ENUMERATORS AGREEMENT

BY AND BETWEEN CENTRE FOR AGRICULTURAL RESEARCH AND DEVELOPMENT

(CARD) (“Client") and

_________________________________________________("ENUMERATORS").

WHEREAS CARD desires to obtain the services of a Enumerators for the “National Farmers’
Census (NFC)-2024 also known as Digital registration, profiling of farmers and geo-
mapping of farm parcels".

WHEREAS, Enumerators has agreed to provide these services to the Client as herein
described,

NOW THEREFORE, in consideration of the mutual covenants and promises stated herein,
the parties agree as follows:

1. Relationship of the Parties – CARD and the Enumerators are independent of each
other, and neither is an authorized agent or representative of the other. No
employer-employee or any other agency relationship is created hereby. The
Enumerator shall have no authority to make any contract in the name of CARD or
otherwise bind CARD or any of its affiliates.

2. Services to be Provided – Enumerators shall provide services (the “Services”)

described below for a period of not more than 31 days from the first day of July
2024. Payment will be made only for the number of completed and checked
questionnaires. These questionnaires should meet the quality desired and acceptable
by the client.

Description of Services: -
a) Conducting Household interviews AND Geo-map farm parcels.
b) Complete a minimum of 40 farm household questionnaires per day.
c) Uploading/syncing completed AND high quality interviews daily.

d) Any other duties as assigned by the CARD Experts and field Supervisors.

3. Payment – CARD shall pay the Enumerators a lump sum of monthly allowance of
MWk 400,000.00. The monthly allowance shall be paid in three installments of
25%, 25% and 50%. The last payment of 50% shall only be paid after successfully
completion of work and that the client has paid the financial resources to CARD for
the assignment to pay to the Enumerators engaged. Should the Enumerators decide
to leave the assignment before its completion for whatever reason, the Enumerator
shall reimburse whatever extra payment they got over and above the actual work
satisfactory completed. CARD shall not be in a position to pay the balance before
getting payment from the Client.

4. Schedule of Payments – The payment schedules shall depend on flow of funds from
the Project Funder. However, the maximum that a Enumerators can get in the field
is 40% of the total sum with the other balance paid upon successful completion of
the field work and upon the client paying CARD.

5. Transport: CARD will pay transport allowance equivalent to MWk 4,000.00 per
day, payable weekly in advance for the Census duration. All subsequent payment
shall be made upon retirement of previous transport allowance received by the
Enumerator.

6. Data Bundle: CARD will pay MWk 6,000.00 for data bundle, which shall be paid
once during the Census duration

7. Air Time: CARD will pay MWk 2,000.00 for voice calls, which shall be paid once
during the Census duration.

8. Terms of Agreement - This Agreement shall be effective from the 1st July 2024 until
the 30th November, 2024.

6. Medical Insurance – CARD is under no obligation to provide medical insurance to

the Enumerator. The Enumerator is encouraged to have own medical insurance to
cover the duration of the work.

9. Severability - If any provision of this Agreement shall be held to be invalid, illegal

or unenforceable, the validity, legality and enforceability of the remaining
provisions shall in no way be affected or impaired.

10. Applicable Law - This Agreement shall be governed by the laws of the Government
of Malawi. All rights of the parties are cumulative and in addition to any rights
they may have at law or equity.

11. Conflict of Interest - To the best of the Enumerators knowledge and belief, no actual
or potential conflict of interest exists. Enumerator agrees to reveal any such conflict-
of-interest situation as soon as it is discovered.

12. All the data used and outputs generated are owned by CARD and Enumerator shall
not reveal to or share with any third party.

13. The Enumerator should take care of all CARD property given to them for
assignment and should be returned to CARD after the assignment. Any loss all
damage to the said property, the Enumerators shall be deducted from their pay
equivalent amount enough to replace or repair the property. Should the
Enumerator’s remaining payment balance be not enough to cover the
replacement/repairs, the Enumerator shall be asked to settle the balance from their
other income sources.
