MEMORANDUM OF UNDERSTANDING

This Memorandum of Understanding is made and executed on 13 th


day of December 2021 at Hyderabad By and Between:
Vadakattu Srinivas , S/o. Sri. Vadakattu Narayana Aged

(Hereinafter called the First Party which term shall mean and
include all his heirs, executors, administrator, legal representatives,

(Hereinafter called the Second Party which term shall mean and
include all his heirs, executors, administrator, legal representatives,
nominees and assignees etc..,of Other Part )

Whereas First party and Second Party herein are husband and wife
married as per Hindu Rites and Customs in the presence of their
family members and elders on 11/05/2007 at Hyderabad. Out of
their wedlock they have two Children namely V Aishwarya aged 13
Years and V.Sai Harsha Vardhan aged 13 Years and are leading a
happy married life with their children.
Whereas First Party earlier married to one V,Manjula. Out of their
wedlock have Two Children namely V.SaiTeja aged 25 Years and
V.Alekya aged 22 Years were born. Unfortunately, the First Party’s
wife Manjula Expired on 02/02/2007 as such in order to upbring the
children the first party married second party V.Swapna. Thus, the
first party is having four children as mentioned below:
1.V Aishwarya aged 13 Years
2.V.Sai Harsha Vardhan aged 13 Years
3.V.SaiTeja aged 25 Years
4.V.Alekya aged 22 Years

The First Party has acquired the schedule properties and in order to
avoid Misunderstandings/disputes in future among their family has
executed this MOU mutually.
NOW THIS MOU WITNESSETH AS FOLLOWS:

1.The first party assured the second party that he is the sole and
absolute owner of the scheduled mentioned properties and has got
right to enter into this MOU. The parties herein assured each other
that they shall abide by the terms stated in this MOU and shall not
enter into any agreement/s, Sale Deed/ mortgage deeds with any
third party/s without consulting each other hereafter and shall
jointly execute the same if necessary in future.

Schedule A Property stands is purchased by the parties herein in
their names Jointly vide Document No 424/2016 dt 29/01/2016.
Regd in the office of SRO SR Nagar Hyderabad.

Schedule B Property stands in the name of Vadakattu Sai Harsha


Vardhan vide Document No 1865/2012 dt 10/10/2012 Regd in the
office of SRO SR Naga Hyderabad

Schedule C Property stands in the name of first wife of the first


party Late Smt Vadakattu Manjula Document No 1766/2003 dt
24/07/2003 Regd in the office of SRO SR Nagar Hyderabad.

Schedule D Property stands in the name of First Party Vadakattu


Srinivas Notary document dt 27/09/2005.

Schedule E Property stands in the name of Vadakattu Bhagyamma


and Vadakattu Andalamma vide Document No 532/1970 dt
09/03/1970 Regd in the office of SRO Khairtabad Hyderabad.
Whereas Vadakattu Bhagyamma has expire on ________ and the
Scheduel E property has fallen to the share of his son which they
have orally partitioned and thus the First party of this MOU has
become the rightful and absolute owner of the Schedule E Property.

It is mutually agreed between the parties herein that though the


Registered Sale Deeds are executed as stated above the properties
mentioned herein shall equally be bequeathed among all the five
children of the parties herein and either party shall not do any such
act/s which will deprive the rights interests of their children.

SCHEDULE A PROPERTY-

All that Residential Semi- Finished Flat No.101, in the First Floor of
Aditya Purvaj Construction’s “GANESH NIVAS’’ , admeasuring 1909
Square Feet, including common area and one car parking, together
with undivided share of land measuring 70 Sq.Yds., or 58.53
Sq.Mts., out of total land admeasuring 700 Sq. Yds., in the property
bearing Door No.7-1-212/7 (Old H.No.7-1-212/F), in Part of Survey
No.76, situated at Shiv Bagh, Ameerpet, Hyderabad and bounded as
follows:-

South : Open to Sky
East : Open to Sky
West : Open to Sky

SCHEDULE B PROPERTY-

All that the Shop No: G3 and Room No.3, in Ground Floor, of
“KAMALA NIVAS”, admeasuring 360 square feet, together with
undivided share of land measuring 25 square yards out of 600
square yards, in Premises bearing Municipal No.7-1-621/263 (52-
M2), Situated at Sanjeeva Reddy Nagar, Hyderabad, A.P., and
bounded by:-

North : Road
South : Neighbors Flat
East : Shop no.2.
West : Open Space( Passage)

SCHEDULE C PROPERTY-

All that the proposed Flat No 101 in the First Floor of SRI RAGHAVA
RENUKA RESIDENCY having a plinth area of 1000 sft including
common area together with undivided share of land admeasuring
38.5 Sq meters in premises bearing MCH No 7-1-237/8 situated at
Bhalool Khan Guda Hyderabad TS and Bounded as

North : Staircase & Flat No 102 Belongs to Owners


South : Open to Sky
East : Open to Sky.

