MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Understanding made and entered into this _____ day of ______, in
the Municipality of Bula, Philippines by and among:

The University of the Philippines – Open University, Faculty of Management and

Development Studies Diploma in Land Use Planning Program, a state university whose
office is located at National Highway, Brgy. Maahas, Los Baños, Laguna, Philippines and duly
represented by the UPOU FMDS Dean, ________________________, Dr. Joanne V. Serrano,
herein referred to as UPOU-DLUP;

And

The Local Government Unit of Municipality of Bula represented by its Mayor, Hon. Amelita
A. Ibasco, herein referred to as Bula LGU.

WITNESSETH:

WHEREAS, the Urban Development and Housing Act (Republic Act 7279) aims to provide for
the rational use and development of urban land and adopt workable policies to
regulate and direct urban growth and expansion towards a dispersed urban net and
more balanced urban-rural interdependence;

WHEREAS, the UPOU DLUP caters to the needs of local government planners that now have
to take on more extensive planning responsibilities as these are devolved to lower
levels of government under the provision of the Local Government code of 1991;

WHEREAS, the Bula LGU’s vision of having empowered and resilient citizenry who enjoys a
globally competitive economy in an ecologically-balanced, functional and adequate
environment requires its urban form to be responsive to the needs of the people;

WHEREAS, the Bula LGU has pipelined the formulation of its Urban Development Plan and is
looking for partners as stated in their research program;

WHEREAS, the DLUP P210.1 class offers to partner with Bula LGU in the formulation of its
Urban Development Plan, specifically the Poblacion area;

NOW THEREFORE, for and in consideration of the foregoing premises and of the mutual
covenant hereinafter set forth, the parties agreed on the following, to wit;

ARTICLE I

ROLES AND RESPONSIBILITIES OF THE PARTIES

Section 1. Parties Responsibilities:

A. UP DLUP. The responsibilities of the University shall include but not limited to
the following:
[i.] Provide technical assistance to the researchers planning students during the
formulation of the Urban Development Plan;
i.[ii.] Conduct field work and planning activities necessary for data gathering;
ii.[iii.] Ensure strict compliance with Data Privacy Act of 2012 in handling of data;
iii.[iv.] Formulate and package the Urban Development Plan within the prescribed
timeline;
 iv.[v.] Present results of the study conducted to the Local Government Unit;
v.[vi.] Turn-over the packaged document to the Local Government Unit of Bula.

B. Bula LGU shall:

i. Provide data requirements necessary for the plan formulation;
ii. Provide transportation to researchers during fieldwork and site visits;
iii. Provide headquarters for researchers during of the immersion;
iv. Provide food and accommodations to researchers during the immersion;
[v.] Provide operation expenses to the faculty in charge, tutor angd planning
students; andresearchers, if necessary;
v.[vi.] Provide such other available support necessary to ensure the success of the
planning project.

Section 2: Voluntary Commitment

This Memorandum of Understanding is an entirely voluntary commitment between

parties and will not in any way obligate or restrict the activity of any party.
No party shall have any right, power, or authority to create any obligation, expressed
or implied, on behalf of any other party.

ARTICLE II

TERM OF AGREEMENT AND EFFECTIVITY

This Agreement constitutes the entire agreement between the parties, their respective
administrators, successors and assignees.

This MOU shall take effect on the date of its signing and may be revised, amended or modified
upon mutual consent of the parties concerned.

IN WITNESS WHEREFORE, the Parties hereunto set their hands and affixed their signatures,
