UİYV, Türkiye ve Suriye’de yaşayan ihtiyaç sahibi
insanları gıda, hijyen, altyapı, barınma, korunma, sağlık
vb. Şimdi Suriye'deki ÜİYOK'lerin ısınması için kömür
sağlayacağız.
Bu projenin beklenen sonuçları, yerel topluluk ve
yerinden olmuş kişiler için güvenli ve sağlıklı bir ortam
sağlamak ve ikamet yerlerine erişimlerini
kolaylaştırmaktır.
Bu Projesi kapsamında, şimdi Suriye halkına milyonlarca
dolar yardım sağlayan büyük ve acil yardım ve geliştirme
programının bir parçasıdır. Gıda, gıda dışı, barınak, ilaçlar
ve tıbbi cihazlar son aylarda Suriye içlerine teslim edildi
ve zor durumda olan insanların hayat kurtarma

4. Sunulan fiyat teklifi, eşyanın UİYV tarafından

5. Hiç bir tedarikçi, ihalenin herhangi bir bölümünü
değiştiremez veya silemez.
6. Her tedarikçi, şirketine finansal ve teknik bir teklif
sunmalıdır.
7. Teklif, 60 günlük bir süre için geçerli
olacaktır.(Teklifin,son teslim tarihinden itibaren
geçerli tarih dikkate alınır.)
8. Ticari sicili ve banka PTT'de hesap sağlamanız ve
yetkili sahibinin kimliğini ek olarak ihale evraklarına
eklemniz gerekmektedir ve bu kişinin hasbına Suriye
içinde parayı aktarılacaktır.
9. İhale Teminatı: İhaleye katılmak isteyenler, ihalenin
kapanış tarihinden itibaren 60 gün geçerli olan 1000
Dolarlık geçici teminat garantisi vermelidir. Ihale
kapanış tarihinden itibaren 60 gün sonra seçilmeyen
tedarikçi firmalara teminat girişi geri iade edilecektir

Tedarikçi, nakit parayı USD cinsinden Bab Al Hawa'daki
ofislerimize devredebilir.
b) Türkiye’deki Tedarikçiler;
Türkiye’deki tedarikçiler, 2000 Dolar’lık geçici teminat
mektubu banka üzerinden sağlaması gerekmektedir.
İhale garantisini işlemlerini yaprken lütfen aşağıdaki

değerlendirilmiş olsa bile teklifin değerlendirme
dışında kalmasına neden olabilir.
10. Teminat bedeli, ihaleye sunulması ve ardından geri
çekilmesi durumunda veya ihalede belirtilen
malzemelerin bir kalemin veya sınıfını
tamamlamaktan dolayı özür olması durumunda
(değerinden) kesilecek ve (Satın Alma Komitesi
belirtilecektir). Teminatın ödenmemesi durumunda
sunulan teklif kabul edilmeyecektir.
11. İhaleyi kazanan teklif sahibi tedarikçi, kendisine
verilecek malzemelerin toplam değerinin toplam
maliyetinin% 5'i değerinde, banka üzerinden kesin

bond that will not be recieved in UİYV Istanbul office
within five days after the closure of the tender might
cuase the offer to be excluded from the evalaution, even
if the supplier was considered for the next stage of
evaluation.
10. The value of the guarantee will be deducted in the event of
submitting to the tender and then withdrawing from it, or
part of it in the event of an apology for not completing a
type or item of the materials mentioned in the tender (the
value of the discount will be estimated by the Procurement
Committee). In the event of non-payment of the
guarantee, the submitted offer will not be accepted.
11. The bidding supplier who wins the tender must submit a
letter of performance guarantee through the bank, worth
5% of the total cost of the total value of the materials to be
given to him. For suppliers in Syria, the money must be

quality inspection purposes.

