AFFIDAVIT BY AND ON BEHALF OF COMPLAINANT, THROUGH ITS GENERAL

MANAGER AND AUTHORISED SIGNATORY, SH. SANTOSH KUMAR SINGH S/O
SH. RAM CHARAN SINGH OF SHREE TIRUPATI AUTO, HAVING ITS
REGISTERED OFFICE AT 16/95, THE MALL, KANPUR NAGAR, UNDER SECTION
200 OF THE CODE OF CRIMINAL PROCEDURE, 1973.

I, the above-named Deponent, do hereby solemnly affirm and declare as under: -

1. I say that I am the General Manager of Shree Tirupati Auto, a partnership Firm,
engaged in the business of supply of cars, accessories and auto parts, having
its registered office at 16/95, The Mall, Kanpur Nagar – 208001. I am filing the
present complaint, as a General Manager and power of attorney holder wherein
the aforesaid special power of attorney is executed in my favour by the Partners,
Shri Nitin Gupta and Shri Manish Gupta. A copy of the Special Power of Attorney
has been attached with the Complainant.

2. I say that the Accused, Arjun Singh S/o Shri Prem Sagar Bhadauriya, is
presently residing at 115/154, Awas Vikas Road, Bramdev Chauraha,
Maswanpur, Kanpur.

3. I say that the Accused approached me in the month of December 2019,

displaying his interest in purchasing Mahindra Scorpio Car from our showroom.
I say that our staff in the showroom, in good faith, supplied Mahindra Scorpio
Car, bearing Engine No. – ETKZG62742 and Chassis No. –
MA1NM2ET1K2G78970 to the Accused and accordingly generated an invoice
for the purchase of above-mentioned car. A copy of the Invoice dated
05.12.2019 has been attached with the Complainant.

4. I say that the Accused made a part-payment of INR 8,32,532.00/- (Rupees Eight
Lakhs Thirty-Two Thousand Five Hundred Thirty-Two Only) in relation to the
purchase of the above-mentioned car and assured to make the balance
payment of INR 1,57,061.00/- (One Lakh Fifty-Seven Thousand Sixty-One Only)
