1. Briefly, the case of the complainant is that on


27.07.2021, complainant had received a phone call from the
alleged person Rohit Verma (mobile number 7669130328) hwo
represent himself sale manager PNB Life Insurance company and
disclosed the policy of complainant bearing no. 22565798 of
PNB Met Life Insurance company of the year 2018. The alleged
no. 1 told to the complainant that a commission amount of Rs.
72,000/­ have been generated against the said policy of
complainant and Insurance agent had applied for the said
amount. However, the complainant was induced to purchase
another policy of Rs. 37,500/­ with the benefit that commission
amount of Rs. 72,000/­ shall be credited in the account of the
complainant. It is further alleged that after some days the
complainant was again pressurized to invest and the complainant
was issued two policies of Rs. 1,50,000/­ and Rs. 99,999/­ of
Barti Axa Life Insurance. Thereafter, the complainant was again
allured that if he purchase another policy the GST amount on the
earlier policy shall be credited in the new policy and therefore
complainant has purchased another policy of Rs. 75,000/­,
however, no such amount was ever paid by the alleged person in
the account of the complainant.

3. Complainant submits that the accused, thus,


committed the offence of criminal breach of trust, cheating,
criminal intimidation against him. However, despite complaints
to SHO PS SB Dairy and also DCP concerned, no action has
been taken so far. Hence the present complaint U/s 156(3) Cr.
P.C has been moved.
4. The ATR was called from the concerned PS as per
judgment of Hon'ble High Court of Delhi in matter of
“Subhkaran Luharuka & Anr. Vs.State (Government of NCT
of Delhi) & Anr.” DLT 170 (2010) 516.
5. As per the ATR, the IO stated that the complainant
had purchased all the polices through online mode and the
process was carried out by the complainant himself. The policies
were found genuine. Further the alleged company has cancelled
two policies on the request of the complainant.
7. I have considered the arguments and gone through the
complaint and ATR.
8. In “M/s Skipper Beverages Pvt. Ltd. Vs. State”
2002 Crl. LJ NOC 333 (Delhi), it has been held that, “It is true
that Section 156(3) of the Code empowers to a Magistrate to
direct the police to register a case and initiative investigations
but this power has to be exercised judiciously on proper grounds
and not in a mechanical manner. In those cases where the
allegations are not very serious and the complainant himself is
in possession of evidence to prove his allegations there should be
no need to pass order under Section 156(3) of the Code. The
discretion ought to be exercised after proper application of the
mind and only in those cases where the Magistrate is of the
view that the nature of allegations is such that the complainant
himself may not be in position to collect and produce evidence
before the Court and interests of justice demand that the police
should step into held the complaint”.
9. In view of the settled position of law and after going
through the enquiry report and material on record, this court is of
the view that there is no need to invoke section 156(3) Cr.P.C for
issuing direction to register FIR against the respondents for the
following reasons:­
(i) The identity of proposed accused is ascertained.
(ii) No facts are needed to be unearthed as the same are well
within the knowledge of the complainant and can be proved by
complainant himself or through summoned witnesses.
(iii) Custodial interrogation of alleged accused is not
necessary.
(iv) The evidence is well within the reach of complainant
and no assistance of police is required to gather the same.
(v) The facts of the case are not such that would warrant
detailed and complex investigation to be carried out by the
State Agency.
10. Hence, the application u/s 156 (3) Cr.P.C. is dismissed.