‫الشروط القانونية‬

‫يعتبر ما دون بهذا التمهيد جزءا ال يتجزأ من العقد‪.‬‬ ‫‪.1‬‬

‫يقر الفريق الثاني انه اطلع على كافة المخططات وقد قام بدراستها ووافق على تنفيذ جميع االعمال المطلوبة طبقا للرسومات والمواصفات المتعاقد عليها ودفتر الشروط الخاصة والعامة والتي تعتبر جميعها جزء ال‬ ‫‪.2‬‬
‫يتجزأ من العقد‪.‬‬

 ‫اتفق الطرفان على قيمة االعمال المذكورة وفق ما ورد في جداول الكميات ويتم الدفع على دفعات حسب العمل المنجز أو حسب عدد الكتل السكنية المنجزة وهذا الدفع ال يعتبر بحال من األحوال انه تسليما منه‪ ،‬بأن‬ ‫‪.3‬‬
‫االعمال التي تمت أو نفذت طبقا للمواصفات والشروط المتفق عليها‪ ،‬وتعهد الفريق الثاني بالقيام بجميع االعمال المطلوبة المدرجة بهذا العقد وتعهد بأن ليس له الحق بطلب تعويض أي رسم أو مبلغ اضافي ألي سبب‬
‫كان أو أي ظرف‪.‬‬
‫وتعهد بتوفير الموقع المناسب وتقديم التصاريح والتراخيص وتذليل العقبات العقارية من إشارات مانعة للتصرف على العقار أو أي إشارات تمس حقوق المستفيدين‪.‬‬ ‫‪.4‬‬
‫‪ /‬تبدأ من تاريخ توقيع العقد واستالم العقار من المالك قيدا وتسجيلها بالسجل العقاري باسم المتعهد‪ ،‬ومعاينة المنظمة للموقع والتأكد من‬ ‫تحدد مدة تنفيذ المشروع وجميع االعمال للمشروع خال مدة ‪/‬‬ ‫‪.5‬‬
‫المساحة والموقع حسب الخريطة الهندسية للعقار وتنفيذ جميع االشغال ضمن الفترة المحددة‪ ،‬وال يتم دفع أي مبلغ للمتعهد حتى تسليم جميع الوحدات السكنية الى المنظمة وتكون مطابقة للمواصفات التي حددتها‬
‫المنظمة بموجب المناقصة المعلن عنها‪.‬‬
‫ً‬
‫على الفريق الثاني تقديم بيان مساحة منجز حديثا (أثناء فترة التعاقد) من قبل مساح معتمد ومصدق عليه من قبل المجلس المحلي‪.‬‬ ‫‪.6‬‬
‫يلتزم الفريق الثاني بالبرنامج الزمني بمواعيد تنفيذ االعمال المتعاقد عليها طبقا للشروط الموضوعة بالمناقصة ضمن مدة محددة لتنفيذ المشروع ويكون مسؤوال امام المنظمة عن االعمال التي يقوم بها واالشراف عليها‬ ‫‪.7‬‬
‫ومطابقتها للمواصفات المذكورة ببنود المناقصة من خالل الزيارات التي تدون على الدفتر اليومي الموجود لدى المتعهد والتوقيع عليه على التنفيذ او عدم الموافقة في حال المخالفة للشروط واستالم المراحل التي تم‬
‫تنفيذها‪.‬‬
‫غرامة التأخير‪ :‬توضع غرامة تأخير على المتعهد عن كل يوم تأخير إذا كان التأخير سببه المتعهد‪ ،‬وإذا كان مدة التأخير‪ 30‬يوم فإن المنظمة لها الخيار في فسخ العقد واالنحالل من العقد‪ ،‬أو االستمرار بالعقد كل ذلك‬ ‫‪.8‬‬
‫حسب وفق ماتراه المنظمة مناسبا ً لها‪.‬‬
‫على كل طرف التنبيه المبكر واشعار الفريق االخر عن الظروف التي تأخر االشغال على أن تكون الظروف غير طبيعية أو قوة قاهرة‪ ،‬أما الظروف العادية المألوفة فيجب أن ال تؤثر على التأخير وال يؤخذ بها‪.‬‬ ‫‪.9‬‬
‫إذا كان التأخير من قبل المتعهد بسبب غير قاهر‪ ،‬فللمنظمة الحق دون الحاجة الى انذار‪ ،‬عدم االستمرار بالتعاقد أو فسخ العقد‪ ،‬مع التعويض للمنظمة مايعادل قيمة األضرار الناتجة عن ذلك التأخير‪.‬‬ ‫‪.10‬‬
