AN ORDER RE-ORGANIZING THE BARANGAY ANTI-DRUG ABUSE COUNCIL


(BADAC)PROVIDING FOR ITS COMMITTEES, COMPOSITION AND FUNCTIONS

WHEREAS, Section 16 or the General Welfare Clause of the Local Government Code of
1991 provides that local government units shall, within their jurisdiction, promote health
and safety, improve public morals, maintain peace and order, and preserve the comfort and
convenience of their inhabitants, among other equally significant responsibilities;

WHEREAS, drug related incidents have been constantly present in our country and
resulted in multiple crime incidents. Despite the efforts of the PNP and other law
enforcement agencies of the government, their lingering presence threatens the peace and
order in communities nationwide;

WHEREAS, the barangays, as the first line of defense, should lead the fight against illegal
drugs through the campaign,” Mamamayan, SugpuinangiligalnaDroga” (MASID);

WHEREAS, DILG Memorandum Circular No.2015-63, dated June 16,2015 was issued to
emphasize to local authorities especially barangay officials their principal responsibilities
in support of overall government efforts to maintain peace and order particularly to curb
illegal drugs and other substances;

WHEREAS, the establishment of the Barangay Anti-Drug Abuse Council (BADAC) in


Barangay__________________, Malita, Davao Occidental is imperative in order to provide a
venue for an orderly, planned and well-managed campaign against all forms of illegal drugs
and other substances;

NOW THEREFORE, I,_____________________________, by virtue of the powers vested in me by law


as Punong Barangay of Barangay ___________, Malita Davao Occidental do hereby order:
Section 1. The Barangay Anti-Drug Abuse Council shall be composed of the following
members;

Section 2. Composition of the BADAC Auxiliary Team – The following shall be


designated as members of the BADAC Auxiliary Team:

Section 3. Functions of BADAC Auxiliary Team – members of the BADAC Auxiliary


Team shall perform the following duties and responsibilities:
1. Identify and report to the BADAC suspected drug dependents, pushers, illegal
drug laboratories, and other illegal drug-related activities in their areas;
2. Assist in the conduct of information, education and communication campaign
activities;
3. Help facilitate in the preparation and distribution information, education and
communication materials in collaboration with schools, neighborhood
associations, etc.; and
4. Initiate the conduct of neighborhood activities to prevent drug abuse in their area
of operation especially among children and youth.
Section 4. Organization of Barangay House Clusters – The organization of Barangay
House Cluster shall be based on the number of streets in the Barangay and the following
shall be designated as cluster leaders:

Section 6. Functions of Barangay Cluster Leaders – Designated cluster leaders shall
perform the following duties and responsibilities:
1. Attend BADAC regular meetings, upon instruction of the Punong Barangay;
2. Prepare and maintain list of individuals or residents in every household within
the assigned cluster;
3. Immediately inform or report to the BADAC any illegal drug-related activities or
cases occurring within the assigned cluster; and
4. Perform other duties as may be assigned by the Punong Barangay.
Section 7. Effectivity – this Order shall take effect immediately.

Section 5. Powers and Functions. The Barangay Anti-Drug Abuse Council shall have the
following roles and responsibilities:
a. Create a BADAC Plan of Action to be submitted to CADAC, copy furnished the DILG
City Field Office;
(1.) Set quarterly targets to reduce the level of drug affectation and ultimately
achieve drug-free status and maintain the status of drug-cleared and unaffected
barangays;
(2.) Empower the community in reporting drug related cases through an
Award/Commendation System;

b. Organize the BADAC Auxiliary Team and orient them of their roles and functions in
formulating a plan of action to address the drug problem;

c. Equip Barangay Tanods and BADAC Auxiliary Team on their roles and functions in
the campaign against street-level illegal drug trade through seminars or trainings;

d. Identify drug-affected places (i.e., workplace, house clusters, and streets) within the
barangay where there are violations of RA 9165 and immediately report the same to
the PNP or PDEA;

e. Determine and maintain record of the names and other pertinent information of
residents, and likewise, record, update, and monitor all drug-related incidents/cases
reported or filed and its effect on the peace and order situation in the barangay
including listing of suspected drug users and peddlers;

f. The BADAC, through its chairperson, shall consolidate all information gathered from
all sources, related to any illegal drug activities within the barangay, to include
names of users/peddlers, marijuana cultivation, clandestine drug laboratories, and
submit immediately to CADAC and local PNP for validation and formulation of watch
list;
g. Ensure existence and operation of barangay rehabilitation referral system, through
the Barangay Rehabilitation and Referral Desk, intended for drug users and
dependents who voluntarily surrendered;

h. Assist PWUD who surrendered to Barangay Rehabilitation and Referral Desk and
refer to CADAC and other institutions for appropriate action;

i. Monitor individuals who are undertaking Community-Based Rehabilitation


Treatment and Rehabilitation through their attendance and completion of CBRP
requirements;

