INCIDENTS/EVENTS
Murder: Hacking Incident
On September 20, 2023, at around 1:00 P.M., Esperanza MPS received a mobile phone call
through the hotline from One (1) Julia Aristan Montes. Informing the office that a hacking Incident
transpired in Purok 4, Guadalupe, Esperanza, Agusan del Sur Victimizing Ben Mabini Montes, 30
Years Old, Married, teacher, and resident of Purok 4, Guadalupe, Esperanza Agusan del Sur and
perpetrated by Juan Mabini Montes, 28 Years Old, Farmer, and Resident of the same address. Upon
receipt of the information personnel of Esperanza MPS led by PSMS ROMEO JAY LACAY proceeded
to the area and conducted the investigation.
Upon arrival, the suspect was apprehended by the responding personnel through a hot pursuit
operation. The suspect was informed of his rights and read the Miranda Doctrine and Anti-Torture law
in a dialect known to him. The suspect was brought to Esperanza MPS for further investigation and
disposition.
The Initial Investigation disclosed that before the incident, both victim and the suspect had a
heated argument over the Last Will Testament left by their father, the victim punched the suspect
because he was not satisfied with the Will. Both of them were pacified by the wife of the victim and the
suspect left the place. A couple of minutes later, the suspect returned to the place equipped with a
sharp-bladed weapon and approached the victim, and without hesitation, hacked the victim multiple
times using a sharp-bladed weapon. After the incident, the suspect fled in an unknown direction.
The victim was immediately rushed to Esperanza Hospital for immediate medical treatment but
was pronounced dead on arrival by the attending physicians.

A-Before the incident, my father-in-law Pedro Montes died and left his last will testament. It was
stated that the land would be divided between his two sons Juan and my husband. The said land
was confirmed to be 10 hectares. The 6 hectares went to my husband and the remaining 4 hectares
will go to Juan. But Juan did not agree, which caused a heated argument towards each other, and my
husband punched his brother at their father's house. After that, Juan left the house.

kay naa sa akong bana ug nahabilin ang upat ka ekatarya sa akong bana. Apan wala mo sugot
si Juan hinungdan sa init nga panaglalis sa usag usa gisumbag sa akong bana ang iyang
igsuon didto sa balay sa ilang amahan. Human niadto, mibiya si Juan sa balay.)

A- A couple of hours later, Juan returned and was equipped with a sharp-bladed weapon locally
known as Sundang, and without any hesitation approached my husband and hacked him five
times. After witnessing the incident, Juan fled in an unknown direction. I was scared and ran
outside to ask for help. My neighbor helped me and brought my husband to the hospital but
pronounced dead on arrival by attending physician.

A – I was informed by the police that they arrested Juan and brought to the police station for
further investigation and disposition.

A-. While I was walking heading towards my house, I saw the Juan carrying a bolo, filled with
blood and running. I immediately shouted for help because I believe that he committed a crime.

A- There were policemen who conducted patrolling, and I told them where the suspect ran. When

A-. Before the incident happened, I was conducting mobile patrolling in Brgy. Catmonon to
Guadalupe. Upon arrival in Brgy Guadalupe, a certain Ryan told us that he saw a man running
equipped with a sharp-bladed weapon locally known as Sundang. I conducted a hot pursuit operation
and was able to apprehend Juan. I informed him of the violation he committed and his constitutional
rights then read the Miranda Doctrine and Anti-Torture Law in a dialect known to him and brought him
to the nearest medical facility for medical examination. Later brought to Esperanza MPS for further
Investigation and disposition.

ug Anti-torture Law sa dialecto nga makasabot siya ug among gi dala sa duol nga Medical