‫إذا توقف المتعهد عن العمل بدون مسوغ قانوني (قوة قاهرة) ولم يتم العمل في الميعاد المحدد‪ ،‬أو قام بمخالفة المخطط الموضوع والمواصفات الهندسية والشروط فالمنظمة لها الخيار أما فسخ العقد مع المتعهد أو‬ ‫‪.11‬‬
‫االستمرار بمتابعة العمل عن طريق متعهد اخر بعد أن يتنازل المتعهد عن العقار الى متعهد اخر واتمام العمل بالمشروع من قبل المتعهد الثاني‪ ،‬دون الحاجة الى انذار وإن حصل ولم يلتزم تنظر محكمة البداية المدنية‬
‫(أو الحاكم في المنطقة) بالخالف الناشئ بين المتعهد والمنظمة‪.‬‬
‫على الفريق الثاني أخذ موافقة خطية مسبقة‪ ،‬واتباع وتنفيذ تعليمات وارشادات لوائح الدوائر الرسمية فيما يتعلق بالبناء والمرافق العامة‪ ،‬وعدم مخالفة القوانين المعمول بها‪ ،‬واحترام جميع القوانين واألعراف المعمول‬ ‫‪.12‬‬
‫بها في المنطقة‪.‬‬
‫أي تعديالت على الرسومات والمواصفات الفنية يجب أن تصدر من المنظمة والمتعهد ملزم بما تمليه المنظمة عليه من تغير دون اعتراض ويقع على عاتق المنظمة دفع الفروق في حال التغير أو التعديل بالمواصفات‬ ‫‪.13‬‬
‫بما يتناسب مع التغير فقط وفق تقدير المنظمة‪.‬‬
‫يلتزم المتعهد بتنفيذ االشغال بصورة سليمة وفقا للعقد‪.‬‬ ‫‪.14‬‬
‫يتحمل المتعهد مخاطر الحروب أو االعمال العدائية – أو االضطرابات والشغب‪.‬‬ ‫‪.15‬‬
‫أي تقصير من المتعهد يتم اشعاره بالتقصير خطيا ً أو شفهياً‪ ،‬وعلى المتعهد اتخاذ الخطوات الممكنة عمليا لمعالجة التقصير‪ ،‬شرط ان ال يخالف ما اتفق عليه ببنود المناقصة‪.‬‬ ‫‪.16‬‬
‫للمنظمة وحدها الحق في متابعة سير العمل وعلى المتعهد اتباع إرشادات المنظمة بدقة وليس له االعتراض على ذلك‪.‬‬ ‫‪.17‬‬
‫يقع على عاتق المتعهد تقديم كل ما يلزم الوحدات السكنية من معدات ومواد بناء وسباكة‪-‬بلوك – وكل ما يلزم وحسب ما تم االتفاق عليه بموجب جداول الكميات التي وافق عليها المتعهد‪.‬‬ ‫‪.18‬‬
‫يضمن الفريق الثاني تنفيذ جميع المخططات والمواصفات والخرائط التي سلمت اليه من قبل المنظمة دون إنقاص أو زيادة عليها قد تغير من المواصفات أو االشكال الهندسية وأي مخالفة لها تقع على عاتقه ويتحمل‬ ‫‪.19‬‬
‫نتيجتها وتكاليفها االضافية إلعادة الحال لما اتفق عليه حسب المخطط الموضوع من المنظمة‪.‬‬
‫يضمن الفريق الثاني للفريق األول ما يحدث للبناء بعد تسليمه من هدم أو شرخ كلي أو جزئي ولو كان ذلك عن عيب في طبيعة األرض ذاتها‪.‬‬ ‫‪.20‬‬
‫يضمن المتعهد ما يوجد في المشروع من عيوب تهدد متانة البناء وسالمته خالل مدة الضمان تبعا ً لما ذكر سابقا وطبقا ً للعرف المتبع بالبلد الذي يتم البناء فيه‪ ،‬وأن يقوم بالعمل بكل أمانة ويبذل في سبيل ذلك الدقة‬ ‫‪.21‬‬
‫والعناية بما يبذله المهني المتخصص وأن يختار العمالة المختصة والمؤهلة‪.‬‬
‫يلتزم المتعهد بنقل ملكية المساحة المبينة والمخصصة للمرافق على الوحدات السكنية الى المستفيدين التي تحدد المنظمة أسمائهم وعددهم‪.‬‬ ‫‪.22‬‬

