The H-1B Cap 2025 filing season begins on March 6, 2024.

Employers who miss filing H-1B registrations in 2024 will not be able to
bring In new employees under the H-1B program until October 1, 2025.

A clear understanding of what to expect this H-1B filing season is crucial

in effectively planning your H-1B filings and improving the chances of
your H-1B registrations being selected.

Under the H-1B Registration Rule which was introduced by

1 USCIS in FY 2021, employers are required to first submit an
electronic registration for each H-1B foreign national they
intend to hire. Since the registration fee for each application
is only $10, employers have been submitting registrations in
large numbers to improve the chances of selection in the H-
1B lottery. It is anticipated that this trend will continue in
March 2024 as well.

H-1B cap filing numbers have been steadily increasing over

the years. During each of the last 5 years, the H-1B cap has

2 been reached within the mandatory initial filing period. In
2023, USCIS received 780,884 H-1B cap registrations during
the initial registration period.

With the H-1B continuing to be the most relevant visa option

12 for many employers to hire foreign nationals for positions in
3 areas such as science, marketing, accounting, engineering,
and technology, the demand for new H-1B’s this year is
expected to far exceed the available annual statutory H-1B
cap limit, leading to an H-1B lottery this March.

Increased scrutiny in adjudication of L-1 petitions has led to

12 many companies opting to file for H-1B’s instead of L-1’s for
4 their qualifying employees. The denial rate, especially for L-
1B’s has been steadily increasing over the years.

The continuing crackdown by immigration on B-1 visa misuse

has forced many companies to re-examine their immigration
5 policies and strategies. To avoid any allegations of apparent
B-1 visa misuse, many companies have made a shift in their
immigration strategy and are increasingly exploring H-1B
visas for their employees, even for short-term placements in
the U.S., leading to escalation in demand for H-1B’s

The FY 2024 H-1B cap was exhausted by March 17, 2023.

Employers have since then been unable to file for new cap
subject H-1B petitions. When the FY 2025 filing season
begins on March 6, 2024, employers will be eager to fill in the
backlogs, thereby increasing the demand for H-1B’s this year.

12 The H-1B cap 2025 is expected to fill up during the H-1B

registration period between March 6 and March 22, 2024,

7 thereby triggering a lottery again. We expect the competition

will be as intense as the previous years, affecting the odds of
selection of a timely filed H-1B petition in the H-1B lottery.
