SUBJECT: NOTICE OF VIOLATION

Sir/Madam:

Notice is hereby served upon you for having violated certain provisions of RA 8749
“Philippine Clean Air Act of 1999”and its IRR based on the monitoring conducted by EMB
Caraga Personnel on January 18, 2024.

ACT/S CONSTITUTING THE VIOLATION

FINDINGS
Failure to designate an accredited
Pollution Control Officer.
Failure to submit the Self-Monitoring quarterly basis. SMR covering activities in a
Report (SMR) regularly.
PROHIBITED ACTS
DAO 2014-02 Section 7. Appointment /
Designation of PCOs. The Managing Heads
of establishments, xxxx shall
appoint/designate and seek accreditation of
Pollution Control Officer.
Section 5 of DAO 2003-27. Submission of
SMR. Unless provided otherwise, all
covered firm shall submit the SMR on a
quarter shall be submitted within fifteen (15)
calendar days after the end of the said
quarter as may be determined by the DENR
RO concerned.

The foregoing considered, you are hereby required to explain in writing, duly subscribed
before a Notary Public, within ten (10) days from receipt hereof, why you should not be
penalized in the amount of Twenty Three Thousand Five Hundred Seventy Nine Pesos and
48/100 (P23,579.48) pursuant to Pollution Adjudication Board Resolution No. 5, Series of 2021,
and to show cause why no Order should be issued against you directing immediate cessation of
the project operation.

Moreover, you are hereby invited to attend a Technical Conference for the following purposes:

1. Simplification of the issues and stipulation of facts; and

2. Execution of a commitment to abate or mitigate the pollution, including the
implementation of remedial measures, within a period that shall not exceed ninety (90)
days.

The Technical Conference will be held on May 23, 2024, 2:00 PM at EMB Caraga Regional
Office, Ambago, Butuan City. Failure to appear or submit your explanation shall be construed
as waiver of your right to be heard and this Office shall institute appropriate legal action against
you based on the evidence on record.