 ‫تحدد المنظمة أسماء مستفيدي السكن ويلتزم المتعهد بنقل الملكية العقار الذي تم بناء الوحدات السكنية عليه الى أسماء المستفيدين الذي تختارهم المنظمة بحيث يستفيد (العائلة الوحدة) من وحدة سكنية واحدة فقط‪،‬‬ ‫‪.23‬‬
‫ويلتزم المتعهد بنقل كافة ملكية أسهم العقار ‪ /2400/‬سهما الى أسماء المستفيدين متى رغبت المنظمة بذلك ودون اعتراض من المتعهد على أي مستفيد موضوع ضمن قوائم المنظمة‪.‬‬
‫ال يحق للمتعهد ان يعترض على أي مستفيد من السكن وعليه االلتزام بنقل الملكية للمستفيدين امام الدوائر القضائية أو امام السجل العقاري عندما ترغب المنظمة بذلك ودون أي اعتراض‪.‬‬ ‫‪.24‬‬
‫تختص المحاكم في منطقة العقار بالنظر في أي خالف ينشأ بين المتعهد والمنظمة أو أي شرط من شروط التعاقد أو تحل بواسطة التحكيم من قبل ثالثة محكمين يختارهم الفريقين أو يتم تعيينهم عن طريق المحكمة‬ ‫‪.25‬‬
‫وهم معفيون من التقيد باألصول المتبعة امام المحاكم‪.‬‬
‫يتم التعاقد مع المتعهد بعد نقل ملكية العقار الذي سيتم البناء عليه من المالك قيدا الى المتعهد في السجل خالي من أي اشاره مانعة للتصرف ويتعهد بنقل ملكيته للعقار الذي تم البناء عليه الى المستفيدين متى رغبت‬ ‫‪.26‬‬
‫المنظمة بذلك وبدون تراخي أو تأخير‪ ،‬بحيث أن للمنظمة وحدها الحق في تحديد مساحة كل كتلة سكنية وتوابعها من األرض التي تقرر نقل ملكتيها الى المستفيد‪ ،‬وال يتم انهاء حساب المتعهد إال بعد آخر تسليم‬
‫المستفيدين ونقل الملكية بأسمائهم مع استالم شهادة إتمام اعمال من المنظمة‪.‬‬
‫الرسوم والضرائب المترتبة على العقار يقع عبئها على المتعهد وعليه فقط دفع الضريبة العقارية والرسوم العقارية ومعاملة انتقال العقار من المالك قيدا ً الى المتعهد‪ ،‬ويسلم العقار الى المستفيدين خالي من الضرائب‬ ‫‪.27‬‬
‫والرسوم العقارية وال تتحمل المنظمة العبء أو الرسوم بانتقال العقار من المالك قيدا ً الى المتعهد ‪.‬‬
‫رسوم انتقال العقار من المتعهد الى المستفيد وما يتبعه من رسوم انتقال وضرائب تقع على عاتق المتعهد فقط‪.‬‬ ‫‪.28‬‬
‫تلتزم المنظمة بدفع تكاليف بناء الوحدات السكنية بعد أنتهاء نقل الملكية للمستفيدين وانتهاء فترة الضمان وكامل المبلغ المتفق عليه عند التعاقد لبناء الوحدات السكنية‬ ‫‪.29‬‬

