Notice is hereby served upon you for having violated certain provisions of RA No. 8749 and
PD No. 1586 based on the inspection conducted by EMB Caraga Personnel on May 31, 2024.

ACT/S CONSTITUTING THE VIOLATION

FINDINGS PROHIBITED ACTS

1. Operating an air Pollution Source
Equipment without a valid Permit
to Operate issued by the EMB

DAO 2000-81 (IRR of RA 8749). Part VI,
Rule XIX, Section 1. Permits Required. All
sources if air pollution subject to these
implementing Rules and Regulations must
have a valid Permit to Operate issued by the

2. Operating a malfunctioned or Rule XXV, Part VII, Section 13 of DAO 2000-

damaged air pollution source 81 (Prohibited Acts) – e.5.All pollution
equipment control devices and systems shall be properly
and consistently maintained and correctly
operated in order to maintain emission in
compliance with the provisions and
standards of Section 19 of the Act. No
facilities shall be operated without the

except with the permission of the
Department through the Bureau when

The foregoing considered, you are hereby required to explain in writing, duly subscribed
before a Notary Public, within ten (10) days from receipt hereof, why you should not be

penalized the amount Twenty Three Thousand Five Hundred Seventy Nine Pesos and 48/100
(P23,579.48) for each of the violations stated pursuant to Pollution Adjudication Board
Resolution No. 5, Series of 2021 and to show cause why this incident shall not be elevated to
the Pollution Adjudication Board. Similarly, same shall be considered as violation of the
conditions of your ECC which is punishable by a penalty in the amount not to exceed Fifty
Thousand Pesos (P50,000.00) for every violation.

Moreover, you are hereby invited to attend a Technical Conference for the following
purposes:

1. Simplification of the issues and stipulation of facts; and

2. Execution of a commitment to abate or mitigate the pollution, including the

implementation of remedial measures, within a period that shall not exceed ninety
(90) days.

The Technical Conference will be held on July 22, 2024, 3:00 PM at EMB Caraga Regional
Office, Ambago, Butuan City. Failure to appear or submit sworn explanation shall be
construed as waiver of your right to be heard and this Office shall act based on the evidence
on record.