SCHEDULE E PROPERTY-

All that All that Plot of Land measuring 231 Sq Yards equvalant to
193.34 Sq Meters situated at Ameerpet Chowrastha with in the
Municipal Corporation Limits Bounded as here under
North : Cement Concrete Road from Ameerpet to Secunderabad
South : 18 ’ wide Lane belonging to Sri Akram Ali Khan
East : 6 ’ wide Common Lane by the side of the Chandraiah
West : Vendors Land

SALE DEED

This DEED OF SALE is made and executed on 13 th day of


December 2021 at Hyderabad By and Between:

Whereas the vendor is the absolute owner and possessor of
residential House No New 8-3-228/664/B ( old 8-3-228/664)
admeasuring 177 Sq Yards situated at Rahamathnagar Yousufguda
Hyderabad. (Which is more clearly mentioned at the schedule of
the property mentioned below).
Whereas the vendor has purchased the scheduled property through
a Agreement of Sale dt 27/09/2005 Notarized vide SL NO 6720
Page 86 dated 27/09/2005 and ever since from the date of its
purchase the vendor is in possession of the same uninterruptedly
from anyone .
The above said vendor has acquired the rights of the property as he
has represented to the Vendee that he has every right to execute
the present Sale Deed. The vendor has offered to sell the schedule
property for a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) and
the Vendee has agreed to purchase the same.
In pursuance of the offer and acceptance of sale of the schedule
property for a total sale consideration of Rs. 10,00,000/- (Rupees
Ten lakhs only) the vendee has already paid the total consideration
in installments out of his savings to the vendor and the vendor
hereby acknowledge the receipt of the same.
NOW THIS DEED OF SALE WITNESSETH AS FOLLOWS :-
That in consideration of payment of Rs. 10,00,000/- (Rupees Ten
lakhs only) the Vendor herein agree and undertake to sell the
schedule property and that having received the complete above said
sale consideration the vendor has executed the present document.
The Vendor do hereby covenant with the Vendee that he has paid
taxes and other liabilities to the respective departments up to date
and that in case any amount is hereafter found due from the
Vendor, his taxes and other liabilities and out goings or any other
account what so ever in connection with the schedule of property
the same shall be paid by the Vendor. And further indemnify and
keep indemnified the Vendee for all losses or damages if any
suffered on that account. The Vendor hereby further covenant with
the Vendee that he shall, from time to time when ever called upon
by the Vendee do and execute further acts deeds and things what
so ever for further and more perfectly convene and assuring the
schedule of property and to and the use of Vendee and shall or may
be reasonably required. Contd..3

The Vendor assures the Vendee that there are no encumbrances,


charges or subsisting agreement of sale etc. in respect of the
Schedule property in favor of any person/Banks/ or any other
Financial Institutions.
The Vendor hereby acknowledge the entire sale consideration in full
as aforesaid is hereby admitted, accepted and acknowledged by the
Vendor as full and final discharge whereof to the Vendee. The
Vendor hereby sells, transfers and assigns to the Vendee, the
Schedule property together with all easementary rights and
proportionate rights in common areas and common access, together
with all rights titles interest property and easements of what so ever
of vendor in, to or upon the said premises and every part thereof,
and also together with fixtures, fittings, ways, water courses, drains,
liberties, advantages and appurtenances belonging or reputed to
belong thereto to have and to hold the said premises to and to the
use of the Vendee, his heirs, and Assignees absolutely forever.
The Vendor has this day delivered to the Vendee vacant & peaceful
physical possession of the schedule property to the Vendee to have
and hold as absolute owner forever and enjoy the property without
any interruption from the Vendor or any person claiming through
them.
The Vendee has thus been put in effective possession of the
property hereby sold and shall hold possess and enjoy the said
premises without any let or hindrance from the Vendor or any one
claiming through or on behalf of the Vendor. Further the Vendor has
also delivered this day to the Vendee all the title deed and other
papers pertaining to the schedule property, which are with her.
The Vendor undertakes that she has not done any act, deed or
things whereby the Vendee shall be deprived the whole or any part
of property and if the Vendee is deprived any part or whole of the
schedule property in that event the Vendor shall indemnify the
Vendee for the loss sustained by him.

IN WINESS WHERE OF the Vendor has put her hands and signed on
this Deed of Sale on the date, month and year mentioned above.