‫‪Legal Conditions:‬‬
‫‪1. 1. The preamble below is an integral part of the contract.‬‬
‫‪2. The second party acknowledges that it has reviewed all the plans, studied them, and agreed to execute all required works in accordance with the agreed-upon‬‬
‫‪drawings, specifications, special and general conditions in the contract, all of which are considered integral parts of the contract.‬‬
‫‪3. The parties agree on the value of the mentioned works according to the quantity schedules, and payments will be made in installments based on the completed‬‬
‫‪work or the number of completed residential units. This payment does not constitute acceptance, provided that the work is carried out in accordance with the‬‬
‫‪agreed specifications and conditions. The second party undertakes to perform all required works listed in this contract and undertakes not to claim‬‬
‫‪compensation for any additional fee or amount for any reason or circumstance.‬‬
‫‪4. The second party undertakes to provide the suitable site, obtain permits and licenses, and remove any property obstacles, whether restrictive signals on the‬‬
‫‪property or any signals affecting the rights of beneficiaries.‬‬
‫‪5. The project's execution period and all works for the project are specified during the period / / starting from the date of signing the contract, receiving the‬‬
‫‪property from the owner, registering it in the land registry under the contractor's name, inspecting the site by the organization, confirming the area and location‬‬
‫‪according to the property's engineering map, and executing all works within the specified period. No payment will be made to the contractor until all residential‬‬
‫‪units are delivered to the organization and comply with the specifications specified by the organization in the announced tender.‬‬

 6. The second party must provide a statement of the recently completed area (during the contract period) by a certified surveyor approved by the local council.
7. The second party commits to the schedule for the execution of the contracted works according to the conditions set in the tender within a specified period for
project execution. They are responsible to the organization for the works they undertake, supervising them, ensuring their compliance with the specified
specifications in the tender through visits recorded in the daily book kept by the contractor, and signing it upon execution or disapproval in case of non-
compliance with the conditions. The organization will receive the completed stages.
8. Delay Penalty: A delay penalty is imposed on the contractor for each day of delay if the delay is caused by the contractor. If the delay period is 30 days, the
organization has the option to terminate the contract and dissolve it or continue the contract, all as deemed appropriate by the organization.
9. Each party must give early notice and inform the other party of the circumstances causing delays, indicating that the circumstances are not normal or force
majeure. Ordinary circumstances must not affect the delay and should not be taken into account.
10. If the delay is due to the contractor for reasons other than force majeure, the organization has the right, without the need for a warning, not to continue the
contract or to terminate it, with compensation to the organization equal to the value of the damages resulting from that delay.
11. If the contractor stops work without legal justification (force majeure) and work is not carried out at the specified time or violates the imposed plan, engineering
specifications, and conditions, the organization has the option to terminate the contract with the contractor or continue the work through another contractor
after the contractor relinquishes the property to another contractor. The second contractor completes the project without the need for a warning. If a dispute
arises between the contractor and the organization, the Civil Court (or the governing body in the region) will decide on the dispute.
12. The second party must obtain prior written approval, follow and implement the instructions and guidance of the official authorities regarding construction and
public facilities, not violate applicable laws, and respect all laws and customs in the region.
13. Any modifications to the drawings and technical specifications must be issued by the organization, and the contractor is obliged to accept and implement what
the organization imposes on it without objection. The organization is responsible for paying the differences in the event of a change or modification in the
specifications, only in proportion to the change, according to the organization's discretion.
14. The contractor is committed to executing the works properly according to the contract.
15. The contractor bears the risks of wars, hostile acts, or disturbances and riots.
16. If there is any negligence on the part of the contractor, they will be notified of the negligence in writing or verbally, and the contractor must take practical steps
to address the negligence, provided that it does not contradict what was agreed upon in the tender terms.
17. Only the organization has the right to monitor the progress of the work, and the contractor must strictly follow the organization's instructions without
objection.
18. It is the responsibility of the contractor to provide all the necessary equipment, building materials, plumbing, and blocks for the residential units, as agreed upon in
the quantity schedules approved by the contractor.