j. Conduct regular and consultative meetings at least once a month and call for special
meetings with organizations in the barangay, such as the Parents Teachers
Community Association (PTCA), youth groups, Boy and Girl Scouts, religious
organizations, senior citizens, homeowners, and neighborhood associations,
puroks, Tricycle Operators and Drivers Association (TODA) and other groups
existing in the community to ensure their commitment to assist in curbing the drug
menace in the community, whenever necessary;

k. Formulate prevention education programs and ensure implementation of the same


in coordination with various association stated in paragraph (j), using funds which
shall be derived from the Local School Board and other available sources;

l. Conduct an Information Education Campaign (IEC) on illegal drug demand


reduction;

m. Extend assistance to law enforcement agencies during the conduct of anti-drug


operations. The BADAC Chairperson or any elected official present during the anti-
drug operations should sign the inventory of seized drugs and paraphernalia as
witness;

n. Submit monthly report to the City Anti-Drug Abuse Council copy furnished the DILG
City Field Office;

o. Submit annual Accomplishment Report and Fund Utilization Report to the CADAC
not later than the 20th day of January, copy furnished the higher Peace and Order
Council and the DILG Field Office;

p. Submit the following reports on the implementation of BADAC Plan of Action (drug-
clearing operations) using the following schedule;

Section 6. BADAC Committees

b. Roles and Responsibilities

 Prepare and maintain a confidential list of suspected


users,pusher,financiers and/or protectors of illegal drug trade
found in the LGU’s area of jurisdiction to be submitted to the
Municipal Anti-Drug Abuse Council copyfurnished the PNP Anti-
illegal Drugs Special Operations Task Force (AIDSOTF),and
 Establish rehabilitation/referral desks and process applications
for rehabilitations of drug defendant.

Pre-Operations
 Identification of drug affected house clusters, work places, streets, puroks
and sitios where manufacture, delivery, sale, or use of illegal drugs are being
conducted and to report the same immediately to the PNP or the Philippine
Drug Enforcement Agency(PDEA);
 Conduct administrative searches of suspected drug dens/laboratories;
 Conduct briefings, meetings prior to the launching of operations to ensure
positive results and safety of the operating teams and the community.

During Operations
 Ensure safety of the community and regularity of the operations;
 Any elected barangay official present during the operation to witness the
inventory of seized drugs/paraphernalia;
 Extend such other necessary assistance to the PDEA and PNP authorities in
its operation against illegal drugs including but not limited to the
preservation of evidence and protection of witnesses and suspects against
unlawful acts.

Post Operation
 The elected barangay official present during the operations shall execute an
affidavit and act as witness in court hearing in the prosecution of drug cases.

 Submit reports of drug-clearing operations conducted, if any, to the


Municipal Anti-Drug Abuse Council copy furnished the DILG Municipal field
Office.
For operations conducted/initiated by the PDEA/PNP an elected barangay
official should be involved immediately after the raid and be present to stand
as witness during the committee of inventory.
B. Committee on Advocacy
a. Composition

b. Roles and Responsibilities

 Coordinate and collaborate with other institutions in the barangay if any. The
Eye in the Barangay in implementing programs and projects on anti-illegal drug
abuse;
 Conduct consultative meetings with organizations in the barangay to get their
commitment to assist in curbing the drugs menace in the community;
 Strengthen the family by promoting values, parental care, and guidance that will
prevent children from attempting to and/or use of prohibited drugs;
 Strengthen the linkages of the Barangay Officials with the community higher
LGU’s local police and PDEA on anti-illegal drug campaign;
 Conduct necessary seminars for the community on the dangers of illegal drugs in
coordination with the PNP;
 Empower the community in reporting drug-related cases through an
award/commendation
 Identify and implement sustainable livelihood projects as a reintegration
program to former drug pushers and drug addicts.

Section 7. FUNDING. Funds for the projects and programs or activities of the council shall
be charged against the 5% fund intended for illegal drugs subject to existing rules and
regulations.
Section 8. Sanctions
All concerned local authorities are hereby advised that:

a. Failure of the concerned local officials to appropriate a substantial portion of their


respective Annual Budgets to assist in or enhance the enforcement of RA 9165, as
mandatorily required by Section 51 of RA 9165 in all budget preparations in
addition to those already mandatorily required under Section 324 of the Local
Government Code, shall be a ground for disapproval of the Annual Budget on review
and can be a ground for possible administrative case of dereliction of duty pursuant
to Section 60 of the Local Government Code.
b. Failure of the local officials to take appropriate measures to enforce the pertinent
provision of RA 9165 after being made aware by the PDEA and/or PNP and other
law enforcement agencies that illegal drugs sale, delivery and use is rampant within
their LGU; or shabu and other illegal drug laboratories and marijuana plantation
have been uncovered within the area of their jurisdiction shall be considered as
prima facie evidence for administrative charge(s) for gross negligence or dereliction
of duties, as may be warranted by evidence.
c. Any local officials engaged in the manufacture, sale, delivery, transportation and use
of illegal drugs or who may have benefited therefrom shall be dealt with criminally
and administratively pursuant to the provision of RA 9165.

Section 9.This Order shall take effect immediately.
