant area preferably owned by the barangay
or the City Government. In case of unavailability, the Sangguniang Barangay
can make an arrangement with a lot-owner in the barangay for the temporary
use of the land for the HAPAG-BCG.

3. Manage the operations of the HAPAG- BCG;


4. Coordinate with the City Agriculture Office for any available agricultural
training, seminars and capacity-building services as well as seeding materials
and other agricultural equipment and facilities, that would help in the
operation of the HAPAG-BCG;
5. Lead the promotion of the HAPAG-BCG to the community including its
importance and benefits as well as the products produced through the
community garden;
6. Promote agribusiness, especially for high-value products in the areas;
7. Keep a record of the overall operations of the HAPAG-BCG such as the types of
seedlings planted, number of vegetables and fruits harvested (e.g. per sack, per
piece, per kilo etc), among others;
8. Ensure the adequate provision of agricultural services and facilities in the
barnagay pursuant to Section 17 of the Local Government Code of 1991;
9. Enjoin a group of volunteers in the community to help in the establishment of
and maintenance of the HAPAG-BCG as well as spread the information in
setting-up household vegetable gardening and/or planting fruit-bearing trees;
and
10.Submit reports to the City DILG Office on their compliance with the
establishment of the HAPAG-BCG.

Section 3. Effectivity. This order shall take effect immediately.

ORGANIZATION OF THE BARANGAY COUNCIL FOR THE PROTECTION OF


CHILDREN OF BARANGAY TALISAY, CITY OF BALANGA, BATAAN

WHEREAS, the United Nations Convention on the Rights of the Child (UNCRC) provides
the fundamental basis of the Philippine Government’s vision for a “Child-friendly, caring
and protective society for, by and with the Children”;

WHEREAS, the Philippine Government’s ratification on the United Nations Convention


on the Rights of the Child (UNCRC) in 1990 has made it imperative for all sectors of the
society to translate its provisions into concrete actions that will lead to the fulfillment of
Filipino children’s rights to survival, development, protection, and participation;

WHEREAS, Republic act 7610-A Special Protection of Children Against Child Abuse
Exploitation and Discrimination Act, provides for a stronger deterrence and special
protection against child-abuse, exploitation and discriminstion and its corresponding
penalties;

WHEREAS, Article 359 and 360 of the Civil Code of the Phillipines, provides that the
“government shall establish a Council for the Protection of Children”;

WHEREAS, Presidential Decree (PD) 603, Article 87-The Child and Youth Welfare Code
encourages the organization of a Barangay Council for the Protection of Children (BCPC)
and shall coordinate with the Council for the Welfare of Children in drawing and
implementing plans for the promotion of child welfare;

WHEREAS, Department of Interior and Local Government (DILG) Memorandum


Circular No. 2002-121, dated August 3, 2002, a “Revised Guidelines on the Organization
and Strengthening of Local Council for the Development (LCPC) incorporating thereat
Early Childhood Care and Development (ECCD) Coordinating Committees at the
Provincial City, Municipal and Barangay levels”;

b. Prepare an Annual Work and Financial Plan;
c. Make recommendations to the barangay on policies and PPAs relative to children for
inclusion in the comprehensive and annual development plan of the Barangay;
d. Perform functions related to its mandate;
e. Document the barangay’s PPAs and accomplishments on children;
f. Coordinate its efforts with the concerned barangay officials and higher level LGU;
g. Conduct of advocacy activities; and

d. Follow-through action points and agreements from the BCPC meetings;
e. Consolidate AWFPs of various departments related to BCPC plans (provinces,
cities, and municipalities);
f. Maintain and update relevant data/information/document of the Council;
g. Prepare accomplishment report of the BCPC; and
h. Monitor services and programs related to BCPC.

A CONSTITUTION OF THE BARANGAY ANTI-DRUG ABUSE COUNCIL (BADAC) OF


BARANGAY TALISAY, CITY OF BALANGA, BATAAN

WHEREAS, drug related incidents have been constantly present in our country and resulted in
multiple crime incidents. Despite the effort of PNP and other law enforcement agencies of the
government, their lingering presence threatens the peace and order in communities nationwide.
The barangay, as the first of defense, should lead the fight against illegal drugs through the
campaign: “Buhay Ingatan, Droga’y Ayawan (BIDA)”Program.

WHEREAS, Memorandum Circular No. 2015 – 63, is issued to emphasize to local authorities
especially Barangay Officials, their principal responsibilities in support of overall government
efforts to address peace and order particularly to curb illegal drugs and other substances.