19. The second team ensures the implementation of all plans, specifications, and maps provided to them by the organization without any deduction or addition. Any
deviation from them is the responsibility of the second team, and they bear the consequences and additional costs to restore the situation to what was agreed
upon according to the plan set by the organization.

20. The second team guarantees what happens to the construction after delivery, whether it is demolition or partial or complete cracking, even if it is due to a defect in
the nature of the land itself.

21. The contractor guarantees any defects in the project that threaten the durability and safety of the construction during the warranty period, as mentioned earlier and
in accordance with the prevailing customs in the country where the construction takes place. The contractor is committed to working with integrity, exercising
precision and care, employing specialized and qualified workforce.
22. The contractor commits to transferring the ownership of the designated area allocated for facilities to the residential units to the beneficiaries, as determined by the
organization, including their names and numbers.
23. The organization specifies the names of the housing beneficiaries, and the contractor commits to transferring the property of the real estate on which the residential
units are built to the names of the beneficiaries chosen by the organization. The contractor agrees to transfer all ownership of the property (2400 shares) to the
names of the beneficiaries whenever the organization desires, without objection from the contractor to any beneficiary listed by the organization.
24. The contractor is not entitled to object to any housing beneficiary, and they must commit to transferring ownership to the beneficiaries before the judicial
authorities or the land registry when the organization wishes, without any objection.

25. The courts in the property's jurisdiction have the authority to adjudicate any dispute that arises between the contractor and the organization or any condition of the
contract or to be resolved by arbitration by three arbitrators chosen by both parties or appointed by the court. They are exempt from adhering to the procedures
followed in the courts.
26. The contract with the contractor is made after the transfer of ownership of the property on which the construction will take place from the owner to the contractor,
registered in the record free from any impediments. The contractor undertakes to transfer ownership of the property on which the construction has been done to
the beneficiaries whenever the organization wishes, without delay. The organization alone has the right to determine the area of each residential block and its
annexes from the land to be transferred to the beneficiaries. The contractor's account is not terminated until after the final delivery to the beneficiaries and the
transfer of ownership in their names, along with receiving a completion certificate from the organization.
27. The fees and taxes on the property are the responsibility of the contractor. Only the contractor is obligated to pay property tax and property transfer fees for the
transfer of the property from the owner to the contractor. The property is delivered to the beneficiaries free of taxes and property transfer fees, and the
organization does not bear the burden or fees for the transfer of the property from the owner to the contractor.
28. The fees for the transfer of the property from the contractor to the beneficiary and any subsequent transfer fees and taxes are the sole responsibility of the
contractor.
29. The organization undertakes to pay the costs of building the residential units after the transfer of ownership to the beneficiaries, the end of the warranty period,
and the full amount agreed upon at the contract for the construction of the residential units

