Rajasthan implements the Advocates Protection Bill, becoming the first state to pass it.

Synopses: The Bill intends to stop offences against advocates such as assault, criminal force, grievous hurt,
and criminal intimidation against the advocates and loss or damage to their property.

The Rajasthan become the first State in India to enact legislation protecting Advocates. Following its
introduction in the assembly last week, the Rajasthan Advocates Protection Bill was approved by the state
legislature in a voice vote.

According to Section 3 of the Bill, any act of assault, criminal force, grievous hurt or criminal intimidation
committed against an advocate will be regarded as a violation of the Act if it is connected to the advocate's
duties while within a court.

Section 4 stipulates that if an advocate complains to the police about such an act as specified in Section 3,
the police shall, if it deems fit, provide protection to such advocate. The Act's offences are punished as
according Section 5.

Assault or employing criminal force against an advocate is punishable under Section 5(1) by up to two years
in prison and a fine of up to 25,000.The act of voluntarily causing grievous hurt to an advocate is punishable
under Section 5(2) by up to seven years in prison and a fine of up to Rs. 50,000/-. Criminal intimidation
against an advocate is a crime punishable by up to two years and a fine of up to Rs. 10,000, according to
Section 5(3).

Any Act-related offence must be cognizable, according to Section 6, meaning that the investigating authority
can arrest the accused without a warrant.Misuse of the Act's provisions is punishable under Section 11 with
up to two years in jail.

The Rajasthan government was recently encouraged to pass a law protecting advocates and their families by
the Bar Council of India (BCI). This was in response to the horrific murder of a lawyer in the State in broad
daylight and the following lawyer strike.
