SUBJECT: NOTICE OF VIOLATION

Sir/Madam:

Notice is hereby served upon you for having violated certain provision of P.D No.1586 or
“Philippine Environmental Impact Assessment System” and its Implementing Rules and
Regulations based on the validation conducted on January 17, 2024 by EMB Caraga Personnel.

ACT/S CONSTITUTING THE VIOLATION

FINDING/S PROHIBITED ACT/S

 The project has commenced and is PD 1586, Sec 4. xxx No person shall
operating without an issued undertake or operate any such declared
Environmental Compliance environmentally critical project without first
Certificate (ECC) issued by this securing an Environmental Compliance
Office. Certificate.

The foregoing considered, you are hereby required to explain in writing, duly subscribed
before a Notary Public, within ten (10) days from receipt hereof, why you should not be
penalized in an amount not to exceed Fifty Thousand Pesos (P50,000.00) as provided for in
Section 9 of Presidential Decree No. 1586 in relation to Section 4 of the said Decree and its
Implementing Rules and Regulations and to show cause why no Order should be issued against
you, directing immediate cessation of the project operation.

Moreover, you are hereby invited to attend a Technical Conference for the following purposes:

1. Simplification of the issues and stipulation of facts; and

2. Execution of a commitment to abate or mitigate the pollution, including the

implementation of remedial measures, within a period that shall not exceed ninety (90)
days.

The Technical Conference will be held on April 9, 2024, 11:00 AM at EMB Caraga Regional
Office, Ambago, Butuan City. Failure to appear or submit your explanation shall be construed
as waiver of your right to be heard and this Office shall institute appropriate legal action against
you based on the evidence on record.
