Terms And Conditions

1. This Work Order is issued towards Landscaping, Water Feature and other related works including 1 Year free maintenance of
the same at Marketing Office of Mantri Sun-1 Project , Rachenahalli, K.R.Puram Hobli, Bangalore and shall be read along with
the detailed BOQ.
2. Works shall be carried out as per he drawings, details, specifications and instructions by Engineer-in-charge.
3. Quantities are indicative. Payment shall be made for actual quantities of works executed, accepted and jointly measured at
site.
4. The above rates are inclusive of material, labour, transportation, loading, unloading, tools, tackles, incidentals necessary to
complete the works as per the details and specifications, but exclusive of VAT @14.50% on 100% value of work for Sl.Nos.44 to
49 and Service Tax @12.36% on 30% total value of work or as applicable at relevant period of time.
5. Contractor is responsible for obtaining Workman's compensation, Insurance on Plants and Machineries, Third Party Insurance
and Contractor's All Risk (CAR) Policy.
6. Defects Liability Period shall be 12 months from the date of issue of Taking-over-Certificate.
7. Retention: @5% on the value of work done and shall not bear any interest
Retention Amount shall be released against Nationalized Bank Guarantee of equal value with a validity upto Defects Liability
Period.
8. Rates shall remain firm till completion of the work.
9. The Electricity for the construction is in the scope of Contractor at his own cost and risk.
10. Insurance cover for your workmen shall be obtained as per workmen compensation act and the copy of the policy shall be
deposited with the Employer before starting the work at site. The insurance policy for third party liability shall be deposited with
the Employer before first running account/ interim bill by the Contractor.
11. Contractor shall be fully responsible for the safe custody of all materials and equipment supplied and stocked at site and / or
supplied and erected at site by you (inclusive of all materials and equipment supplied by us if any) till they are taken over by the
Employer.
12. Contractor shall co-ordinate with all other Contractors / Agencies engaged by the Employer.
13. If at any time after acceptance of the tender the Employer shall decide to abandon or reduce the scope of the work for any
part of the works to be carried out, the Employer shall give notice in writing to that effect to the contractor and the contractor shall
have no claim of whatsoever nature consequent to abandoning and thus resulting in foreclosure of the whole or part of works .
Upon such intimation this contract shall stand cancelled and terminated.

14. Contractor shall indemnify the Employer in case of an accident injury or death of any workmen employed by you for
execution of the work/third party, Contractor shall be liable for payment of compensation arising out of the same.
15. Contractor is solely responsible for safety of material, finished works, workmen and Third party at work site and shall ensure
compliance of safety norms use of safety tools and personal protective equipment like helmets, safety shoes, gloves etc.
16. Payment Terms : 100% upon completion.

Additional details for the above works shall be read as follows :
