The Suit is presented on 14.11.2018 and registered on


15.11.2018.

The suit is valued at `.6,00,000/- for the purpose of


Court fee and jurisdiction being the share of the plaintiff
and fixed court fee of `.200/- is paid herewith under section
35(2) of the Karnataka Court Fees and Suit Valuation act.

The cause of action for the suit arose on third week of


October 2018 when the defendants acted detrimental to the
interest of the plaintiff and the plaintiff requested and
demanded partition of the plaint ‘A’ schedule property with
the defendants and subsequently at Shivapura Village of
Karkala Taluk which is within the jurisdiction of this court.

The suit is filed by the plaintiff against defendants


praying for pass a judgment and decree:

1. For the partition of the plaint ‘A’ schedule


property into 5 fair and equal shares
considering the good and bad soil, allot and
delivery of one such share to the plaintiff.

This suit coming on 20.12.2019 before me for final


disposal in the presence of Sri. K. Sriramana Acharya,
Advocate for Plaintiff, Defendants No.1 to 24 are placed
Exparte. After recording evidence both side and heard
arguments on 27.11.2019 & and upon perusal of the plaint
and other material papers "THIS COURT DOTH HEREBY
ORDER AND DECREE " as follows:

i) That, the suit is hereby decreed.

ii) That, the plaintiff is entitled to 1/5


share in the plaint ‘A’ schedule
property.

iii) That, the defendant No.1 is entitled to


1/5 share in the plaint ‘A’ schedule
property.

iv) That, the defendants No.2 to 7 are


jointly entitled to 1/5 share in the
plaint ‘A’ schedule property.

v) That, the defendant No.8 to 17 are


jointly entitled to 1/5 share in the
plaint ‘A’ schedule property.

vi) That, the defendant No.18 to 24 are


jointly entitled to 1/5 share in the
plaint ‘A’ schedule property.

vii) That, the parties are directed them to


bear their own costs.
