APPLICATION UNDER SECTION 439 OF THE CODE OF CRIMINAL


PROCEDURE 1973 FOR GRANT OF BAIL

Most Respectfully Show:

1. That the present application under section 439 of the Code of


Criminal Procedure 1973 is being filed by the Petitioner for seeking
grant of bail in FIR No. 420/2024 registered at Tumkur Police . The
present petition is being moved as the Petitioner has been arrested on
15/05/2024 in connection with the said FIR. The petitioner is now in
judicial/police custody.
2. That the Petitioner is innocent and is being falsely implicated in
the above said case as he has nothing to do with the matter.

3. That the Petitioner is a law abiding citizen of India. The


petitioner is good student and calm in nature studying 5th semester E
& C Ruhi Institute of science and technology, college at Tumkur.

4. That the Petitioner is a responsible person and is living at the


above mentioned address.

5. The Petitioner and the deceased/ victim are very close friends.
The both studying in the same college and they planned to marriage
also with the consent of the parents.

6. The victim invited the petitioner/accused on 15/5/2024 when she


was alone to discuss about their marriage. The victim/deceased forced
the petitioner/accused on that day to marry instantly. The petitioner
denied for that and arguments were broken.

7. The petitioner went to meet the deceased/victim without any


criminal intention of weapon.

8. The wordy insulation on the petitioner/accused by the


deceased /victim was made the petitioner so emotional to stab with
the knife on the table.

9. Even after realising the situation the petitioner tried to call for
help of Ambulance but due to instant assemble of unknown nearby
with commotion the petitioner ran away from the place.

10, The petitioner is young and age about only 22 years and already
in trauma of the event and lost his mental stability. He need the
physiological treatment to carry a normal life.
11. The petitioner was not involved any previous criminal activity
in any manner during the course of the study and no case or complaint
was filed so far.

12. That the Petitioner is innocent and no useful purpose would be


served by keeping him under custody and this is a fit case for grant of
bail. The charge sheet has been filed.

13. That the Petitioner undertakes to abide by the conditions that


this Honorable Court may impose at the time of granting bail to the
Petitioner and further undertakes to attend the trial on every date of
hearing.

14. That the Petitioner has not filed any other similar petition
before this or any other Honorable Court for grant of bail in case of
the present FIR.

PRAYER:

In view of the above stated facts and circumstances it is most


respectfully prayed that this Honorable Court may be pleased to

a. Grant bail to the Petitioner in connection with FIR No. 420/2024


registered under section 299,300,322, 324,326,350,354 of IPC for the
offence of murder at Tumkur Police Station .

b. Pass any other such order as this Honorable Court may deem fit
and proper in the interest of justice.
