Title
"Navigating Asylum: India's Dilemma between National Interests and Humanitarian
Commitments under International Law and the Citizenship Amendment Act"
Abstract
This study explores the complex connections between refugee protection, the right to asylum,
and the enactment of the Citizenship Amendment Act (CAA) in India. The research thoroughly
looks at the legal ramifications of the CAA for those who seek refuge, closely examining how
well it complies with the 1951 Refugee Convention and how it affects other international
commitments. Human rights issues raised by the CAA's implementation are examined, with a
focus on how they relate to international asylum norms. Analysis of the reaction of the world
community to the CAA clarifies its consequences for India's compliance with the international
law protecting refugees. Particular attention is paid to the ways in which the CAA affects the
asylum claims of specific groups, including religious minorities, and the wider implications for
burden-sharing in international refugee management.