6. İkinci tarafın, bir yerel konsey tarafından onaylanmış bir mühendis tarafından belirtilen sözleşme süresi boyunca gerçekleştirilen alanın bir beyanını sağlaması
gerekir.
7. İkinci taraf, sözleşme kapsamındaki işlerin uygulama programına ve belirlenen sürede projenin tamamlanması için belirlenen tarihlerine bağlı kalır. Yapılan
işlerden ve belirtilen şartlara uygunluğunu gözetlemek, yapılan ziyaretleri yüklenicinin günlük defterine kaydetmek ve uygulama veya uygunsuzluk durumunda
imzalamak, örgüt karşısında sorumludur ve tamamlanan aşamaları teslim alır.
8. Gecikme Cezası: Gecikmenin sebebi yüklenici ise, her gecikme günü için bir gecikme cezası uygulanır. Gecikme süresi 30 gün ise, örgütün sözleşmeyi feshetme ve
iptal etme veya sözleşmeye devam etme seçeneği vardır, örgütün uygun gördüğü şekilde.
9. Her iki tarafın da işleri geciktiren durumları erken bildirmesi ve diğer tarafı bu gecikmeler hakkında bilgilendirmesi gerekmektedir. Bu durumlar olağandışı veya
zorlayıcı olmalıdır. Olağan durumlar, gecikmeye etki etmemeli ve dikkate alınmamalıdır.
10. Gecikme, yüklenici tarafından zorlayıcı olmayan nedenlerle kaynaklanıyorsa, örgütün uyarıya gerek olmaksızın sözleşmeye devam etmeme veya feshetme hakkı
vardır ve bu durumdan kaynaklanan zararın değerine eşdeğer bir tazminat talep edebilir.
11. Eğer yüklenici yasal bir sebep olmaksızın (zorlayıcı bir sebep) çalışmayı durdurursa ve belirlenen tarihte çalışma yapılmazsa, veya yüklenici koyulan plana,
mühendislik özelliklerine ve şartlara aykırı hareket ederse, örgütün, yükleniciyle sözleşmeyi sonlandırma veya başka bir yüklenici aracılığıyla işe devam etme
seçeneği vardır. Yüklenici, mülkiyeti başka bir yükleniciye devrettikten sonra proje üzerinde çalışmayı tamamlamak zorundadır ve uyarıya gerek olmaksızın, eğer
yüklenici uyum sağlamazsa, Mahkeme (veya bölgedeki hakim) yüklenici ile örgüt arasındaki anlaşmazlığı değerlendirir.
12. İkinci tarafın önceden yazılı onay alması, resmi kurallara ve yapı ve genel tesislerle ilgili resmi dairesinin yönergelerini takip etmesi ve uygulaması, geçerli
yasalara aykırı hareket etmemesi ve bölgedeki tüm yasalara ve alışkanlıklara saygı göstermesi gerekmektedir.
13. Çizim ve teknik özelliklerde yapılan herhangi bir değişiklik, örgüt tarafından yayınlanmalıdır. Yüklenici, değişikliklere itiraz etmeden bu değişikliklere bağlıdır ve
değişiklikler veya özelliklerdeki değişiklikler durumunda farkları ödeme sorumluluğu örgüte aittir, sadece değişiklikle orantılı olarak örgütün takdirine bağlı
olarak.
14. Yüklenici, işleri sözleşmeye uygun bir şekilde gerçekleştirmeyi taahhüt eder.
15. Yüklenici, savaş veya düşmanca eylemler, anarşi ve ayaklanma risklerini taşır.
16. Yüklenicinin herhangi bir kusuru yazılı veya sözlü olarak bildirilir ve yüklenici, kusurları gidermek için gerekli adımları atmakla yükümlüdür, öngörülen ihale
şartlarına aykırı olmamak şartıyla.
17. Sadece örgütün işlerin ilerleyişini izleme hakkı vardır ve yüklenici, örgütün talimatlarını sıkı bir şekilde takip etmekle yükümlüdür, buna itiraz hakkı yoktur.

