MUTUAL UNDERSTANDING

THIS MUTUAL UNDERSTANDING IS MADE ON BETWEEN

I, son/daughter of ,aged about years, by caste & faith- ,by


occupation- , residing at- P.O- P.S- Kolkata- , hereinafter called and
referred to as the FIRST PARTY (which terms or expressions shall
unless excluded by or repugnant to the context be deemed to mean
and include their heirs, executors, administrators, legal
representatives and assigns) of the ONE PART.

AND

I, son/daughter of ,aged about years, by caste & faith- ,by


occupation- , residing at- P.O- P.S- Kolkata- , hereinafter called and
referred to as the SECOND PARTY (which terms or expressions
shall unless excluded by or repugnant to the context be deemed to
mean and include their heirs, executors, administrators, legal
representatives and assigns) of the OTHER PART.

WHEREAS first party and second party are the joint owners in
respect of the Premises No. , along with other co-sharers and first
party has got half share of the entire Premises and remaining half
share shall be divided into six share after mutual understanding
and a length discussions in presence of the local respectable
persons and police authority and said disputed has been amicably
settled out of the court and to avoid the future complications and
disputes are recorded are as follows:-

1. That the Second party has full right, liberty to use and occupy all
the common facilities like water, bath and privy and common septic
tank as well as staircases and including roof rights as a co-sharer.

2. That second party is already in possession at the floor measuring


an area about ft at floor at the above mentioned premises and
second party also in possession of the shoproom at floor measuring
about ft and also agreed to allot tenanted flat of ft at the floor ,and
second party has full right, title and interest over the said allotted
portion forever and first party or his legal heirs and successors
shall claim anything regarding the same in future.
3. That both the parties have agreed to follow the above mentioned
provisions and first party and other co-sharers have agreed to follow
the same and shall not disturb the second party in any manner.

4. That second party has acquired all sorts of right, title and
interest over the aforesaid allotted portion and shall have the right
to alienate and transfer the said portion to any THIRD PARTY and
in that event the first party shall raise no objection.

5. That the second party has agreed to pay his imposed taxes in
respect of his proportionate share.
