Leave and Licence Agreement

THIS AGREEMENT OF LEAVE AND LICENCE is made on this the 14th day of
December, 2023 at Durgapur Court.

BETWEEN

Asha Rani Chand, W/o- Ujjwal Chand, by faith-Hindu, by occupation-Housewife,


resident of D4/3 Vidyasagar Pally, Benachity, Durgapur-13, P.S-Durgapur, Dist.-
Paschim Bardhhaman hereinafter called The Licensor or the First Party (which
expression shall include her legal heirs, attorney etc.).

AND

Partha Samanta, S/o-Dipankar Samanta, by faith-Hindu, resident of Palashpai,


Paschim Medinipur, West Bengal-721146 hereinafter called the Licensee or the
Second Party (which expression shall include his legal heirs, attorney etc.).

Whereas the first party is the registered owner of the building/premises more
fully mentioned in the schedule below and the second party approached to the
first party for granting him below schedule premises on the basis of leave and
licence for residential purpose only for limited period of 11 (Eleven) months
from the date of execution of this agreement on the terms and conditions as
stated hereunder: -

IT IS THEREFORE MUTUALLY AGREED BY THE PARTIES aforesaid as under: -

1. That this writing shall never be construed as tenancy agreement or base


nor otherwise creating any other right or interest over the below
scheduled premises in favour of the second party.
2. That the second party shall pay the consideration/premium for such
temporary accommodation as hereunder provided to pay to the first
party as fixed premium of Rs. 4500/- only per month in cash only as
charges for such temporary accommodation within 10 th day of every
English Calendar month excluding electricity charges which will be paid
by the second party as per consumption within date.
3. That the instant agreement shall be deemed to commence on and from
01/10/2023.
4. That the second party shall pay the monthly premium unto the first party
regularly and in default of consecutive 3 months this agreement be
terminated.
5. That the second party shall not make any addition and alteration and
change the existing nature and character of the below schedule premises
without prior written permission of the first party.
6. That the second party shall not transfer/sub-let the possession of below
schedule premises or any part thereof to any person.
7. That the second party shall be bound to deliver the vacant possession of
the below schedule premises unto the first party on the expiry of the
stipulated period. If the second party does not hand over the same after
the expiry of stipulated period, the second party shall be treated as illegal
occupant of the said premises.
8. That the second party shall not keep the below said premises under lock
and key or unused condition for consecutive 3 months.
9. That the premises shall not be used for illegal / immoral purpose. The
second party shall not keep/store any explosive substance or carry on
any illegal business in the premises.

SCHEDULE

In the district of Paschim Bardhaman, PS-Durgapur, 2 Rooms, Kitchen,


Toilet/Bathroom on the First Floor within the premises D4/3 Vidyasagar Pally,
Benachity, Durgapur-13, P.S-Durgapur, Dist.-Paschim Bardhhaman.

IN WITNESSES WHEREOF both the parties after going through it and


admitting it to be correctly written which read over to them by the witnesses,
put their signatures on this day, month and year first above written.