 18. Müteahhitin, konut birimleri için gerekli olan tüm ekipmanları, inşaat malzemelerini, tesisatı ve blokları, müteahhit tarafından onaylanan miktar tablolarına
uygun bir şekilde temin etme yükümlülüğündedir.
19. İkinci ekip, organizasyon tarafından kendilerine teslim edilen tüm planların, özelliklerin ve haritaların eksiksiz bir şekilde uygulanmasını sağlar ve bunlarda
herhangi bir eksiltme veya ek yapmaz. Bu konuda herhangi bir sapma ikinci ekibin sorumluluğundadır ve bu sapmaların sonuçları ile bunların düzeltilmesi için ek
maliyetler ikinci ekip tarafından karşılanır.

20. İkinci ekip, teslim sonrası yapıya ne olursa olsun (yıkım, kısmi veya tam çatlamalar gibi) meydana gelen durumları garanti eder, hatta bu durumlar arsanın
doğasındaki bir kusurdan kaynaklanıyorsa bile.
21. Müteahhit, projede meydana gelebilecek yapısal dayanıklılığı ve güvenliği tehdit eden tüm kusurlardan, önce belirtilen süre boyunca ve yapı inşa edilen ülkede
uygulanan geleneklere uygun olarak, sorumludur. Bu görevi yerine getirirken, uzmanlık alanındaki profesyonellikle çalışır, titizlikle ve dikkatle çalışır, uygun ve
nitelikli işgücünü seçer.

22. Müteahhit, tesislere tahsis edilen belirtilen alanın mülkiyetini, organizasyon tarafından belirlenen isim ve sayıdaki hak sahiplerine devretmeyi taahhüt eder.

23. Organizasyon, konut hak sahiplerinin isimlerini belirler ve müteahhit, konut birimleri inşa edilen gayrimenkulün mülkiyetini, organizasyonun seçtiği hak
sahiplerinin isimlerine devretmeyi taahhüt eder. Organizasyonun listesinde yer alan herhangi bir hak sahibine karşı müteahhidin itirazda bulunmaması
gerekmektedir.
24. Müteahhidin, konut hak sahiplerine karşı herhangi bir itirazda bulunma hakkı yoktur ve müteahhit, organizasyonun bu talebi üzerine mülkiyeti hak sahiplerine
devretmeye yönelik herhangi bir itirazda bulunmamalıdır.
25. Mülkiyetin transferi sonrasında ve garanti süresinin sona ermesinin ardından, organizasyon tarafından belirlenen konut birimlerinin inşa maliyetlerini ödemeyi
taahhüt eden bir sözleşme yapılmaktadır.
26. Müteahhit, inşaatın gerçekleşeceği mülkiyetin sahibinden müteahhide geçtikten sonra, üzerinde herhangi bir engel olmadan kayıtlı olarak gerçekleşmelidir.
Müteahhit, inşa edilen mülkiyetin sahibi olduğu toprakları, organizasyonun bu talep ettiği herhangi bir zamanda hak sahiplerine devretmeyi taahhüt eder.
Yalnızca organizasyon, hak sahiplerine devredilecek her konut bloğunun alanını belirleme hakkına sahiptir. Müteahhidin hesabı, hak sahiplerine tam teslimatın
ve mülkiyetin isimlerine geçişin ardından sona erir ve organizasyonun tamamlama sertifikası almasıyla sona erer.
27. Gayrimenkul üzerindeki ücretler ve vergiler müteahhidin sorumluluğundadır. Yalnızca müteahhit, mülk vergisini ve mülkiyet transfer ücretlerini ödemekle
yükümlüdür. Organizasyon, mülkiyetin sahibinden müteahhide transfer ücretleri ve vergileri için herhangi bir yükümlülüğü taşımaz.
28. Mülkiyetin müteahhitten hak sahibine transfer edilmesinden kaynaklanan ücretler ve sonrasında gelen transfer ücretleri ve vergiler yalnızca müteahhidin
sorumluluğundadır.

29. Organizasyon, mülkiyetin hak sahiplerine devredilmesinin ardından, garanti süresinin sona ermesi ve konut birimlerinin inşası için sözleşmede belirlenen tam
miktarın ödenmesini taahhüt eder.