NOW THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of Barangay Talisay,


City of Balanga, Bataan by virtue of the powers vested in me by law, hereby declare the
reorganization of the Barangay Anti – Drug Abuse Council to wit:

Section 2. Powers and Functions

1. Conduct regular meeting at least once a month and call for a special meeting wherever
necessary;
2. Plan, strategize, implement and evaluate programs and projects on drug abuse prevention
in the barangay;
3. Organize the BADAC Auxiliary Team to compose an ideal member of 20 member per 2,000
population of the barangay representing streets, puroks subdivisions or sitios;
4. Orient the BADAC Auxiliary Team of roles and functions and in formulating plan of action to
address the problem;
5. Equip Barangay Tanods and BADAC Auxiliary Team on their roles and function in the
campaign against street-level illegal drug trade through seminars or trainings;
6. Coordinate and collaborate with other institutions implementing programs and projects on
drug abuse prevention at the barangay level;
7. Continuously gather and update data on all drug related incidents and its effect on the peace
and order situation in the barangay including listing of suspected drug users and pushers;
8. Submit a monthly report to the City Anti-Drug Abuse Council copy furnished the DILG City
Field Office;
9. Refer suspected drug users to the CADAC and other institutions for corresponding
counseling and/or rehabilitation;
10. Conduct an Information Education campaign (IEC) on illegal Drug demand reduction;
11. Monitor disposition and progress of drug related cases filed;
12. Submit the following reports on the implementation of BADAC Plan of Action (drug clearing
operations) using the following schedule:

b. Roles and Responsibilities


1. Identify and report to BADAC, drug dependents, suspected drug personalities, illegal
drug laboratories within their respective areas;
2. Assist in the conduct of IEC;
3. Help facilitate in the preparation and distribution of information materials in
collaboration with the school, neighborhood association, etc.;
4. Report existing community-based rehabilitation programs
5. Conduct neighborhood activities to prevent drug addiction.

 Identification of drug affected house clusters, work, places, streets, Puroks, sitios where
manufacture, delivery, sales or use of illegal drugs are being conducted and to report
the same immediately to the PNP or the Philippine Drug Enforcement Agency (PDEA).
 Conduct administrative searchers of suspected drug dens / laboratories.
 Conduct briefing meeting prior to the launching of operations to ensure positive results
and safety of the operating teams and the community.

DURING OPERATION
 Ensure safety of the community and regularity of the operation.
 Any elected Barangay Officials present during the operations to witness the inventory of
seized drugs / paraphernalia.
 Extend such necessary assistance to the PDEA and PNP authorizes in its operation
against illegal drugs including but not limited to the preservation of evidence and
protection of witnesses and suspects against unlawful acts.

POST – OPERATION
 The elected Barangay Officials present during the operation shall submit reports of the
drug – clearing operations conducted, if any, to the City Anti – Drug Abuse Council copy
furnished the DILG City Field Office.

b. Roles and Responsibilities
1. Coordinate and collaborate with other institutions in the barangay if any, (i. e. Barangay
Intelligence Network (BIN). “The eye in the Barangay,” Barangay Peacekeeping Action
Team (BPAT) etc. in implementing programs and projects on anti – illegal drug abuse.
2. Conduct consultative meetings with organizations in the barangay, such as Parents
Teacher Community Association (PTCA). Youth Group Boy and Girl Scout, Religious
Organizations, Senior Citizens, Homeowners Associations, Neighborhood Association,
Street and Tricycle Operations and Drivers Association existing in the community to get
their commitment assist in curbing the drug menace in the community.
3. Strengthen the family by promoting values, parental care and guidance that will prevent
children from attempting to and/ or use of prohibited drugs.
4. Strengthen the linkages of the Barangay Officials with the community, higher LGU’s local
police and PDEA on anti – illegal drug campaign.

5. Conduct necessary seminars for the community on the dangers of illegal drugs in
coordination with the PNP.
6. Empower the community in reporting drug related cases through an award/
commendation system.
7. Identify and implement sustainable livelihood projects as a reintegration program to
former drug pushers and drug addicts.

Section 5. Sanctions
All concerned local authorities are hereby advised that:
a. Failure of the concerned local officials to appropriate a substantial portion of their portion
of their respective annual budget to assist in or enhance the enforcement of RA 9165, as
mandatory required by Section 51 of RA 9165 in all budget preparation in addition to those
already mandatory required under Section 324 of the local Government Code, shall be a
ground for disposal of the annual budget on review and can be a ground for possible
administrative case of dereliction of duty pursuant to Section 60 of the Local Government
Code.
b. Failure of the local officials to take appropriate measures to enforce the pertinent provision
of RA 9165 after being made aware by the PDEA and or PNP and other law enforcement
agencies that illegal drug laboratories and marijuana plantation have been uncovered
within the area of their jurisdiction shall be considered as prime face evidence for
administrative charge (s) for gross negligence or dereliction of duties as maybe warranted
by evidence.
c. Any local official engaged in the manufacture, sale, delivery, transportation and use of illegal
drugs or who may have benefited therefrom shall be dealt with criminality and
administratively pursuant to the provision of RA 9165.

Section 6. Repealing Clause


All previous issuances which are inconsistent herewith are hereby repealed or modified
accordingly.

Section 7. Effectivity
This Executive Order shall take effect immediately.
